My Mother set up a Life Estate putting myself and my three other siblings on the life estate. My Mother has now reconsidered and would like to remove the other three from the life estate. Can she make this change, once the original life estate has been set up. She resides in Pennsylvania. This is where the property in question is.

I would need to see a copy of the deed to see what exactly your mother signed. Think of ownership of real property as a bundle of sticks. When someone gives the property away, they give their bundle of sticks to the new owner. When they keep a life estate, they keep one stick for themselves and give away 99 of the sticks to the grantees.

If your mother conveyed away the property to herself and kept a life therein with the remainder to the siblings, your mother cannot unilaterally change it. She would need each of the other 3 siblings to agree to re-convey their remainder interest to her or whomever. If they do not agree, then there is nothing that she can do (barring facts like fraud or something which would invalidate the transaction like lack of mental capacity). What I would do is have your mother take a copy of the document to a real estate attorney and get his/her opinion. If the lawyer agrees with my assessment, then see if the other siblings are willing to reconvey their interests and have the lawyer prepare a proper deed for your mother.

There is a fee for medical record preparation which health care providers are entitled to charge. It is $15 + a per page charge, which was .50/pg in 1995 but adjusted for inflation after that, so the .76 is probably the current page charge.

I do not see that there would be a legal issue that would prevent it. The agent may be better aware of conflict regulations within the real estate marketing industry.

I can see some positives of her coordinating the sale and her own move, but I could also see reasons that she may make poor choices. If you use another agent, that agent, working with your closing attorney, should be able to help you make sure the timing of everything flows well.

You should be able to get your listing in 6-month periods and that should be negotiable.

I suggest your first consideration be other factors in whether you would hire this realtor. In other words, if she were not a tenant, where would she rank in referrals you receive from others who have used realtors, is she with a company that seems to do well in your area, does she seem to have plenty of background, how does she do in answering questions about listing the property, does she seem organized, ...

Once the lawsuit is filed, with Standing Orders injunctions, AND you are served; then there are restrictions on what you can do or spend. Even then you are allowed to spend on attorney fees. But none of that has happened yet. Collect your retainer and go hire your lawyer. Today.

If you know of an injunction being filed - usually in Texas called standing orders (you can look them up your county court's website), you are to abide by those orders (injunction) until the hearing and/or until the Judge tells you otherwise, even if you have not been served with them, as of yet.

Next, the standing orders should allow you to pull money out to hire your own attorney and to support yourself. Your attorney can look into this,

As for setting up a new account, in Texas, BOTH of your incomes are community property until the divorce is finalized as in Texas there is no legal separation. Therefore, even if you set up a new account, just as if she would, the money in that account would still be joint community money. I would also bring this up at the temporary orders hearing and hopefully her attorney set a hearing - you will need an attorney to represent you.

At this hearing, the judge will decide as to who gets what money and what you both should or should not be able to do.

If she has been greedy and has taken more than half of what you had liquid, your attorney can argue that the funds that were taken were not equal and they can ask for you to receive funds so that it is equitable.

You will not get into trouble, despite what your probation officer is telling you. Generally, a driver's license is not restored until the motorist has met all the requirements to the restoration of his or her driving privileges. However, if your probation officer failed to inform PennDot that you had not paid all your fines, Court Costs, Probation fees, etc. in full, and PennDot went ahead and restored your driving privileges, you will not be penalized, nor will you get into any trouble because your probation officer was remiss in meeting his obligations to give accurate and up to date information to PennDot.

Typically the best approach is the narrow the feild of expertise. Combining your skill set as an actor and producer may be successful, but a full review of your background and what has been submitted to date would be key. It sounds as though you have already submitted this with a broad field of expertise, and you won't be able to narrow that down much in response to an RFE. A new filing may be the better option.

The creditor cannot garnish your wages, until they have a judgment against you. If you have a payment agreement (and you're current on your payments) they probably can't get a judgment. If they have a judgment, and insist on doing the garnishment, you're not required to make any extra payment.

This is a relocation case.

First, look to the Stipulation of Settlement and Judgment of Divorce. Was their a radius clause in either document. A radius clause is a provision in the settlement which prevents the custodial parent from relocating with the minor child without the fathers consent or a court order.

If there are no provision in the agreement the law in New York still requires you to get the fathers permission or a court order to relocate the child out of the juristiction. Given the fact that the proposed location is only 20 minutes from the current home, the Court may allow the move. It depends on why you made the move, is it in the child's best interest and is the fathers parenting time infringed on.

It doesn't necessarily have to affect your joint custody arrangement although obviously while he is in jail he won't be able to exercise his possession periods. When he leaves jail then he will be able to pick up on his regular possession periods.

So the issue here is really whether it is in the best interests of your son for your soon-to-be-ex-husband to have unsupervised, extended possession periods when he gets out. You may need to rethink your agreement and opt for a possession schedule that limits his interactions with your son. It may also be reasonable to consider provisions requiring him to seek treatment for alcoholism to expand his access rights to your son. You can expect that he will not be thrilled with your change in position about the divorce and this may turn into a contested divorce.

The same persons are entitled to a copy of the under Probate Code section 16061.5.

So, without reviewing all of the documents, my best guess is that your half-sister is entitled to a copy of the trust even though she's not a beneficiary.

If your daughter does not live with you, she'll likely be considered emancipated. For father to terminate child support, he'll have to file a complaint for modifications. If you have issue with his lack of compliance on any issue, a complaint for contempt must be filed.

Is this a question? Your daughter owns the property as a matter of public record. If you feel there was some agreement she would hold it for you or would not sell it, you should consult a real estate litagaton attorney to bring legal action and dispute the ownership. Did you have some type of written agreement with her? Was there an oral understanding? Were your trying to defraud your creditors in the transfer? DId you, in fact, defraud your creditors? Do they still have claims? Should you have considered bankruptcy and tried to protect the residence ( perhaps water under the bridge at this point)? These issues will need to be discussed with counsel who can advise you as to your rights once they have all the facts..

I agree completely with Mr. Christian. You gave her the house, and did so under circumstances that exposed both of you to charges of fraud on creditors. Unless you had an agreement that she would deed it back to you and can prove it, she has every right to do what she pleases with the property. And of course if you prove an agreement that you transferred it to her to hide the asset from creditors and then she would transfer it back, you have a whole other set of problems.

The child is not automatically entitled to permanent resident status. There is a protocol in place for children born abroad to LPR parents that allows them to enter using what amounts to a non-immigrant visa to promote family unity. You can file the I-130 visa petition for your child but as an LPR that petition is subject to the annual quotas and will take some time to become ripe. When you naturalize, you can upgrade that visa petition and your child can then adjust status immediately. If you choose not to naturalize you will need to monitor the child's status until such time as the visa petition does become ripe to ensure the child is eligible to adjust status at that time.

I have a question on behalf of a friend. His mother racked up large amounts of money under his name and left the bills go unpaid. Many of these charges under his name were made without his knowledge or consent. As a result it has destroyed his credit. He is stuck in a deep hole. He doesn't have any money to file for bankruptcy. He also refuses to sue his own mother. Recently, we were discussing this problem with a mutual friend and they mentioned that there may be a way to not sue the mother but rather transfer all of those unpaid charges unto her name. Hello, unfortunately there does not seem to be any other option but to either file for bankruptcy or do nothing. If there were fraudulent charges, he should have contacted the credit card company upon discovery and they could have looked into it. However, if charges were made without consent possible criminal charges could be involved.

Bankruptcy would clear up the bad credit and eventually he would be able to get credit back.

That is a very common and standard form of trust. The most challenging part is finding a trustee and a set of successor trustees (anyone can get hit by a bus) who are capable and willing to take on the duties involved in managing things for your son. Any attorney can help you set up a basic trust that would be revocable during your lifetime with you as trustee, in case who knows what happens and you need to revoke the trust, then becomes irrevocable with your chosen trustee in charge when you die, and lastly goes to charity once your son dies (although you might want to think about providing for his children should he have any, and then have it go to charity after THEY die). What you need/want is all VERY standard.

Yes. If you get evicted the landlord will get a money judgment for any unpaid rent on top of the order that you be moved out of the premises. That judgment can then be enforced by, among other things, a levy on your bank account.

Your landlord is WRONG that it is "up to him." That does nothing to solve your problem.

Now I am going to say this one more time. The lease is probably not voidable. If it is not, then the law says the lease ends on the month/day/time stated in the year after the lease is signed. If you are right and the lease is voidable, then you are a month-to-month tenant as a matter of law. That's it. No other legal rules apply.

Either you have a flawed but enforceable lease. OR you are right and it is voidable. That makes NO difference to your problem. EITHER WAY YOU ARE OBLIGATED TO PAY YOUR RENT OR YOU GET EVICTED AND A JUDGMENT AGAINST YOU FOR UNPAID RENT.

So what can you do? Pay rent until you move. Period, end of story.

Since your sister is a named beneficiary on a Life insurance policy the proceeds are hers. Morally she may be obligated if the probate assets are insufficient to pay the expenses but legally the money is hers. The cost of the funeral should come out of the probate estate. Of course if the funds are insufficient the funeral home will look to the party or parties who authorized the various bills.

Mr. Weistein is correct. The life insurance proceeds are not part of the probate estate. You are not personally responsible for paying any of your mother's bills (unless you incurred them or guaranteed them). If there is insifficient money in the estate to cover her bills, you have an insolvent estate. There are specific laws covering insolvent estates. If you follow them perfectly, you will eliminate the possibility of having to personally pay for your mother's debts. I recommend that you speak with an attorney to assist you.

If I understand you correctly, you have a power of attorney given by your sister and wish to file a suit on a claim that she has. You ask whether you can sue in your name alone. The answer is no. It is possible that the power gives you the ability to sue in your sister's name but you cannot sue for her or represent her in court unless you are admitted to the bar as an attorney at law. If you have a related claim, you may be able to sue in your own name but that would not resolve any claims that your sister might have.

Succeeding on an order to show cause is not like filing a case in small claims court. If you have a claim that warrants such a suit, you should engage a lawyer to help you.

The HOA incurred $650 in attorney fees which they charged to my account.

In Mar'15, the foreclosure process began. I didn't respond to the notice I rec'd since I had already submitted an offer from a buyer to bank, the bank confirmed receipt of my finl info and said that they would halt the foreclosure process while they considered the short sale.

However, the HOA rec'd a summons re foreclosure, and they incurred attorney fees to respond.

Am I obligated to pay for these atty fees?

Unfortunately you will be responsible for these attorneys' fees. Hopefully you are able to get the lender to pay them to complete the short sale. If not at times you are able to get the buyer or realtor or title company to take a hit and pay al of some of the fees. Regardless, you will have to get the HOA satisfied to close on the short sale. On the facts you present, whether you did anything illegal depends on if she was telling the truth. If she in fact owns the lake and land and you sat on your tush and continued to fish when she told you to leave then you have likely committed at least some form of trespass possibly some form of theft if you caught and took any fish - both of which are crimes and both of which are illegal. If she got enough identifying information and wants to take the time and effort to go to the magistrate to swear out a warrant, then you are possibly going to be arrested soon.

You can ask your employer for a pay increase. But they do not have to agree to it.

Legal terms mean things. If there is a trust then executors do not apply. Executors are in charge of estates where there is a will. Trustees are in charge of trusts.

So the first thing you need to do is figure out what you have. If you have a revocable living trust, there should be a pour-over will in case there were any assets not owned by the trust. The pour-over will provides that everything that is not already in the trust "pours over" into the trust as of death, after payment of estate bills.

If all property was owned by the trust already, then there would be no need for probate. In that case, the trustees then just follow the trust by paying debts and then distributing the net estate.

I don't know what you are referring to. A trustee needs to file accountings/annual reports with beneficiaries unless the beneficiary waives a right to the information in writing. However, these are given to the beneficiaries, not filed with the court.

If an estate is probated (because there is a will and assets justifying probate), then inventories and accountings are filed. If the will did not provide for it, then all of the beneficiaries can agree in writing to waive the filing of an inventory The same is true for filing an accounting.

To my knowledge there are no forms. If an estate is sizeable enough to justify the creation of a trust, then it is sizeable enough for you to be hiring a probate attorney who can draft this.

And really, what prying eyes do you think would be reading any inventory/accounting reports anyway? I don't know where this is, but I for one have better things to do than go see what my dead neighbor owned at the courthouse. Most of my clients have no interest in visiting the courthouse. So unless you have a Gladys Kravitz for a neighbor who loves going to the courthouse and poring through estate files to read inventories and accountings, I just don't see the reason for this concern here and why there is an overwhelming need for secrecy especially as this estate is under $1 million. We are not talking about some fabulously wealthy person who could be featured on lifestyles of the rich and famous with houses, boats, planes and so forth.

Next, in Texas under the Texas guidelines, when a person is not named the primary parent or if there is not a 50/50 custody arrangement agreed upon, and where there are (3) three children, that non-custodial parent should be paying 30% of their gross monthly income in child support per month to the primary or custodial parent. And, that 30% is taking your gross pay minus only a deduction for federal and SS taxes - unless you can prove that you have other children that you support or that you are on disability. In addition to this, under the Texas guidelines you could be ordered to pay an additional amount for the children's medical/dental/vision support above this percentage plus pay a percentage of their un-reimbursed medical/dental/vision expenses.

I would recommend to you, and to anyone who is involved in a custody battle or a divorce involving child custody, that you retain and pay a qualified family law attorney or divorce attorney with custody experience, to handle these arrangements for you, or ask a family member to help in retaining and paying that attorney so that they can properly advise you. However, the ultimate decision regarding child custody arrangements, unless court ordered, will be your decision.

Keep in mind that once the custody orders are entered with the court, these orders will be very difficult to modify or change, and in order to change or modify an order, time will have to pass and you will need to show a substantial change in circumstances in order to warrant the modification change, which is often times difficult to prove. Or you would need to have an emergency situation occur that would substantiate a change. Either way, you WILL need to retain a qualified and experienced child custody attorney in order to assist you in any modification effort that you attempt to enter into in the future.

You gave an indication that you are in NJ but you gave a NY zip code. In any event, whether you are in NY or NJ just because your arbitrator has a previous decison overturned is not cause for you to seek his or her removal before a decision is rendered in your case.

I've been checking in with a bondsman every week with no upcoming court date. When I called to check in this week, they informed me I have an upcoming court date; however, I have received no communication from my attorney or received anything in the mail informing me of this court date. What could it be for? I haven't received any communication back from my attorney yet.

Assuming that the court has your correct address, you should receive something in the mail regarding your court date. You can call the court provide them with your information and ask if you have an upcoming court date and ask them the purpose of the hearing.

I'm currently in a Workers' Comp battle, I've been denied because they claim I didn't fulfill my light-duty capacity during my injury. My doctor wrote a note restricting me to either sit-down work and if no work was available, then I should remain out of work. My employer couldn't find any light-duty work for me and I remained out of work. However, the court said I should've looked for other jobs to accommodate my light-duty needs during my time out. I didn't know I could look for other jobs and my question is, can this help in my Workers' Comp case?

First, there are no "liens" on your credit report. You are mixing apples and oranges here.

(1) Judgments are entered if you owe a money debt to someone for something, not liens, and the person or company to whom you owe money sues you.

(2) Judgments in NC NEVER go away. However, for enforcement purposes, the judgment is enforceable by way of execution for 10 years only. If the creditor wishes to keep on trying to collect, they basically have to renew the judgment by filing another lawsuit before the 10 years is up from the date of entry of the first judgment. If renewed, the second judgment is good for another 10 years. So even if the judgment is no longer on the credit report a maximum of 20 years is a long long time to be able to enforce a debt obligation.

(3) Bad debts, late pays and other derogatory financial information - can stay on your credit report for about 7 1/2 years from the time you stop paying. But note that if you have a bad debt it can be listed with the original creditor and if sold to a junk debt buyer can be listed again with a junk debt buyer and if it goes to judgment it can be reported as a public record. The judgment can stay on your report for 7 years from the date of entry but the date the debt went delinquent has no bearing on this. So what this means is a bad debt could be reported and then be sold to a junk debt buyer and be on your report for 2 years; the junk debt buyer sues and gets a judgment. The judgment stays on there for 7 years (even if satisfied by resolving at some point).

(4) Because a prior judgment can be renewed by filing a second lawsuit, that second judgment can be reported on your credit for another 7 years from date of entry. It gets a new docket number.

So in sum - judgments can be reported for a total of 14 years on your credit and they will be enforceable for a maximum of 20 years regardless of whether or not they are reported on your credit.

Bottom line - if you have a judgment against you, if you are relatively young and someone who would someday like to have a home or refinance an existing home or otherwise get credit then you need to think about resolving the judgment in some way - whether its by paying in full, by settling or by bankruptcy. The only people who might not care are those who have no assets, no need for credit and some other circumstances - either advanced age or being terminally ill.

Unpaid judgments can stay on your credit report for 10 years. Judgments are easily renewed for a second 10 years. The judgment creditor files a new lawsuit against you, usually about 9 and a half years after the first judgment, and requests that the judgment be renewed. If the judgment creditor does not obtain a new judgment to renew the old judgment within 10 years, the old judgment is no longer enforceable and it will probably stop showing on your credit report.

Even if you pay a judgment in full or settle it, the judgment will still potentially show on your credit report for as long as 10 years after the judgment is entered (up to 20 years if the judgment is renewed) Judgments show on your credit report if the credit bureau researcher finds them. If a judgment does not show on your credit report and it has been less than 10 years since the judgment was entered, that does not mean that the judgment is invalid or unenforceable.

I just discovered I did not accrue the vacation hours I normally accrue this month since the employer claimed I was over the max accrual amount. The max is based on 150% of an annual accrual amount. I was accruing 200 hrs /year so my max was 300 hrs. However, the company said they changed the vacation accrual policy so that I now get 160 hrs/year and my max is therefore 240 hrs and I am above that and so I did not get my vacation accrual for January. Can they change the accrual rate like this to just some employees? I've been earning this vacation accrual for over a year and a half now and was hired into my position w/ the understanding I'd earn vacation at 200 hrs/year.

An employer can change the vacation accrual plan for at-will employees, whenever and however they like, provided that it does not constitute unlawful discrimination. They cannot take away vacation, however, that is already accrued. If you had accrued over 240 hours by the time the policy changed, your employer cold not reduce your accrued hours to 240.

A change in policy can certainly affect some employees but not others without violating California law.
