My lease states that there is a penalty in the amount equal to one months rent, AND I cannot get the security deposit back (also equal to one months rent). So that is essentially a two months' rent penalty for breaking the lease. This penalty is in place even if the landlord is able to rent the property out during the time I would have been renting. This seems to be an unusually harsh penalty. I looked at Georgia code, and couldn't find any information about reasonable fees. Are these fees considered exorbitant? Are there any legal caps to fees for lease termination?

That amount is common and acceptable. Looking at the other way, would you want to be liable for the entire lease if the landlord could not rent all similar units? You and the landlord agreed in the lease to not risk it either way, and instead set a fix amount. As an aside, if it is an apartment complex the question is not whether the landlord could find someone for your particular unit. Those people would likely have rented in the same complex anyway and the landlord still has one less unit leased.

I reitterated to the girl, when she took my urine, it has to go to LabCorp, or my insurance wont pay. To make a long story short: Under "2014 California Rules of Court, Rule 5.125 (b)(1) Respondent's Attorney served me "Copy of Proposed Order". Rule 5.125 (c)(1)(B) I served Respondent's Attorney with "Alternate Proposed Order". Rule (e) Respondent/Attorney did NOT do. Respondent Attorney sent in her Original Proposed Order to the Court (as if I had approved) and had that Order become the Court Order; also this is not the first time. We had to come back to Court a year later because she did not put in payment date of the Spousal Support Arrears her client owed me (wiggle room for her client when to pay). My question is when we went to the Hearing Yesterday, the Judge and Respondent's Attorney acted as if they had a previous meeting and Respondent's Attorney said that she had withdrawn request for Attorney Fees and both Judge and Attorney acted as if they both knew what was to be ordered. Do you think that the Judge Reprimanded the Attorney for what she did not do as required by the Rule and did the Judge cover the Attorney's (b.....) for something I could have filed against her? I am just surprised at what happened prior and during the hearing and just trying to figure out what.

You did not fully understand the process. In this case the other attorney should have either removed the attorney fee provision or notified you that she was sending her version of the order to the court. your next step would have been to send your version of the court order to the court for a signature. The judge would have then decided which order to sign. If the judge is uncertain as to which order is the proper order the judge would have called both of you into court to discuss the matter. If the other attorney does not prepare the order then you should prepare the order. Send the other side a copy and after 10 days send your order to the court along with a letter explaining what you did.

The judge and other attorney did not have a discussion before the hearing. They both what the order would be well prior to the hearing.motion you should consult with an attorneyet y or better retain an attorney and request that your attorney fees pay your attorney fees.

A short history description. Long ago everyone accused of a crime was taken to jail. Even drivers accused of going four miles over the limit. Some were released, and others had their crime or violation recorded in the Court calendar book. That is where the term "booking" comes from. A person who was booked sat in jail until they went in front of a judge. Some got someone to post a bond (promise to transfer property, usually money, to the Court, if the defendant fails to appear for arraignment or trial. That is very expensive system for any governmental body to undertake, especially cities, towns and villages.

The traffic ticket or Summons was created to simplify and economize the system. They work about the same way as an arrest. Drivers are most often given the ticket before they are allowed to drive away. People observed committing a crime in their house are seen as less of a flight risk because the Police "know where they live." So, in minor drug cases it is common for the ticket, citation or Summons to be mailed to them at that residence. Supposedly, it allows officers and prosecutors time to decide which crimes and violations to charge.

In fact, for white collar type crimes, it is very rare for anyone to be arrested. They or their lawyer get a letter telling them to be in a certain courtroom at a certain date and time.

It sounds like your friend was Summoned to pay a fine or appear before a judge by a certain date, or a Bench Warrant (for her arrest) will be issued. The city or County has only a few months or years to bring criminal or violation charges. As long as they don't exceed that time nothing prevents them from mailing the citation or ticket long after observing the activity.

Her attorney should know what to do. She can contact the Missouri Bar to get referrals to criminal defense attorneys in her area. Since the felony can get her significant incarceration, the Court can appointment a public defender or appoint private counsel for her.

Thank you for being concerned enough about your friend to seek to understand the process better. But, if she did even some of the things they allege, you might want to monitor how close you get or how and where you spend time together. People on the drug radar often get their friends in trouble too. Advise her to consult directly with an attorney as soon as she can.

In 1937, a man named George Steblitz develops his "Model K" to solve complex calculations and while working at Bell Labs made improvements and in 1940 while at Dartmouth College, teletypes a problem to his "Complex Number Calculator" in New York, which sends back the results.

Your failure to respond could result in the plaintiff brining a motion to compel those responses, and possible monetary sanctions against you by the court. If you have the time to spend in a law library figuring out what you need to do, you could do the responses yourself. However, there are very specific rules concerning discovery which you must follow (such as providing the responses under oath) or any response you give may be no better than no response at all. It would be better for you to hire an attorney to represent you so you don't do something wrong.

Yes, the person above me is definitely right. What really ticks me off is when people give you dirty looks and they just stay away from you. Its almost like there's a huge plastic bubble around you that no one wants to touch. The individuals who are spreading rumors are probably people who are un-confident and they have nothing better to do with their life than make other people feel bad. Don't let these people ruin your life. Right, keep your distance. If other people have heard this horrible rumor, and they believe it just because of someone telling them with no proof, then they are just as un-confident as the people spreading the rumor. If the rumor hasn't spread too far, befriend the people who you know haven't heard. Once the rumor gets to them, and if what your personality has been like so far is completely the opposite, then they shouldn't believe the rumor.

A far better and more constructive suggestion would have been for your son's pediatrician to have recommended that you have your son tested by a an experienced child psychologist to determine the source and reason for your son's statements.

You did not say what kind of Petition is being prepared, but I can tell you with a great deal of certainty that if it is a Petition to Modify Custody and take your son away from his mother at this time when he needs to feel secure and have a sense of stability will do him more harm than you can imagine and which will have long term effects on him. Ex parte matters are unusual in how they are handled. In many courts, the judge does not even take the bench. The court clerk takes the ex parte papers back to the judge in chambers, and relays comments from the parties. The judge will issue a decision from chambers. You can ask to see the judge, of course, but it is rare that the judge will see you.

It would be smart to prepare a short paper saying why you oppose the ex parte. The lack of a rush is a good reason for an opposition, and to have the motion heard in the regular course of things.

You cannot prevent the ex parte hearing -- but you can oppose it as I stated above. You will also want to go to the hearing, so that the court clerk can tell the judge you are there and that you oppose. Your presence will confirm your opposition, if nothing else.

He has not seen the 2 boys in 2.5 years (6yrs and 4yrs old). The youngest only knows my current husband as his dad and the oldest wants nothing to do with my ex (abuse issues). Was the son who made the changes the son of the sister who holds the power of attorney?

If he is then you can ask the Court to remove the power of attorney on the basis that the sister breached her duty by allowing her son to make the changes.

The fact that the brother takes care of and has the patient living with him does not effect the power of attorney. However, the brother can seek guardianship and note that the patient lives with him and is under his care.

Generally speaking, a partnership interest is not transferred rather it is sold. If there is a partnership agreement then you would have to follow the prescribed process for the purchase of a partner's share. Ideally, the four partners would have to come to an agreement. There are scenarios where a partner can sell his share without the acquiescence of the other partners. This would require a careful analysis of the facts as well as a review of the possible intended and unintended outcomes, one of which could be the dissolution of the partnership.

The above is generally correct also in the event the "partnership" is actually an LLP, LLC or a corporation.

its usually on a fuse panel under the hood probably close to the battery if you can't find it disconnecting and reconnecting after 10 minute will reset the computer. but you will lose all your preset radio satations. also make sure you put the correct amount of oil in your car. if you don't want to dissconnect your battery and you can't find the switch a garage will reset it for you or it might just go off on its own eventually
