Then we went into court the complaint was read we pled not guilty and judge appointed us an attorney.Then the da told the judge that the probation officer wanted a chance to work with my son and me then gave us another court date in two weeks. Before we left the court room the attorney that was appointed to us turned around and said" i guess u are going to talk with the probation officer this case should be dropped". Probation wanted me to call and schedule an appointment the next day and stated that he would give informal probation and put the case on hold. I felt that the probation officer was being really pushy and in a hurry for some reason, so i did not call to schedule an appointment. His next email was alot more relaxed and said to call some time before the next court date.After researching i believe that if we choose to fight the case that all my son would get is the same thing informal probation.It is said that my son was in possession no (weights given) i believe it couldnt be over a gram.Is it possible that we could get this dropped to an infraction since that is what it would of been if not caught on school grounds, Less than an ounce .When do they decide to test the so called "Hash oil" to see if it is even a narcotic ? From what i have researched the lab could end up doing test and maybe keep what little is left.Then as a defendant dont we have the right to ask for the results or reports and underlying data. Then dont we have a statutory right to test evidence and if thier cant be a test preformed for what ever reason we could get the case dismissed. Bottom line is that i feel that we can get it dropped, and have other choices. Do you believe that there could be options?He is 12, fist time charge, not doing to bad in school.It was cited as a felony and when we told the first probation officer that we had nothing to talk to them about and to file charges they filed as a misdemeanor. First of all, you CANNOT redo the property settlement. You can attempt to enforce it. However, impossibility is a defense to contempt. If his credit prevents a refi, or if the assets are upside down where he can't, a contempt could be a waste of money. OTOH, if you can show it is possible, contempt may help.

You need to hire a new attorney; one document, a Dismissal of Attorney, will fire the current guy, and a Substitution of Attorney will name a new attorney in his place.

You can write to the WCAB Judge that you insist the Insurance Company be ordered to obtain new counsel given your attorney is working there, creating a conflict of interest for the current defense firm. There is no requirement that the judge will order the insurance company to get a new lawyer. But it wouldn't hurt to alert the judge that your counsel abandoned you for the opposing firm.

DO NOT talk to "fight for you" TV advertisers!!! that's the wrong move. YOu need not just an attorney but a Certified Specialist in Workers compensation law... we specialists took an extra bar exam just in workers comp and complete continuing education just in workers comp...but we charge exactly the same as non-specialists who goof things up.

Most likely everything went to your father. If you need to handle his affairs, you need to file for guardianship of him. If your mother owned anything in her name alone you need to probate her estate. If what she owned in her name alone was less than $100k, then you can file a small estate affidavit (look into the rules on this). If not, then you have to file for a full probate. You should consult with an attorney about this.

Well, I'm going to start out by saying that the answer seems to be "yes," but I need to add to that to make sure I understood the question correctly, and to make my "yes" answer more specific.

First, I assume that you bought a piece of real property and financed part (or all?) of the purchase price by giving the seller a promissory note secured by a deed of trust. This is the usual way of financing real estate purchases in California, by the way. Next, I assume you are re-selling the aforesaid piece of real property to someone else. When you do that, there's no reason why you cannot accept the new buyer's note and deed of trust as part or full payment. HOWEVER, when you sell the real property to the new buyer and therefore are parting with ownership of it, you will probably have to pay off the remaining balance you owe on the promissory note you gave to the original seller. That's because the note almost certainly has a "due on sale" clause in it. Some seller/lenders will waive the "due on sale" clause; I advise you to read your note carefully, understand its terms, and if necessary, try to negotiate to get the clause waived.

Don't be concerned about getting your money back if you are a New Jersey tenant. A NJ landlord, whether the original landlord of the bank, has an obligation to disclose, in writing, the location of your security deposit within 30 days. If that didn't happen, you may inform the landlord that the security deposit is to be applied to the rent. Thereafter, the landlord can never ask for a security deposit again. So, if it were me, I would just tell both the original landlord and the bank that I am applying the security deposit to the rent. If you are not a NJ tenant, your rules will be different. Either way, you may want to consult a local lawyer.

It is generally not a good idea to cancel a Will, since there may be property unknown to the testator which may need to pass in some fashion to heirs. A common practice in more sophisticated estate plans is for a Will to "pour over" to a trust established by a testator, so that the probate is simplified and the ultimate distribution is handled outside of probate. Your attorney can explain further.

In our contract with the client company, we had included a clause saying they would not be able to directly hire any of our employees for up to 6 months from date of termination of our contract. Herein lies the rub, she says if the 3rd weekend coincides with a holiday that falls on Monday, and according to the school calendar the Thanksgiving holiday starts on Monday, she has the kids that weekend through Monday. I say that rule does not apply for Thanksgiving, it has its own rule and it cancels out the weekend rule. The Thanksgiving holiday starts at 6pm the last day school before Thanksgiving. Who is correct?

Apparently, this is the "new" area that people are "fighting" about. A Houston Texas facebook page has family law attorneys posting this exact question at Thanksgiving. I wonder if they were discussing your case or another case similar to yours - interesting. The concensus on that site was that since Thanksgiving was specifically mentioned in the Decree that it is superior to the 1st, 3rd and 5th week-end visits. And, if the parties ended up in front of the judge that the judge was going to give the non-custodial parent make-up time and attorneys' fees.

The case in question arose because the school did not specially call it Thanksgiving week-end because there were some "teacher days" before the actual Thanksgiving break to give the children a couple of days extra of days off from school.

This is why attorneys make money -- people fighting over silly stuff.

So if your ex wants to try to avoid you having Thanksgiving -- then let her & then go before the judge and get make-up time and ask for attorney's fees. Judge's tend not to like ex's being petty over this type of stuff. Judges want parents to see their kids - especially at holidays.

If your parents have not had success finding a company that will file a satisfaction of mortgage on the original debt, they may have to file an "action to quiet title" in Superior Court. However, the issue is not with the company that sold the loan but rather with the company who holds the note now or held it last. If the note and mortgage were sold together (as is almost always the case), the new company becomes responsible for servicing the loan and for issuing the mortgage satisfaction. There should also be a public record of the assignment to each new lender as the loan is bought and sold. Your parents' lawyer probably knows all that and is trying to solve the problem without getting it too messy. However, in the end, there may be no easy way and there may have to be a suit.

To use your skills and education to get an employment based visa, you'd have to change status while in the U.S. Without more and based solely on what you've written here, departing the U.S. immediately and then applying for the relevant employment visa abroad is your best chance at regulating the current issue. That said, the DoS doesn't have to issue you a visa (based on your overstay) and if DoS does issue you that visa, CBP does not have to admit you to the U.S. upon your return (even with a valid visa). So tread carefully.

In 2000, i plead guilty to one count of PC 311.1(a). I received no jail time (i never spent any time in custody) and was not required to register as a sex offender. I was 21 at the time and did quite a poor job of finding out the exact details of my plea. As i remember, i believe there was mention of a reduction to a misdemeanor and possible expungement after successful completion of a three year probation.

I completed my probation successfully and have had zero law enforcement contact in the last 15 years. I have since moved out of State.

Is expungement even possible for this type of felony offense? Is it possible to get it reduced to a misdemeanor? If it was reduced, would it show up on a background check by an employer?

I'm desperately trying to get out from under the stigma this puts on me and the damage it causes with potential employers. What would be the best way of going about it? Would i have to go back to the courthouse where i entered my plea and petition a judge? Would there be any point in getting a reduction for this type of offense?

What I'm really looking to do is get it expunged. Any and all help is greatly appreciated.

California does not have a true "expungement" statute. What we do have is a dismissal under Penal Code 1203.4. If granted, it doesn't wipe the case off your record, but it adds a notation that the case was dismissed. That allows you to tell most employers that you have not been convicted of the crime, but it remains on your record and still counts as a prior conviction.

Contact a good local criminal defense attorney that practices where the conviction occurred.

Nothing has been paid in 5 months. He is not over 14,000.00 behind. This isn't my main concern. My main concern is that since we had our custody hearing, he has yet to take advantage of the order. The landlord however has turned out to be a deadbeat landlord and in turn has lost utilities to his property and has violated the lease agreement in a multiple of ways. The County is looking to pull his use permit for the property but has not done so. The County has ordered this landlord to file unlawful detainers on all tenants and lease holders to quickly evict them. Your story does not add-up. The county has no power to order a landlord to evict tenants, and they certainly would not do it without paperwork. I don't know what the real story is, but it is not as you describe it. Is your landlord lying? I don't know. It just doesn't add up.

However, forging a signature on a legal document is a criminal act, and you could make a police report. Because this involves HUD, a federal agency, you might also contact the FBI. From your description, it sounds as if, in addition, the woman intended to perpetrate a fraud on a federal agency.

Even if you don't want to get the police involved, at the very least your friend should notify the building's management and HUD to see if they can help straighten this out. Naming someone as a beneficiary works for insurance proceeds and a few closely-related things such as death benefits, but is not a will substitute and does not affect the distribution of a person's own property upon their death. Whether filled-out but never turned in paperwork will be deemed effective by the insurers is probably a matter of their own policy, and needless to say if the insurance proceeds have been paid to someone else, there won't be a second distribution. An employer may indeed offer a death benefit payable like insurance, or perhaps even some life insurance per se, as a fringe benefit. However, I'm really doubtful that a checking account would involve anything payable to a beneficiary....maybe the idea was that these papers would make them joint tenants with right of survivorship, which is legally not the same thing as a beneficiary, but would entitle her to own the money in the account upon his death, by operation of law.

As a practical matter, a decedent's property passes to heirs (as opposed to beneficiaries) by will, or under the rules of intestate succession if there is no will, or when steps have been taken to put property in joint tenancy or trusts, under the rules associated with those vehicles. Intestate succession rules provide for inheritance by relatives when there is no will, and girlfriends are not on the list.

I would take the papers, along with a copy of the death certificate, to the HR manager at the employer and an officer at the bank, and see what they say. I would be a little surprised if your daughter gets anything, but it's certainly worth a try.

A few questions would need to be answered such as whether he was to pay you a monthly amount on the promissory note, or whether you have to wait until the end of the year before it comes due and payable. If the terms state you have to wait a year to collect the full amount of the loan and profit then you will have to wait until the year is up to sue. If there was a monthly requirement, you could sue for breach of contract because of the failure to make the monthly payments. As far as the "mental torture" typically there is no cause of action for mental distress based on a contract, so it is unlikely that a court would rule in your favor on this type of claim.

From the date on the summons I was able to recall a stopped van (broken down) to the side of the exit ramp off the toll road I had just left. It was hanging out at such an angle that cars were backing up as they had to slow down to get by it. As I approached and passed by this car I could see some guy standing on the walkway at the end of where the ramp merged into street. I came up to a yield sign, looked right and saw the guy was on the walkway several feet back; looked back to the left and as the way was clear/no traffic, moved forward. I immediately hit a nasty pothole and at the same time heard a shout from behind. I slowed to a stop and saw this same guy standing and looking at me. I thought he was some kind of nut, and drove away. After receiving the summons, I contacted an attorney and made it clear to her that there was no accident and in subsequent communications I told her I believed this was a setup. It's just this person's word against mine. We have a court date for tomorrow and I am just nervous as I've never been involved in anything like this before. What is the best course my lawyer should follow?

Background:

I am a Veteran and Disabled. I hired a contractor by the VA to remodel part of my bathroom in order to be able to get into the shower.

While removing part of the bathroom shower curb to build a slope for ease of entry and it was discovered water and mold intrusion. We called the insurance company (USAA) and notified them promptly as well as I notified the VA. USAA sent out their adjuster and noticed dried mold and water that dried up over two days. We continued to demo the shower unit and found excessive water/moisture inside on the outside concrete block wall and under the shower pan. Again we contacted USAA and notified them of this and they sent out their adjuster again for inspection. Once the adjuster came out they not only inspected the shower again, but the entire exterior of the home and roof structures. They noted several deficiencies, wall cracks, etc., but could not find water intrusion. However they said that there was over 38% damage to the roof.

Further background here is that in 2002 the house had a major fire with total loss, USAA had their adjuster inspect, qualify a claim and handled hiring a contractor, not us and we did not sign any contracts for the work and was completed with repairs in 2003. The paperwork as we have discovered stated that the bathroom we were working on was to have been completely demoed and redone. (This did not happen). The roof was suppose to be a 3 tab 25 year roof and the present claim from the adjuster states 3 tab 20 year roof.

Is this a case of latent defect under Florida Law?

FL Statutes for latent defects gives a person 10 yrs to file a lawsuit or 4 years from the date of discovering the problem. Latent defects are something that is not visible to the naked eye. The only thing I did not pick up on in your write up is when did you discover the mold and water intrusion. If it was more than 4 years ago, it would be too late to file a lawsuit. Also noted, your issues may have arisen out of the 2002 reconstruction. The 10 year statute of limitation is this year. As it goes with your insurance company, they likely have a clause in your coverage which only gives you 5 years to file a claim for latent defects. You can ask them where the 5 yr limitation came from. Lastly, before you can say it is a latent defect, it must be determined the source of the water intrustion. It may not be from an exterior source; but, from a crack in the tile in the shower.

In Minnesota, the statute of limitations on a breach of contract claims is 6 years. Depending on when you defaulted, you could have a defense to the action. You should have an attorney review to see if you can bring a motion to dismiss. If they did obtain a judgment against you, they would be unable to get at the credit card because credit is not actually funds they can levy to satisfy a judgment. They could, however, attempt to get at bank accounts and other assets, although it sounds like what you have and receive is likely exempt from collections.

6 months ago we purchased a two family house and would like to have our daughter and her family move into the upstairs apartment. There is a tenant living there now that has been here for approximately 4 years, with NO lease, it's month to month. They have been good tenants and pay the rent reasonably on time, but unfortunately my daughter and grandchildren need a safe place to live. Can I legally ask the tenant to move and how much notice would I be required to give?

The New Jersey Anti-Eviction Act generally protects a tenant against most evictions not caused by the tenant's actions. There is an exception for dwellings of three or fewer units where the owner intends to /personally occupy/ the premises. However, there is no case law that I could find in a short search that would extend the exemption to members of the owners family especially if there is an intention to charge rent. So, your ability to evict the tenant may be limited or non-existent if the tenant wants to sign a lease. (You can require that but it will do you no good in these circumstances.) It may be better to see if you can negotiate for the tenant to move. If that does not work, you may wish to contact a lawyer who can look into the matter further.

The answer to this question depends on whether or not you occupy a unit within the building. If the property is owner occupied and three units or less, the Anti-Eviction Act (AEA) does not apply. In that situation you can evict for any reason or no reason upon notice and following court process.

If it is not an owner-occupied building, it is difficult to evict the tenant. You need to be able to show one of the 17 reasons under the AEA to evict and you need to follow the procedures outlined in the act, strictly.

I would agree with Mr. Corbette, that it would be difficult to evict in the situation where you are not resident in the building. On the other hand is somewhat simpler if the building is owner-occupied. I would suggest a consultation with counsel in order to figure out what actions are appropriate.
