How can a 12 year old girl make 400 in a month?
Start your own website or blog. It's all about the Internet these days. If you spend enough time on a website to make it useful or interesting, your site views will accumulate and if it gets popular, advertisements will want to pay you to put their ads on your site. Keep in mind you must be serious and diligent about updating your website/blog. The more time put into it, the more you'll get out of it.
There are many websites out there that let you create your own website for free; google "how to create my own website."

Although that is one of the most ideal ways to earn some cash each month, it is not always dependent. Try observing what people in your school would pay for---food, crafts, stationery, etc. and sell that item. Creating your own business at school is another great way to earn money at a young age.

Good luck.

Question

We signed a one year lease with the owner of the home and gave him a check for $2,500.00 for the deposit. He in turn gave us the keys and the garage door openers. Exactly 6 days before our move date he told us that he had to sale the home because of a financial bind. He tried to find us another home and in turn we had to go with another property management company, pay 1,000 more for a deposit and purchase a refrigerator and washer/dryer (the other house had those appliances already in the home). Do we have a case to take him to court atleast for the extra money we had to pay out?

Answer

To start, the sale of the home doesn't terminate the landlord's obligation (nor the tenant's) under a lease. A foreclosure could, but not a sale. What your landlord would be selling would be a tenant-occupied income property, not a vacant house, but you'd have had a right to remain as the tenant (unless the lease contained a specific termination-upon-sale clause, which is rather unusual in residential leases). Consider, for example, the situation where a large office building such as the Sears Tower or the Empire State Building gets a new owner. Do you imagine the chaos if all the hundreds of tenants got evicted as a result of the sale? It's the same with single-tenant residences, apartment buildings, stores, and everything.

You probably have a case for return of your deposit and some amount of money damages for breach of the lease. I'm somewhat doubtful about whether you would be awarded the outlays for additional deposit and/or the appliances as specific losses you have incurred, because the deposit is refundable and the appliances expenditures aren't so much a loss to you as a transfer of one kind of asset into another, but it's worth a try. Small claims may be a good venue.

A possible drawback is that if the (former) landlord is or was in a financial bind, he may not be able to pay any judgment you get against him.

Question

Hello I am recently divorced and am trying to change back to my maiden name. Unfortunately, I was not in the country when the divorce went through and so wasn't able to stipulate a name change. I am living/working out of the country right now and the county clerk (where I got my divorce decree) says I can't get it done there because I don't live there any more. But another person says I can, so I'm getting conflicting information. It would be easier if I could get it done where I'm currently living (South Korea), but is it possible? Or do I need to get it done in the States? Thanks

Answer

The question really pertains to residency. If you are in the military, that's no problem because your legal residence is the county you are from. If you are temporarily in Korea but have no intention of staying there and you still intend that your home is in whatever county it is in Iowa, I think it could be done remotely if you have not given up your residency. Evidence of that would be filing an Iowa income tax return or owning property.

You would however have to sign the petition in front of a notary public before it is filed. Iowa Code chapter 674 gives you all the needed information.

Dr. Wally Hastings - Northern State University
Walter Dean Myers
1937-
Life:
Myers was born into a large West Virginia family in 1937, in the midst of the Great Depression. Two years after his birth, his mother died, leaving his father with eight children to care for and no job. In 1939, his father's previous wife, a mixed-race (white/Native American) woman from whom he had been divorced due to family pressures, came to take her two daughters with her to New York, where she now lived with her second husband, Herbert Dean. The Deans decided to adopt Walter along with his half-sisters, and so he came to grow up in Harlem.
Though poorly educated themselves, the Deans taught Walter to read by the time he was four. His mother had Walter read to her every day from True Romance magazine and eventually from other sources, and his father and grandfather told him stories. Despite his obvious ability, though, young Walter had trouble on the playground because of a speech impediment; he was frequently involved in fights when the other children teased him, so much so that by the time he was in fourth grade, he was threatened with suspension. Fortunately, his fifth grade teacher recognized his writing ability and channeled his energy into creative writing.
Walter's childhood life revolved around the church, which was not just a place of worship but an activity center where he learned basketball and dance. He says, "I am a product of Harlem and of the values, color, toughness, and caring that I found there as a child."
His talents brought Walter a place in an accelerated junior high program and ultimately at Stuyvesant High School, a strong academic environment (the same school that Steve Harmon attends in Monster). Again, one of his teachers encouraged his writing, and he received some writing awards; but his school attendance became spotty as he would spend days reading and writing in the park rather than attending class.
Myers began hanging with the "wrong crowd," and, knowing his family couldn't afford college, dropped out of high school at 15. He soon returned but then left again, and at the age of 17 joined the army to escape. After three years, he returned to civilian life, taking a factory job in New Jersey and then a position with the Post Office. He married a woman he met in the Post Office job and began once again to write - publishing stories and poetry in (mostly) black-oriented magazines.
Myers took college classes but did not finish school; meanwhile, his first marriage was falling apart under the strain. In 1970, he was hired as an acquisitions editor for Bobbs Merrill, a publisher interested in developing more black writers for young people. Already, he had published his first children's book, a picture book published by Parents Magazine Press. Myers had written it for a contest, "more because I wanted to write anything than because I wanted to write a picture book." In 1975, he wrote his first young adult novel, Fast Sam, Cool Clyde, and Stuff. Two years later, he left Bobbs Merrill and undertook to write full time.
Supporting oneself by writing alone requires discipline. Myers' daily routine begins with early rising, usually before 5 a.m., for a daily 5-mile walk. He returns home and showers, then starts into work by about 7: "I try to get ten pages done. Once I do my ten pages, that's it."
The idea for Monster goes back to a series of interviews with prisoners Myers did during one of his attempts at college, in the late '70s:I did 600 pages of interviews with prisoners in New York and New Jersey. And patterns began to emerge. They all knew why they were in jail; they knew what crimes they had committed or had been accused of committing, but they never seemed to be really sure of the path that had got thm there. . . . All these people felt that they were good people. They were always talking about whether they were guilty or innocent, and the discussion were legal arguments. (Rochman)
Later, he witnessed the trial of a 17-year-old charged with armed robbery and attempted murder, right across the street from a high school, and was struck by the short distance between those ordinary students and this young man's situation.
Walter Dean Myers twice received Newbery Honor recognition (for Scorpions, 1989, and Somewhere in the Darkness, 1993) and is a three-time recipient of the Coretta Scott King Award. In 2000, Monster (a Coretta Scott King Honor book) was named the first winner of the Michael L. Printz Award for "literary excellence in young adult literature."
Monster:
The question of guilt or innocence: Do we think Steve is guilty or innocent? We have been given pretty much all of the evidence that the jury is considering (plus a little more conveyed by his journal writing) - so if we were on the jury, how would we judge?
Myers avoids a simplistic view of his character's role. We know that Steve was in the store the day of the killing, and that he had discussed his role with James King. Steve says he did not signal the others; they say he did. We are never shown directly what happened when Steve emerged from the store. Steve's own father and his defense attorney both seem to have doubts about his innocence. Under the law, if he conspired with others to commit a felony (the robbery), and someone dies in the course of that felony (no matter how the death occurs), all of the conspirators may be guilty of felony murder. So there are hints that he may be guilty.
On the other hand, we have ample testimony that he is basically a good kid - his teacher, his mother, his relationship with his little brother. We don't see him actually agree to take part, just that he was present when the job was planned. If we believe that his job was to signal the others that the coast was clear, we have to accept a relatively far-fetched argument that "no signal" was the signal. And he never received his "taste" of the proceeds. Is this enough doubt to find him not guilty? If he is "not guilty," is he also necessarily "innocent"?
Additionally, there is the question of proportionate punishment. Even though some may conclude that he is guilty under the law, life in prison seems a pretty stiff penalty for a first offense, when he himself wasn't even present at the time the killing occurred.
Myers says that when he talks to young people about Monster, their responses are interesting: "When I ask them, 'So what's the story with Steve?' they come up with various answers about his legal guilt, but eventually some kid does say that whether Steve's legally guilty or innocent doesn't make any difference; he is guilty. And to me, that's the essence of the book. Apart from legal machinations, is he accepting his moral responsibility for what he's done or is he just trying to avoid it?" (Rochman)
The issue of the novel's form: Myers uses the two types of narration - Steve's journals and his film script - as a means of showing how people create distance between their sense of themselves and their actions. When Steve writes in the journal, we get an insight into how he feels; when he writes about his crime, he uses the film script to distance himself from this act
That, at any rate, is what the author tries to do. Does it work? We are accustomed to watching movies, and a film script - which provides cues as to closeup, long shot, and other details of scene that a play script cannot - is a bit closer to traditional narration as well in its ability to set the scene and mood. But it is still often more difficult to read a dramatic text, which is normally intended to be performed, than a typical narration. Here, Myers is writing what looks like a dramatic text, but what is intended to be read, not actually filmed. Does this create a degree of difficulty in our understanding the book?
Between journal entries and the film script, we get a number of shifts back and forth across time. This is not a simple narrative in chronological sequence. What effect does that have on our reading experience?
The matter of Steve Harmon's identity: We get various testimonials as to who other people see Steve as being - the prosecutor describes him as a monster, his teacher sees him as a gifted student and a gentle soul, etc. But, as always with the adolescent novel, the great task of this character is to determine for himself who he is. What kind of evidence is there?
He seems to accept the prosecutor's characterization when he names his film, "Monster," and again when he writes the word over and over on his scratch pad, until his lawyer makes him stop and tells him, "You have to believe in yourself if we're going to convince a jury that you're innocent" (24). Interestingly, she doesn't seem to believe him, either, since she never states that he is innocent during her summation, only that he should be found "not guilty," and she shrinks back from his attempt to hug her after his acquittal.
His brother Jerry admires him, and to Jerry, Steve says he would like to be Superman - but his motive is that as Superman, "I'd kick butt" (58). This scene comes not long after one in which he throws a rock and hits a tough guy, then runs away (42-43). Which is Steve's true "secret identity" - the guy who runs away, or the butt-kicking Superman?
In his journal, Steve writes: "I want to look like a good person. I want to feel like I'm a good person because I believe I am. But being in here with these guys makes it hard to think about yourself as being different. We look about the same, and even though I'm younger than they are, it's hard not to notice that we are all pretty young." (62) Steve has to deal with some strong prejudicial stereotypes that may affect jurors (and readers) - the fact that so many young black men are or have been in prison, for instance, may predispose some observers to conclude that they are all "monsters"; as Ms. O'Brien says, "You're young, you're black, and you're on trial. What else do they need to know?" (79) Steve is in danger, here and elsewhere, of accepting the negative stereotype as his actual identity. At one point, he says that he feels like the word "Monster" has been stamped on his forehead.
Steve's sense of his self-identity is further strained when he realizes that his father is no longer sure of who he is. When Steve asks his father if he believes that Steve did nothing wrong, the father is unable to give him the reassurance he asks for, and instead tells him about his own aspirations for Steve, along with his failure ever to imagine visiting his son in prison (111-12).

Question

i recieved a criminal traffic ticket for leaving the scene of an accident. no injuries and I was not at fault. no priors, what can i expect at court. how do I plead?

Answer

The particular citation to the law for which you are being cited is A.R.S. 28-662

It is a class 2 misdemeanor if you were "involved" in the accident and did not remain at the scene.

Your defenses are did not know or have reason to know that damage was done, was not involved or duress.

Since the purpose of the law is to prevent hit and run accidents, and no one was hurt I recommend pleading not guilty and ask to waive counsel to speak to the prosecutor. If you weren't even involved, and just witnessed the accident, you have no obligation to stop and fill out a report.

If found guilty, I doubt you would get probation time let alone jail. A steep fine would be more like it and you face the possibility of the judge ordering your driver license to be suspended or restricted.

I hope this helps.

New Jersey, 4 Traffic Citations issued, failure to inspect vehicle, false inspection sticker, no insurance, obstructed view. DATE: 05/29/2007....

Went to Municipal court in 2007, was sent to Super court with added charge of Presenting a false document to a police officer.

Was offered and accepted into Pre Trial Intervention. At that time I was told if i accepted PTI and successfully completed it ALL charges would be dismissed.

Did community service, paid fines, got insurance, had car inspected - met all requirements of probation.

Now 8 years later I received a summons to appear in court because the 4 citations are still open.

Went to court, told Judge about Superior court, completed PTI, all charges dismissed... he did not care, said those remain open... suggested I get a lawyer and persue a dismissal based on lack of speedy trial.

Answer

That was good advice that the judge gave you. We'd be happy to help you. Call us at 1-855-9-JEFLAW to discuss.

Question

I was convicted of a felony for fleeing or attempting to elude an officer. I was DUI at the time. At my preliminary hearing The public defender never indicated I was being charged with a felony. I only learned about it when the judge made it aware to me. I received no defense for this charge at the preliminary hearing. I took a plea to a recovery court program to avoid state sentencing. I have fulfilled all my requirements with the court. Can I request the court reduce my felony charge to a misdemeanor, citing it may be a "wobbler" offense?

What is the difference between a will form for divorced persons and single persons? Is there an advantage to the divorced persons will?

Question

What is the difference between a will form for divorced persons and single persons? Is there an advantage to the divorced persons will?

Answer

Your question would be better if put in context. A will is a will. What it contains or its interpretation may differ based on one's circumstances, including a divorce. With a divorce, often there is more concern with matters such as the naming of a guardian, assuring that any funds left to children are held for them by someone in trust, etc. Even better than adding any context in an online forum, make an appointment to see an attorney.

Answer

The principal difference between a will of a married person compared to that of a single person is that a married person cannot disinherit a spouse. A surviving spouse has the right to renounce the will and sue for the portion of the estate of his or her deceased spouse allowed under state law.

Question

I am a contractor specializing in building construction. An out-of-state resident contracted me to repair a barn door on her Indiana property. We provided an estimate which she approved. We submitted an invoice for the same amount which she is refusing to pay. She wanted great detail - which we provided in the form of hours and store receipts. After non-payment (and repeated emails - she refused phone calls), I filed a small claims case. A day after filing, she mailed a check for 16% less than full payment (before she was served) because this is what she deems fair. I cannot stop the small claims process at this point. Can I cash the check without it being considered payment in full? Can I notate the check as "accepted as partial payment" or something similar?

Answer

You can stop the small claims proceeding--just tell the judge that you want to. You cannot accept the check or cash it without risk of it being deemed full satisfaction. If you're getting almost 85% of your bill, you have to ask yourself whether it's really worthwhile pursing this any further.

Answer

Have you had continued communication with the mortgage company since you filed.? You need to talk to the right person to fin out the status. Best advice may be to consult with a lawyer to review the situation and advise as to appropriate course of action to take.

Answer

If your property is in Philadelphia and is your residence, and if the bank has started foreclosure in the Court by a complaint or if any of the foreclosure process has been scheduled, you may go to the Court of Common Pleas Mortgage Foreclosure Conciliation Hearings, usually held on Thursdays, in Courtroom 676, City Hall. You may be able to get help there.

This response is not legal advice, since I do not have all of the information that would be required, and I do not have a representation agreement with you.

* If the answers to your question confirm that you have a valid issue or worthwhile claim, your next step should almost always be to establish a dialog with a lawyer who can provide specific advice to you. Contact a lawyer in your county or township.

* Another reason for contacting a lawyer is that it is often impossible to give a good answer in the Internet Q&A format without having more information. The unique circumstances of your situation and things that you may not have thought to mention in your question may completely change the answer. If you want to be sure that you have a complete answer to your question and an understanding of what that answer means, establish a connection with a lawyer who practices in the area of your concern.

Answer

If they haven't answered in three years, it sounds like they have never looked at it. Even when banks turn down packages they tend to have some limited communication. Initially call and ask for a manager to see what has happened. And then get a lawyer to explore your options.

Question

what legal responsibility does a man have after he get his girlfriend pregnant , and then he decides he does not want to marry her after all ? He was all for marriage until she got pregnant now he and his family are acting like jerks as though she is the bad person and he is the innocent victim.

Answer

Your question is a bit unclear . . . if you mean, "legal responsibility" to get married, the answer is none. People call off weddings all the time, and there is no recourse for "breach of promise to marry" if I understand your meaning.

Things are very different as to the prospective child, as to which both parents owe a duty of support -- and have the usual options as to custody and visitation -- whether they were ever married, or not. See http://willicklawgroup.com/child-custody-and-visitation/ and http://willicklawgroup.com/child-support/. If you need further assistance, your best bet is to consult with a qualified family law specialist, either in this firm or another.

Answer

Not generally. Quite a few costs can go into the cost of transferring property. Or simple call a title company exploring what the charges might be.

Question

I would like to find out a certain judge's sentences. My son requested to be sentenced as a youthful offender and was turned down but I know the judge gave someone with very similar circumstances y.o. I would think if I could find the info and present it to the judge then he would have to reconsider the sentence.

Answer

Choosing to sentence someone as a Youthful Offender is discretionary if they meet the requirements for Y.O. sentencing. The key word in the Statute is "may" though. The court can chose to do this on a case by case basis so even if the judge has done this in very similar cases they do not have to.

Question

I have lived in the same apartment for 5 years. When I moved in, I paid $825.00 a month. They have increased my rent to $950.00 over time. My lease renewal is July 1st and they are going up to $1,050.00. Is this even legal? Banks cannot increase mortgages. How can leasing offices get away with this when it's the SAME apartment. No upgrades. No new features.

Answer

Yes they can increase the rental cost. There are no laws limiting their ability to do that.

Answer

Actually mortgages do go up as well - taxes and insurance cause the increase. Therefore to answer your question, yes this is legal. If you can not afford the apartment then give your notice. Be sure you are within the requirements - some say 30 days notice others state 60 days notice.

Answer

It is absolutely legal. Your contract is only good for a specific period of time- during the contract period they can not increase the rate. However, if you choose to renew the contract at a higher rate why wouldn't that be legal? They are not forcing you to renew.

Question

I would like to know if I have a right to have a defense (or an attorney) provided by my insurance company. The other party and I have the same insurance and in Feb. 2015 I sought legal advice and decided to sue the other party personally. The other party was granted an attorney from the insurance then, however I won the case. Now that the other party is looking to appeal (again is provided legal services through the insurance company) however I am not getting the same treatment. The insurance company declared the auto accident as a "no-fault" but when i took the party to court they were found at fault and ordered to pay. So now that the case is being appealed and I have to defend what I already proved in court shouldn't I be able to have an attorney appointed through my insurance?

Answer

Insurance companies provide attorneys for their insureds who are defendants. You are the plaintiff so you have to pay for your own. The situation does not change despite the fact that that defendant appealed the result.

Question

If I purchased a motorcycle before we got married under my name. Then before we got married I traded that motorcycle for a car. Do I need to sell that car and split the money with my wife that im divorcing?

Answer

Property that you own prior to marriage is separate property. Property you acquire during marriage is presumed to be community property unless you can prove differently. If you can prove the motorcycle was owned prior to marriage and it was traded in on the car then all, or at least a portion, of the car can be considered separate property and not subject to division in a divorce.

What can i do over not having a 401 k although i have worked undet same employer for 3+ years

Question

What can i do over not having a 401 k although i have worked undet same employer for 3+ years

Answer

Does your employer have a 401k plan? Your employer is not required to have one, but you may have rights to participate if it does.

You should probably talk to your human resources director about this matter before contacting an attorney.

Answer

An employer is not required to provide a 401k plan. You can possibly contribute to your own IRA if you are not covered by a 401k at work. You should consult a tax professional regarding this or search the IRS website for IRA.

Answer

Nothing, unless you are saying that the employer was supposed to have opened and contributed to one as part of your employment agreement or by company policy. None is required by 'law'. It is up to the employer if they want to offer one. If you are actually 'owed' one by agreement, and it hasn't been funded in accordance with the agreement, then contact me to discuss your legal rights and remedies.

You can always contribute to your own IRA, etc. See your HR person to discuss.

Question

Myself and girlfriend own a house together. She is on the deed not the mortgage. We split the mortgage for 3 years. Then we broke up and she moved away no longer paying her share of the mortgage. Will she continue to gain part of the equity or does it stop since she left?

Answer

Your former girlfriend is still part owner of the property and you will need her signature if and when you decide to sell the property. She will not be entitled to any increase in value of the property, but if and when you sell, the check will be issued in both your name and hers and if she demands one half of the check, you will have to take her to Court to determine your rights, so it would be a good idea to keep good records of all the costs and expenses you paid for since she left.

In the alternative, you could file an action in Partition and ask the Court to remove her name from the deed, however, you would have to be prepared to buy her out at the value the property had at the time she left and you started paying all the expenses yourself. Then, when you sold the property, any appreciation in the property would be yours and she would have no claim to it.

Kindest regards,

ANDREA

Question

I made reservations at a major chain hotel,im on a limited budget due to a workers comp disability claim..i asked for a bottem floor handicap room and was told i would have to pay a higher rate for those accomodations reguardless of my disability.i had no choice but to take the second floor regular room .it was very painful to have to walk the extra distance and i had no handicap handles and almost fell in the shower twice..my surgically repaired and recooperating foot is more pained today due to the near fall and extra walking..the hotel chain has fired the clerk that tried to chage me extra in violation of ada policy..do i have a claim for monetary damages?

Answer

If a handicap room was available and offered at the same price as for comparable non-handicapped rooms, the hotel has complied with the law. You are not entitled to get preferential or discount rates because of handicap. If you took a cheaper non comparable room, that was your choice.

However, if you were actually charged 'extra' for a handicap room, that is a violation.

Your facts are not clear, since you say bottom floor rooms are higher regardless of disability, versus alleging the clerk was fired for trying 'to charge extra'.

Taking that into account, if you believe there was a violation, feel free to contact me for help.

Question

my husband just got a nol process on a charge from last year, at court on 1/21/15. He had signed for rental furniture for his boss, was responsible when boss didn't pay, of course , boss is mia now for a year. so showing all proof we had , it was nol processed

now the dummy was just arrested today for shoplifting, under 50.00 , two baseball hats, in va , a petty larceny. will his nol process affect this new charge, will he get a bail? i read the second offense is an immediate 30 days in jail, but is nol processed count as an offense??

Answer

Petit Larceny is a misdemeanor so hopefully bail should be set. The charge disposed of by nolle prosequi is not a conviction so should not count against him in the determination of bail.

Question

Did partners break any laws?

I was involved in a group that was planning on creating an LLP

I worked for 4 1/2 months tirelessly

Got into disagreement over other future partners actions

Took some time off 12 days to clear my head (I hadn't taken any breaks)

When I came back, I was informed that they filed papers for LLC without me

Add additional information

Answer

From this set of facts, it doesn't sound like any laws were broken. You don't say whether there was any contract or agreement in place, but that might affect whether you are entitled to compensation or shares.

What forces are used when a toy car goes down a ramp?

What forces are used when a toy car goes down a ramp?
I am not sure what you mean by "forces used" as there are many forces at work on every object constantly. However, in this case the main forces are gravity friction and air pressure as well as the main force of the car =mass times its acceleration or speed.

the person that wrote this well clearly did not take science as a degree!! what they mean by 'forces used' they mean 'what forces are there when a toy car goes down a ramp' some may get this other may not. the forces used are gravity friction and air pressure. some may say weight is also included in this advent. the mass of the car is normally included in the gravity or weight. thank you!!

Question

I live in Pennsylvania, and my question is this: Should I expect my vacation to accrue, from what was agreed upon in my employment agreement - that is to say if I negotiate an extra week of vacation as part of my employment agreement, should I expect to have that extra week as a supplement to all future accruals? My employment agreement offers: "Two weeks of paid vacation annually effective immediately" and our Employee Manual states: that each employee is offered one week of vacation in their first year, two weeks of vacation for the 2nd through 5th years of employment, etc.

Answer

I would look at your agreement. if you negotiated two weeks immediately then to avoid any confusion the agreement should have indicated something to the effect that the two weeks given to Employee are in addition to any schedule of vacation offered in the employee manual. As your agreement states you get two weeks annually effective immediately.

Question

I took my automobile to a mechanic to have the sparks plugs replaced . I belived he change engine in my automobile . what can I do?

Answer

What you "believe" does not matter. What actually happened is what matters. Take the vehicle to a reputable mechanic to see what, if anything, was done. Then deal with the real issue, if there is one. If the engine was replaced, it is time to see a lawyer.

Question

My divorce was finalized in mid 2013, and as part of the divorce settlement my ex-husband was supposed to remove my name from the mortgage and I was supposed to execute a quit claim deed. However, he has not done so and I would like my name off of the loan. What legal recourse do I have? Also, does filing a quit claim deed prior to having my name removed from the mortgage put me at a disadvantage if my ex-husband stops paying the mortgage and walks away from the property?

Answer

It is almost impossible to get one's name off a mortgage. Could it be that he was ordered to refinance the home? The wording of the judgment governs when you are supposed to give him the quit claim deed. It may be at the time of the refinance or at the time of entry of the judgment. The terms of the judgment are not modifiable except by agreement of the parties. They are part of a property settlement. the court can enforce the agreement but it does not have the power to modify it.

Answer

You will have to go back into court and ask the court to enforce the terms of your settlement. Its called a rule to show cause. In the meantime, do not give your ex a quitclaim deed. If you do, you will still be liable on the mortgage but have no claim or right to the property. You should always wait until your name is removed from the mortgage before giving up your rights to a property.

Question

My twin 5 yr old boys attend GA public school. They are both autistic and have an IEP. They are in a regular class but have an "inclusion" teacher to help if they need anything. I intend to ask for more one on one during food times due to their food sensory issues. For example trying to get them to touch different foods, even if they don't eat it, just touching it will help in the long run. Also asking for more morning interaction with sensory toys because they have a hard time transitioning in the morning. I was told by a school employee that they are providing all the services they are legally held accountable for providing. Am I in the "right" to be able to ask for these extra services?

Also, I have seen the regular teacher in the class lose her patients with another child in the class and pull him by the arm. Recently, my mom told me she saw her pull one of my children off his feet by the arm because he wasn't completing a task fast enough. It seems she is lacking the patients to work with the special needs children. What are the legal guidelines for physical touch by a teacher on a student?

Answer

You need to have a discussion with the administration on all these issues.

Question

Hello, I started chatting with a guy I thought was 18. he then told me he was 17, I'm 24. He sent me a nude pic and we kept talking because I was trying to slowly ease him away. Eventually I stopped receiving messages. Then tonight his dad called pretty upset about the incident. I refused my name and acted as if I didn't know him. Should I be worried about this incident. We are in two states, I'm in AL, he's in Georgia.

Answer

Did the father demand money? I've heard several stories like that, and they sound like scams to me. After all, a father who was genuinely upset about something like this likely would not let it go in exchange for a quick payment.

The "son" may really be over 18. The photo might not really be him. The person in the photo might be over 18, whether it's the "son" or not. And the "father" may not be who he says he is.

I'm not saying this really is a scam. It might be exactly what it looks like. And I suppose there is some risk you could be prosecuted, though that depends on additional facts. (Did you ask for the photo? Had you already heard that the "son" was underage? Did you delete the photo? If so, when? What sort of things did you say after he told you he was 17?) Whatever you do, proceed with caution.

Good luck.

What subject areas should the attorney and client discuss during the initial consultation?

Question

What subject areas should the attorney and client discuss during the initial consultation?

Answer

The word "should" troubles me a bit. I am going to respond by discussing what often happens in my own practice -- other attorneys may do it differently, but I cannot say that one system is better than another.

The attorney will normally gather information about the client and the nature of the problem. The attorney also will inquire about any other opposing or interested parties. At a minimum, this is to check for possible conflicts of interest. The attorney is likely to give an initial assessment of whether he or she is interested in or able to take on the matter, and may provide some initial advice. The attorney's fees will be discussed. The attorney will also try to answer as many of the client's questions as possible. If the case is big, initial thoughts on staffing may be addressed. Much depends, however, on the size of the matter and the firm.

Note that not all attorneys provide a free consultation. This is particularly true if the consultation is intended to provide substantial advice, or neither the attorney nor the client anticipates further work after the meeting.

Question

if I have a charge for possession of marijuana with intent to sell manufacture deliver

and sell marijuana both adjucation withheld S893.13(1)(A)2

can I get this sealed or expunged?

Answer

If both charges were part of a single case then you should be able to get the case sealed. It would also be necessary that you have never been adjudicated guilty for any other offense and never had anything else sealed or expunged.

Getting your case sealed can be extremely technical and it is very easy to be done incorrectly. I strongly recommend that you hire an attorney to handle it for you to make sure it is done right. Once the case is sealed you are eligible to get it expunged after 10 years if you stay out of trouble. Please feel free to contact me if you have any questions.

Question

A dective says he has evidence of theft on an accused individual. Over the phone, he tells the accused to come in for an interview before he (detective) finishes the paperwork to send to the D.A.

If the detective had evidence wouldn't he just arrest the accused without question?

Answer

He doesn't have to and can wait for a warrant or summons. Most importantly, don't talk to the police on the phone or in person without an attorney, even if you are innocent.

Question

My parents deeded a property to me three years prior to their passing away, but they did not update their will to reflect this change. Now, a sibling is saying that the property must be sold and divided equally between the kids. Is this true?

Answer

If the home was deeded to you prior to your parents passing, the home was no longer subject to the will and thus did not pass through it...your sibling is incorrect. Your sibling only has a claim if they can show that you used undue influence or fraud to get your parents to deed the home to you.

Question

Divorced in Nebraska. I live in Minnesota and my ex lives in Nebraska, with my daughter.

01/03/2008 Decree, 12/08/2010 Custody Order,

Since the custody order in 2010, my ex has denied me nine ordered visits, is 30 minutes or more late for exchanges about 95% of the time, failed to answer at least 40% of my phone calls to my daughter, refused to cooperate for getting my daughter decent insurance, taken my daughter to no dental visits, taken my daughter to no regular health checkups, discontinued ordered mental health care about one week after the order, failed to respond to repeated requests for documents for me to cover any medical or school-related costs, and made four moves without any (required 30 day) notice. She also has facilitated no contact with my daughter's Godmother or Aunt, and very limited with my parents. She's given harassed me by text and email over child support twice a month, despite support being paid ahead since support order took effect in December, 2011, too.

Our judge was her foster parent in her teens. The custody order in December, 2010, actually contains fabricated information to support the order. Her failed court-ordered drug tests somehow never made it into record, and have disappeared. I've gone through every cent of family and friends' money trying to work this out.

What can I do?

Question

i have been living in a house now for twmo years. my father owns this house, and when he passes he plans on putting 9the house in both min and my sisters name. my sister has already said she is kicking me out when this happens. is this legal?

Answer

First, whatever your father "plans on" doing must obviously be appropriately planned while he still alive, by either executing a will or establishing a trust. If his will were to say that you and your sister would be the devisees of the house, presumably as a tenancy in common, then her rights would not trump your rights. Each of you would have equal rights. Which is a problem, because the relationship between you and your sister is clearly not good. There will need to be cooperation between the two of you. You don't say what other assets, if any, you expect to be part of your father's estate, but if it were possible for you and your sister to divide up the assets in a manner that would obviate the two of you sharing a single asset, that would obviously avoid a good deal of feuding.

Good luck to you.

Is it legal for my company to require me to notify them before I apply for a position at a different company.

Question

Is it legal for my company to require me to notify them before I apply for a position at a different company.

Answer

Yes, but what are they going to do if you tell them? Fire you. What are they going to do if you don't tell them and they find out? Fire you. You do the math. Unless it is part of a negotiated personal employment contract like many high level executives get, with appropriate protections for employer and employee if the employee is considering leaving, I'm not sure how realistic such a requirement is.

Answer

Legal to ask? Of course. Legal to refuse them? Of course. Legal for them to fire you if you say you are looking? Of course. Give them notice only after you have a new job, unless you are sure they won't immediately walk you off premise when you tell them.

Answer

Whenever anyone asks whether something is "legal" in a contract, my response tends to be "What do you mean by legal?" Lawyers tend to think of legal and illegal as terms defining what is permissible and what is punished, particularly in a criminal law context.

Here, the better question might be whether such a contract provision is enforcible, and what would enforcement amount to.

Suppose you signed the agreement, then went and applied for a position at another company without telling the employer, thus violating the term of the agreement. If they find out, what can they do? Fire you? Sure, but they can do that anyway; they don't need a contract provision. Sue you? I think the judge would die laughing. The company could win, but its damages would be nominal ($1). Or, it could lose on the ground that such a contract provision is void under Business and Professions Code 16600, which declares any employment contract term that limits anyone from engaging in any lawful business, trade or profession to be void; such ruling resting upon the obvious purpose of the clause to restrict employment mobility, contrary to B&P 16600.

I would not encourage you to engage in a heated negotiation over this term in your employment contract. Go ahead and sign it. Then, when you get itchy feet, either report the facts of your other job interviews to this employer or not. What's the worst thing that can happen?

Question

My ex husband and I divorced ten years ago, at the time of our divorce our house was appraised at 360.000, with 160.000 in equity. Which meant 80.000 for each of us in equity. In order for my children and I to stay in the house, I refinanced and was able to give my ex husband 40,000 dollars of his share, owing him another 40,000 when our youngest daughter reaches 18. Since the divorce agreement, the real estate market has changed drastically..I owe 212,000 on the house now and the house recently appraised at 275.000. Which means there is only 63,000 in equity. Am I entitled to receive my portion of the equity or will I have to give him his remaining 40,000? Will I be entitled to anything at all? We live in Massachusetts.

Thank you.

Gina

Answer

You ex-husband is entitled to his remaining share of $40,000.00. Look at this way, if you owed your ex-husband $40,000.00 and the house had gone up in value, your ex-husband would not be entitled to the increase in value. He would only be entitled to the amount he was entitled to when the divorce became final ten years ago. So, the bottom line is, he would not be penalized for the decrease in value or reap the benefits of the increase in value since divorce.

Answer

Your husband is owed $40K.

What will my vet likely argue in response to a malpractice suit?

Question

What will my vet likely argue in response to a malpractice suit?

Answer

That's very hard to say without knowing the specific allegations. To be successful with a malpractice suit, you would have to prove 1. that he had some sort of duty to provide care for your pet and 2. that his actions or inaction fell outside of the normal standard of care. A bad result does not always equal malpractice. Their general defense is that they acted within the normal standard of care for that specific situation.

To be able to even file a malpractice action against the vet, you would first be required to find another vet and have that vet review the records and have that vet issue an opinion that the original vet did in fact commit malpractice. This can be an expensive and very complicated process. I certainly would not suggest doing this without an attorney.

Question

I left a company that I had worked at for several years and part of my compensation was living in one of his condos and now he has asked that we leave immediately the condo. Now some key things.. I left due to the stress and some things he had me to do that may be illegal that pertains to a law case he is in and thru other various mental stress (short of verbal abuse). this has affected my health and my Dr. said he is more than willing to write a note or whatever so that I may claim unemployment. My position with the company was operations mgr. The owner is 92 and I basically did it all. The other key is this is in a gated community in which the condo is located that he provided and we are afraid that he may shut us off gaining access thru the gate. We do live in Florida. Side note he had bought my personal car shortly after I started and bought a new car in his name so that I could use as a company car. So this left me with no car.. thankfully my elder mother (84) lives with me and I have her car. We have started packing but this will be no easy task to get out immediately(what ever that means). I am to go in to pick up my last check and I am sure we will have a conversation and I will offer to pay him rent for a month.. My QUESTION IS.. Can he make us move immediately or do we have a time frame to move out and he can legally shut us off going thru the gates to get access to the condo. I did give 2 weeks notice.. Being the operations mgr. I tried to leave on good terms..and worked till the end of the day of my last day.

Answer

Unless you have some written agreement, he can end your employment with all the perks including the condo without any further notice. HIs stressing you is not worker's compensation, you must have physical impact to have a w/c case. As for your unemployment compensation claim, you will have a tough road on that too if he decides to fight you. You need legal help, seek a labor and employment attorney

My stepfather has just died leaving no will behind. Can I claim his inheritance?

Question

My stepfather has just died leaving no will behind. Can I claim his inheritance?

Answer

Thank you for your question,,

In order for a stepchild to inheritit from their deceased stepfather, the decedent must have done one of two things -

1..During the decedent's lifetime, he adopted his stepchild; or

2. Left a will in which he made a bequest to his stepchild.

If neither was done, then a stepchild does not have legal standing to inheit anything from the stepfather.

I am sorry that I could not give you happier news, but the Answe is correct and one on which you can rely,

Kindest Regards,

Answer

You need to post your question in a forum where Virgina law is considered.

Answer

The assumption behind this answer rests on the fact that the child lives in Virginia. It's also presumed that court orders for the child's current placement came from Virginia. That is why you should consult with a family law attorney in that jurisdiction.

Question

Is it illegal for someone to hack into a business' computer system to see if an employee of that business is getting on facebook or instant messaging people?

Answer

Most likely yes. Potential areas of concern would be:

1) Is there a corporate policy governing network access by employees? For instance, many companies allow their IT or HR personnel to access all employee internet access records & activity while at the same time alerting employees that use of their network is the property of the business and the employee should not have any expectation of privacy while using their systems.

2) Does the "hacking" include circumventing encryption? This could implicate portions of the DMCA (Digital Millennium Copyright Act) that provide specific penalties for breaking encryption to access copyrighted material. Using a stolen password would most likely count as circumventing encryption.

3) This could possibly be a common law trespass or conversion, although the business would likely have to be the party suing for the unlawful trespass/conversion of their equipment and not the employee.

4) This could possibly be an "invasion of privacy" under the Constitution or the ECPA (Electronic Communications Privacy Act) if the "hacker" is a government employee.

5) If a private investigator is the "hacker" they may also be violating their regulatory or professional organization's rules.

6) If this is a domestic dispute between two employees there may also be corporate policies mandating that the employees make HR aware of the relationship which a violation could result in both employees termination.

Question

A judgment has been obtained for past due co-op maintenance fees and legal fees. I wish to stay in home and offered to pay entire amount. co-op management agrees but wishes to hold judgment in abatement' so that they may take the home without

filing another judgment if I am ever late in my payments in the future. How can I protect myself?

Answer

If you satisfy the judgment, the co-op cannot "hold the judgment in abatement."

Answer

They are required to satisfy the judgment if you pay 100% of it and the interest which is due since its entry. You need to hire an attorney to accomplish this for you. Future late payments will be dealt with as new occurrences after the judgment is resolved. if the judgment is for foreclosure on a lien, than you need to act to get that dismissed by paying the sums due. hire an attorney to help you.

Question

I was arrested and am being charged with criminal trespassing. Basically, my brother was having some sort of altercation and came and got me, we then went outside. We were both highly intoxicated and for some reason or another were not wanted back inside. I however had an expensive coat with glasses and car keys inside of the bar and when I asked if I could go back in the bouncers got physical and aggressive with me, slammed me on the ground and held me there. My brother called the police and they came and arrested us both for criminal trespassing. Is there any way I could get these charges dropped?

Answer

"Dropped"? Probably not. Successfully defended at a trial? Very possibly. Find a good criminal attorney in your community to help you; there is no formula that can be given to you on a computer forum to handle this.

Good luck.

Question

Attorney that did the original decree and QDRO, didn't follow the instructions given to him by the wife, his client, and the language he entered regarding a retirement (Defined Benefit Plan) settlement said something totally different, and now they are trying to get it modified. It was done in 2008 originally. Both spouses are in agreement that it needs to be changed to what they intended it to say but the attorney they now have working on it is having a difficult time trying to find a way to get it in front of the judge who told him to find a statute that would allow him to hear the case. The attorney hasn't been able to locate anything.

Answer

The problem is that if the proposed amended QDRO creates new substantive rights not contemplated by the terms of the divorce decree then the judge may not have the power to amend the QDRO. If the attorney doesn't know how to deal with this situation then he or she probably needs to consult with an attorney with more experience dealing with QDRO issues.

What to do if a co-worker blames you for something that is not your fault?

What to do if a co-worker blames you for something that is not your fault?
A step by step thought process to think about.....

First: Do not wait to tell your Supervisor/Manager if you know that you have been accused of something that you did not do. When explaining, never state your reason why you are explaining only what the issue is and how you could not have been the person responsible, do not point fingers. Only concentrate on why you are not the person responsible.

Note: Keep in mind any good and experienced Manager initially never looks for "who to blame" only how to fix the issue at hand. After this has been resolved, then an investigation would normally happen.

Second: Not matter what pressure is placed on you, always maintain your integrity and tell the truth. This also includes not covering up for friends.

Third: A proper investigation will always show who is responsible and who is not. As long as you maintain honesty, you have nothing to worry about.

Fourth: If somewhere in between the above, you realize that you may have been the person responsible, then go back to step two and ensure that you explain your mistake and how you came about to not mentioning it. Honesty is appreciated!

One of the hardest things in life is being honest. Most, like 87% of people worldwide don't give a hoot about their jobs apart from the money it provides. So if you are unable to be honest with someone you may not really give a hoot about and what they think, how do you think your going to go with being honest with yourself?

I am looking for an attorney who specializes in Disability Trusts. Can anybody describe the pros and cons and possibly refer me to an expert in this arena? State of residence is currently CA.

Answer

Presumably you are talking about a Special Needs Trust, but in order to advise someone in this area requires detailed information about the facts and circumstances. Is this for yourself or for a child? Is there an unexpected inheritance or other windfall that is spurring the need for such a Trust? I am a member of the Academy of Special Needs Planners and specialize in this area. Their web site can also guide you to a specialist in this field in your area.

Question

My mother was cosigner on bank loan for my car! loan went in collection she said she would pay the 1700.00 dollars left on the loan and now a year after paying it for me she need money and is going to sue me..can she do that ?

Answer

Yes, unfortunately. However, the bright side is that she can sue all day long in PA. However, how is she going to collect? There is no wage garnishment and if you have no assets, collection is going to be difficult.

BUT, this is your mama. What a lousy way to treat your mama. She bore you. She lent you her name and her credit by agreeing to co-sign. And how do you repay her? You default on the loan and trash her credit. She even went so far to pay off the debt. You need to start repaying the debt now. Apologize for being such a jerk, send her flowers and work out a payment arrangement (get it in writing) and start paying her back NOW before she sues.

The strongest out of all of them is the Luxafloor HS but obviously it will cost you aswell.

Can a creditor garnish wages after court judgement of dismissal for default judgement?

Question

Can a creditor garnish wages after court judgement of dismissal for default judgement?

Answer

You should take your paperwork to an attorney for review. Our office charges a reasonable $100.00 consultation fee, which we credit back to you on your first bill if we are hired. Your description of a judgment of dismissal for default judgment is confusing because those are two very different things. A judgment of dismissal would generally be a dismissal of the plaintiff's action on account of the plaintiff failing to appear or to do something they were ordered by a court to do. A default judgment would generally be a default by the defendant on account of defendant's failure to appear or to do something they were ordered to do. A default judgment would generally result in the plaintiff being awarded their requested relief. You may have your terms confused, which is understandable. Reach out to an attorney.

Question

Him I'm going to be getting my fingerprints taken soon for my green card and I was wondering if having 2 misdaminors well affect me one is for criminal mischief and the other harassment I was 18 and I have went to jail 3 other time's for public intoxicated and family violence and fighting but I've been clean for 2 years now I just want to know if all that is going to affect me on getting my green card again ??

Answer

Hi. It seems as if you're applying for a renewal of your green card. In these cases USCIS must give you the renewal. It is a ministerial duty. However, if they learn of criminal issues of which they did not have previous knowledge, removal proceedings can be instituted. I'm confronted with this issue routinely and advise all who ask to have a crimmigration lawyer review your history (immigration, criminal, family) to ascertain the consequences of the criminal conduct and potential outcomes. This gives you the opportunity to proceed with some level of clarity and you have a lawyer who understands your case ready to go if an issue does in fact arise. Feel free to give us a call.

Question

Can an officer pull a traffic stop on you just to check your license?no traffic violation commited. Said he ran tag number and owner of vehicle license were suspended.

Answer

As the case law stands right now, the answer is yes, but with limitations. For example, they can't pull you over if the suspended license belongs to a female, but the driver is male. It can certainly be challenged regardless, but you need to talk to an attorney to see the best way to handle it for your individual situation.

Question

I had asked if I would set off a red light camera by being on the first line of the croswalk when the light turns red. I was told that most judges would not find me guilty. However as a followup, would I usually set off the camera by being on the first line of the crosswalk and if I do would I be sent a ticket or would the person who reviews these things throw it out? I had understood that being only as far as the first line of the crosswalk wouldn't trigger the camera but I am unsure. I was NOT in the intersection. Would I trigger the camera?

Answer

The only way to answer that question is that it is up to the judge and since it is up to the judge, you can either go to court and find out the answer, or hire an attorney who can fight for you to find out the answer. Then again I wouldn't even be worrying about whether or not you "set off" a camera until or unless you actually receive one.

Question

Can I have a 20+ year old felony revised or appealed??? I received a felony with 140K joint restitution over twenty years ago. I have made monthly restitution payments but the other party has contributed peanuts compared to my payment to date. I want to know if there is a way to separate the restitution based on the grossly uneven amounts paid towards the fine.

Answer

Yes. Depending on your circumstances and the little information you have given, a good criminal attorney can try and accomplish this for you.

Answer

Your question is a bit vague. Most likely, you and the other defendant were held jointly and severally liable for the restitution award. If that's what happened, then you probably can't get the type of relief you're asking about. Joint and several liability is supposed to work the way you've described. You may have a valid civil claim against the other defendant, but that does not mean you're entitled to modify either your conviction or the terms of your restitution order. You should consult with a local attorney directly about the specifics of your case.

Good luck.

Question

My husband walked away from his condo and the HOA came after him with a judgement for the HOA fees and won in court because we received zero notice of the court date. His bank account was cleared out and we were able to come up with the money. How do we stop the HOA from doing this again since the bank refuses to finish the foreclosure and remove his name from the property because his lender is in bankruptcy themselves.

Answer

You generally will owe the fees as long as the property is in his name. You should have tried to negotiated a settlement providing that it was a full and final settlement of all claims related to the condo. Otherwise, if they have valid claims there is nothing stopping them from pursuing their claims. Even Bankruptcy does not discharge future HOA dues.

Answer

He owes HOA fees until and unless his name is off the property. And since you can't make a lender foreclose, that can be forever. You should have negotiated a settlement when they made an error in filing, as that error doesn't prevent a new filing.

I work in childcare. Can my boss withhold my check because I owe some money on my kids tuition?

Question

I work in childcare. Can my boss withhold my check because I owe some money on my kids tuition?

Answer

You will need to supply more informations, such as to whom you owe the tuition. Did they file a collection case in court and get a judgment against you? If so and they then filed a wage attachment on your boss, he or she would be legally obligated to withhold 25 percent of your take home pay to send to the creditor. If this is just a private deal in which your boss fronted the tuition and you we're supposed to pay them back and fell behind, it would depend upon what the nature of the agreement.

Question

As stated in my divorce agreement, my ex-husband is to pay me $3,000 every month. Also stated, is that if he defaults in payments and the amount in arrears totals $6,000, my lawyer should send his lawyer a letter that gives him 30 days to cure the defaulted amount. "Husband shall have thirty (30) days from the date of the notice to cure said default." My lawyer sent him the notice, however, my husband paid enough to bring the arrears total under $6,000 again. My lawyer says that is all he has to pay but I believe that to cure the default, then the full amount in arrears has to be paid to me. Is my lawyer right to not pursue this? Or do I have a valid argument?

Answer

Without seeing the settlement agreement it's impossible to say. But who wrote that agreement? It sounds odd.

Question

I live in NC and my husband has a judgement against him. We have a jointly owned vehicle valued at $18500 with a remaining loan balance of $16500. I get offers to refinance at a lower rate. If I do so can my husband co sign without being on the title? And will that affect the judgement? I fill out the notice of exemptions when it comes. Any advice would be apprciated!

Answer

You do not fill out the exemptions if your husband has a judgment against him. Your husband has to fill out the exemptions.

Your husband cannot convey away assets now that he has a judgment against him; it would be a fraudulent conveyance if he signed his share of the car to you. You should have thought about this before the judgment was entered. Going forward, he cannot have his name on any assets as this poses a problem if you go to sell it.

Your car is not at risk for right now. Your husband is allowed to exempt up to $3500 equity in any one motor vehicle. That means that your half of the equity can be $3500 too. Right now, you only have $2000 equity total. The car is safe.

I suppose you could refinance and keep the car in both of your names. That would not be a problem as far as fraudulent conveyance law goes. If your husband gets served with exemptions, I would strongly encourage him to contact me or another attorney like me who assists clients in fillinmg out the exemptions properly for a reasonable fee. Long term, your husband needs to think about how he is going to resolve the judgment debt - by either paying or filing bankruptcy.

If your husband is interested in getting help with the exemptions or resolving the debt in a non-bankruptcy context, please have him contact me at [email protected]/* */

Question

I am currently taking classes to become an EMT. I am worried about the CORI check that will be done. I was arrested a few time and each case was continued without finding. Will these show up on the Cori report if they have been dismissed?

Answer

I would take immediate steps to try to have your record sealed. The rules and procedures depend on how old the cases are, whether they were felonies or misdemeanor . If they were misdemeanors and any probation ended more than five years ago, you can file a simple for, the the Board of Probation. I'd they are more recent, you'll need to ask a judge for this. If the record is sealed it comes back as "no record" on a CORI.

Why does BBC America change all of the music on Top Gear from the original to some cheesey bad stuff that doesn't work as well and makes the show more boring?

Why does BBC America change all of the music on Top Gear from the original to some cheesey bad stuff that doesn't work as well and makes the show more boring?
The BBC doesn't spend the money to get the rights to the music everywhere. BBC openly dislikes America, because we don't HAVE to pay the BBC, whereas in England if you want TV at all you have to pay the BBC. Because they have less of a market, because they would have to work harder for the same pay, and because rights for music are bloody expensive, they'll pay for the rights to music only in region-locked DVDs and on british television. BBC America usually has one or two kids on staff who can slap together music for them, mixed with music the BBC and BBC America have purchased unlimited rights to use and royalty free music.
Obviously I would never do this because that would be wrong, but apparently if you google top gear, and put in the season and episode, and look for the episodes that have been uploaded to streetfire.net, you can watch the episodes with the original british music.

Question

My brother, who is Guardian of the person(MOTHER) keeps locking me out of the house. This past week, he turned off all the lights on the third level( I reside on the third level of our mother's home). I HAVE NO HEAT OR ELECTRICITY. I pay the electric bill. How can I stop him from doing this. HE IS DOING EVERYTHING HE CAN TO GET ME TO MOVE OUT.

Answer

You have to sue him him for his wrongful actions. He has no right to evict you without notice. You have the right to reside there. The law requires that he give you written notice to force you out. Even more if he only guardian of the person, call the guardian of the estate and ask if they join in your brother's actions. If they do, sue them to.

Question

I am in the middle of a divorce in Florida. The wife will be getting the house, but I would like to add a few conditions to this:

1. She must refinance within 12 months to remove my name from the loan. During this time, all payments must be made in full and on time.

2. If the house is not refinanced within 12 months, or the payments are not made in full and on time, she must do one of the following:

A. Sell the house. The selling price must be enough to cover all payoff costs of the loan. Any amount over wil be equally shared among myself and her.

OR

B. She must Quit Claim the house to me and move out. I will move in and assume ownership and sole financial liability until I can refinance the house in my name only or sell the property.

Can I do this? Would it be enforceable? And how would I do it, just type it on a sheet of paper, or would I include it on a particular form?

Answer

That you are not represented by an attorney is assumed in this answer. You may benefit from review of the basic dissolution of marriage procedures outlined online. You and your wife can resolve all such issues through a Marital Settlement Agreement which is incorporated in the divorce order. An attorney can guide you and represent you, or you can explain the issues to a judge. So long as the agreement relating to the residence is reasonable in terms of Florida law, you and your wife can state in writing how the residence issues will be resolved. Your outline appears reasonable depending on the current equity existing in the property.

Question

I received my divorce decree with nothing but a stamp of the judge name, not actually signed. Does Pennsylvania require a judges signature or is a rubber stamp of his name ....President Judge good enough? My "Original" decree has a raised seal and says it is a true and correct copy certified from the records of......county, penna. The only signature is that of the Deputy Prothonotary. Am I, in fact, divorced?? Should I contact the county branch where the papers were filed?

Answer

Yes, it sounds like you are divorced. It isn't that odd for the judge to sign via a stamp.

Can you film pornography in Michigan legally?

Can you film pornography in Michigan legally?
California is the ONLY place in the United States where productions of this type are actually legal. Adult film production is legal in California due to a precedent created by a 1988 decision of the California Supreme Court (California vs. Freeman). As a result of that decision, California became the FIRST AND ONLY state where a person can be legally hired to have sex for the purpose of making adult films. However, producers are still required to obtain permits before starting any such production. NO OTHER STATE HAS SUCH A PRECEDENT therefore production in any other State is, and will remain, ILLEGAL!

Question

I live in NY I had concrete work done by a NJ contractor. The concrete over the winter began sporing, The contractor promised to repair it. Now she refuses to answer calls. This was a 12000 job. should I sue her in NY or NJ and how do I do that...Thank you very much

Answer

A contractor has to be licensed in New York to perform work. Did you check your contractor's credentials, his insurance binder and experience? Chances are, no matter where you sue him, you are going to hold the bag. I doubt he will answer your formal complaint. You can sue in New York Supreme Court, for Civil Court and small claims court have no jurisdiction and you are in for a pretty hefty bill in legal costs and bills. Apporach NJ Better Business Bureau and find out if they can help you.

Question

My father passed away in Sept of 2013. He had a Will. My sister was named Executor. My sister and I do not talk. We did meet with the lawyer that did my father will. After not being able to get into my fathers house to go through/split belongings as what was in the will I called the lawyer and he was of no help and would not respond to me. My sister was living in my fathers house at the time and still is. I received a summons notice she had stopped paying the mortgage back in June 2014 and is in foreclosure. Back in January of 2014 I was receiving calls from my fathers mortgage company of late payments. I told the lawyer and he did not respond to me. At the "reading of the will" (the first and only time I meet the Will lawyer) he advised my sister to put the house up for sale. She has refused and is not paying the mortgage or rent. The lawyer still is not cooperating either. I am on a very tight financial budget but I'm wondering about my rights? I would very much appreciate for someone to help explain what my sister and the estate lawyers duties are/were?

Answer

It can be explained, but now very well on LawGuru. Consult with the attorney of your choice. It's not likely to cost you anything.

Answer

What is the value of the property compared to the total balance due on the mortgage? If this property is "under water" it's very likely there's no value to attempting to enforce your rights. Your sister is not doing her job, but if there are no assets of monetary value in the estate, the question is "what difference does it make, and how do we measure this difference in dollars?" You should consult with an attorney in your area to seek answers to the foregoing.

Question

I have a commercial building I'm leasing. my lease was over in Feb. The landlord sent me a letter in the mail on March 3rd stating he wants to increase the rent as well as have me responsible for utilities if the bigger unit next to me becomes vacant. The problem with this is that unit and mine share a meter. If I don't agree to this new provision by April 1st he has given me less than 30 days to find a new location. We have also been to court last year where I filed suit and won for a breach of contract and I know this is his way of retaliation by his comment "you had to have known this was coming." What can I do? Please help!

Answer

You would really need an attorney to review the lease and then advise you as the answer is going to be in the terms of the agreement. Generally, with proper notice, a landlord has the right to change terms (i.e. increase rent) after an agreement expires or is terminated.

mortgage transfermy father would like to pay off his mortgage transfer the house to me. How much does something like this usually cost?...

Question

mortgage transfer

my father would like to pay off his mortgage & transfer the house to me. How much does something like this usually cost?

Answer

Re: mortgage transfer

This depends on the size of the mortgage and the value of the house. You may have to pay transfer taxes which can amount to 3% of the value of the property. You may also have a prepayment fee that you need to pay in order to pay off the mortgage early. If you would like to talk more about this contact me at the address below and we can sit down and figure out the exact details.

Answer

Re: mortgage transfer

The transaction is not complicated it would ivolve drafting a new deed and recording it. You would have to get a payoff figure from the mortgage company. They should then complete and file a mortgage satisfaction so that it shows on the record that the mortgage was paid . this would avoid problems in the future if it still showed up on credit reports. There would not be a transfer tax as it is a tax free transfer from parent to child unless it was being transferred to another unrelated party.
