Capital one has a debtor judgement on me. They were previously garnishing my wages but I was recently unemployed for several months so they were no longer able to garnish my wages. So I got a letter from the court saying they gave an order to the judgement creditor that some of my money in an excess of $450, property or credits other than personal earnings that may now be in possession of #1 JP Morgan Chase to satisfy my debt. The property sought to be attached to any and all accounts. I am prohibited to remove or attempt to remove such money and doing so subjects me to punishment for contempt of court. Here is the thing. I never had an account with JP Morgan. The only thing I ever had was a car loan that was paid off 10 years ago and the car was taken by the trustee when I filed bankruptcy 10 years ago. So what came come of this? Is the creditor's attorney not doing very good due diligence or are they trying to set me up for some sort of contempt even though I am clearly not in contempt? JP Morgan is the parent bank for Chase so they are trying to "snag" any checking or savings accounts that you have with Chase Bank. If you don't have any accounts then you don't have a problem.

Only assets transfered to the trust are governed by the trust instrument. You should be concerned. Ask your father if everything he owns is in the name of the trust. If it is not, a probate may be required. To place assets in the trust name you must deed real estate, transfer brokerage accounts, retitle directly owned securities and retitle bank accounts. Perhaps he has done so.
Your father has no obligation at this time to tell you what he owns if he elects not to. He had no obligation to give you the trust, but it appears he decided to do so. If he elects to provide you more information, that's great, but it is his decision. Most of my clients do not disclose their personal estate planning documents to their children, in part because they may change their minds. Others simply do not feel it is their childrens business until death or incapacity. Be happy your father has used a living trust. Not everyone has the foresight to do so.

I refinanced the mobile home 4 years ago and allowed the bank to include the real property in the mortgage to make it somewhat more appealing to finance. The lien was duly filed on the land and the mortgage also lists the mobile home as primary security. I offered them the title, but was told that it was not needed. Here 4 years later, I am attempting to renegotiate the payments and they discovered that they do not have the title and no lien was ever annotated on said title. I presently have a clear title in my name and in my possession to the mobile home. Also the serial number that they have listed on the mortgage is incorrect. I have no idea where it came from, but I did not supply it to them as they never asked. If this goes to foreclosure or repossession, do they have a viable claim against the mobile home? Does this complicate matters for them in the event of my default?

My employeer went through a compensation review (base and bonus target would be combined for a new base) for US based employees (which I am one) and I emailed our US HR Lead asking if I would be eligible for the new compensation structure. I have an email from her confirming a new compensation, and another email from someone on her team with the same confirmation.
Then they said they made a mistake and my role/designation was not eligible.

The court will issue a bench warrant which will require that your husband be brought before the court when he is released from his current period of incarceration.
But what he should do is make a 1381 request by talking to his counselor or jailer while he is incarcerated. Then the court where he has the October 31 court appearance will have 90 days to come get him and to put him on trial.
There are a few exceptions to this but without knowing why he is scheduled to be in court on October 31 I cannot provide more information.

First of all, you are mixing up some issues.
If the deed is a grant deed, then the grantor is estopped from denying that he had title on March 1, 2013, because a grant deed contains a warranty of title. Thus any title subsequently gained by the grantor inures to the benefit of his grantee, because that grantor warranted that he had title. The result is different with a quitclaim deed, which may not pass title at all if the grantor does not have it.
Deeds don't get recorded with the courts, they get recorded with the County Recorder. A deed does not have to be recorded to be valid, it only has to be delivered. Recording creates a presumption of validity, and recording is important to put third parties on notice.

I also disagree in part with Mr. Roach about quitclaim vs grant deeds in this situation. If the middle grantee/grantor never acquired title, the final grantee could sue for breach of warranty of title if the original grantor, or the middle grantee/grantor disputed title and the middle grantee/grantor had given a grant deed. That would not be true if it was a quitclaim deed. So I agree that far. However, it makes no difference if it was a grant deed or a quitclaim deed to whether the final grantee now owns the property. The doctrine of after-acquired title says that if a grantor does not have the title he or she gives to a grantee, at the time the deed is given (recording being irrelevant to this rule) but later acquires the title that was previously given, then the final grantee's title is perfected and they become the owner immediately upon the grantor receiving the title that was granted forward. So the March 2 deed perfected the grant of title in the March 1 deed and the grantee in the March 1 deed actually came into ownership on March 2, regardless of when anything was recorded.

You have commited bigamy, which is a crime, Since you got divorced since, you can likely fix this by getting married again, assuming your new "wife" wants to cooperate rather than prosecute you. (Otherwise you may need an annulment). See a lawyer with all the details and expect to have a very dificult conversation with the woman that is not your wife.

My Dad has been in a wheel chair for over 2 yrs and not making wise, but rather foolish money decisions. He has almost gone through his life savings of over$60 thousand down to $16 thousand in 2 yrs. Many have come to their home and have taken advantage of them. He has no people sense and they seem to find the weak victims. I have found out through his complaining that his Home Health Aide has asked him for financial help on many occasions since she started there in October. I had been giving them assistance until lately, my herniated discs have given me more problems. So a HHC aide for both parents has helped me with their needs. Recently I brought the two issues to their Aides attention. One- Please don't confuse my Mom by calling her Mamma. My Mom always asks who she is and why does she think I am her Mamma? Aide answered, ok , I will not call her Mamma anymore. Secondly, I asked the Aide not to bring up her financial problems to my Dad's attention. She denied it. But I told her that she should keep her financial problems to herself. My Dad has a tendency of trying to fix everyone's problems. She said, okay. But the next day told my Dad that I assaulted her. She called her employer and complained that I assaulted her too. When my Dad called me after talking to her, he became angry at me and not the way a person should react when once complaining about her asking him for money . I realize she is taking advantage of the situation placing a wedge between my parents and I. My Dad has insisted that I am trying to get her fired. I have told him and my daughters have noticed too, during their visit Thanksgiving week. She has called my home and hung up and when I looked up the number I notice it being her number. My Dad told me that she was told to call the police on me if I come to their home and interfere with her being there. She now has more rights than I have, my Dad tells her employer that she never asked for money and he has never given her any, She spoke of her drug addict husband on numerous occasions to my Dad and I. Even mentioning she did not have money to divorce him yet. Nor does she have money for getting her call fixed. He has given her money to clean out his garage and she has access to his cash box , he keeps beside his bed. I am worried that her drug addict husband is involved in her scheme to get more money out of him. He recently, this summer fixed a strangers' that broke down in front of their home at 3 am. He let them in his home and gave the man over$500 to fix a strangers car. He does not think about the consequences, yet alone the harm her places my Mother in by letting people convince him that they need the money more than him. My brothers live in CA. The say, get the Sheriff to help, they can't do anything about it until after the fact. I am concerned that the Home Health Care Aide is exploiting them. How can I help my parents? Especially when my Dad does not see how naive he really is. Would you advise me suing the Home Health Care Agency? They said, they do background checks, but how about just getting this person out of their home? Sorry, but the lawyers you have talked to are correct. There is no hearing like that and judges don't ever do that. There is such a thing as a "civil" hearing, but that just means any court hearing that is not a criminal case. There is no civil hearing where the things you describe happens. Either the book you read was wrong or you are not remembering what you read correctly. The only way a person can describe what has happened and get an explanation of the law on the subject and possible remedies is to hire a lawyer to evaluate your case and explain your options. That is what we do.

The day after I was laid off the VP created new organization chart which shows new roles for exactly what I was doing. In fact the org-chart shows 12 positions for the position I was in, two filed by my colleagues, and ten that need to be filled.
I have never been given a negative review by my boss. In fact I make over my bonus.

Proving that the reason you were selected for lay-off is gender discrimination will likely be an uphill battle unless you can show a pattern of replacing men with women (I assume that's unlikely).
I do not know how old you are, but in these types of scenarios age come into play. If you are significantly older than those who were left or those who will be hired in your place, it would be a good idea to see if age discrimination claim can be made. You should discuss this with an experienced employment attorney in your area.

When the time comes for you to inherit, you would file and serve a renunciation of the inheritance. It is a volluntary act of renouncing your right to any inheritance and relinquishing your rights under the will. Your portion would then go to the next in line or be distributed as if you predeceased the decedent - whatever the document provides. You do not do anything right now if the person is still alive. It is premature until the death of the person who has named you as a beneficiary.

I have split my account balance as of the date of divorce and including the gains on that money to date to give to my ex-husband. In Texas, you only have 4 years to probate a Will, and to do so, you will need to retain a qualified probate lawyer to assist you in this probate litigation process.
- Next, I would need to see the Will in order to determine if there was a percentage of distribution or a set amount given to each heir.
- If it was a percentage of distribution to set heirs, then, the value of the assets at the time the Will was probated would be used, and not what they were when the Will was signed..
- However, if the Executor did not probate the Will when he should have and he waited and now there is a loss in value of the assets, the heirs may be able to file suit against the Executor, possibly for breach of a fiduciary duty. This issue would need to be researched as to liability if this were the case.
- Next, if the Will specifies that particular heirs are to get a specific amount of liquid assets and now, there is not enough liquid assets to distribute those amounts to the heirs, the Executor may need to sell off the non-liquid assets to make up for the lack of liquid assets.
- Again, I would need to see if the Will provides for this occasion, as when I draft my Wills for my client's, I include a provision which explains what to do if there are not enough assets at the time of passing.
- if there are not enough assets to distribute and the Will does not provide an answer, the heirs may need to litigate the distribution of the assets left through the probate process in court, and then let the probate Judge decide, and again, this may be a breach of duty issue on the part of the Executor if the Will was not probated in time and the assets lost value, but this issue would need to be investigated further.
- I would need to see the Will and the documentation of the assets of the estate of the deceased in order to answer this questions as these are only generalities.
- In closing, if more than 4 years has passed and you did not probate the Will, we would also need to look at other options to transfer the property and assets and the issues in resolving this matter. Either way, you need to hire a qualified probate attorney to assist you in this matter.

The day I got this new demand letter Feb 2007 I called HUD & spoke to rep who said mort co must have mailed letter to their Washington office and it got lost there. Thats bad enough, but what I really dont understand is after the foreclosure I wrote to HUD several times asking them to help me with what I still believe to be an invalid foreclosure sale, I provided FHA loan # and other info only to receive a standard form letter saying sorry they cant help me since I dont have an FHA loan. The loan # I gave them is the same one they're now demanding money on

Why was the foreclosure sale invalid? Some kinds of invalid sale could perhaps still be pursued after six or so years, but in most cases your right to contest the sale would be lost, and you probably can't raise bureaucratic snafus as a factor in your loss. What about the excess funds after sale - who got them? Was the foreclosure by trustee sale or by court action?
Your situation is intriguing and some lawyer may be interested in accepting the challenge of turning the demand now being made into a success for you.
I don't see a specific question here, just a set of facts that are rather clearly stated, and also a rather situation-specific fact set that doesn't lend itself to a bulletin-board type of statement of applicable law, as we are accustomed to do.
There are foreclosure specialists out there, and a few HUD bureaucracy specialists as well. The tend to be expensive.
If you want to send me a pack of info about what happened, I'd be willing to at least skim it, but unless I see a way to attack the foreclosure at this late date, I doubt there is much I can do. Maybe I could refer you to an HUD/FHA specialist, or possibly if you would be satisfied just to get them off your back, without recovering damages, I could write some letters on your behalf.

Your best bet is to go to the county you reside in (after the baby is born) and talk to your local child support enforcement agency. They can assist you administratively to pursue paternity and a child support order.
There are varying thoughts about the father's responsibilities for what you have purchased. It's not very likely that a court would order the father to pay half the costs of what you have already purchased. You can check with your local child support enforcement agency, though. Some agencies will pursue one half of the birthing costs for you.

Generally, an employer may not deduct any hours from an exempt employee's pay if the employee leaves early or arrives late; as long as the employee reported for work that day, the employer must provide a full day's pay.
So, in a word, yes, your employer's deducting 4 hours from your pay because you left early one day would place your exempt status in jeopardy, assuming it was correct to begin with. Which leads to the next issue, which is whether you were properly classified as "exempt" in the first place. That is based upon several factors, including how much you are paid, how you are paid, and what your job duties are.
You should consult with an employment law attorney for further advice regarding your specific situation. Many attorneys--including me--provide free consultations.

To follow up on Ron's comments, while your daughter would not be taken by US authorities, Child Protective Services would look after her until your named guardian was actually able to take her.
As an aside, you should be aware that since you are not US citizens, anything that passes between you and your spouse (or down to your daughter) in excess of $675,000 could be subject to a NJ estate tax. I strongly recommend meeting with an estate planning attorney who is familiar with planning for non-citizens.

I ordered the food and went to the window and handed the worker my card to pay for the food. he gave it back, then when he went to hand me the bags of food i noticed he had what looked like blood on his pinky finger. When he seen me looking he said, " i almost cut my finger off on that machine, i didnt touch your food though". But, i know for a fact that he fixed my sons drink and scooped the fries out to put in the box and bagged the food up. You don't have a claim for being fired, as Louisiana is an at-will employment state. As for defamation, if someone falsely accused you of a crime, or of some notorious thing, you may have a cause of action for that. Still, defamation actions are hard to prove and don't always come out to much. You will likely have a tough time finding an attorney to take that case, unless you have clear proof that someone seriously defamed you. Moreover, you have to prove that they "published" it, or that they said it to someone else (not you). If I tell you that you are a criminal, that's not defamation. If I tell your neighbor that you are a criminal, that's defamation. There are also some limited privileges, such as in situations where a person is giving a report during an investigation or where a person is in court or being deposed.
If you want to pursue some claim and can't find a lawyer to take it (a real possibility), you can sue in small claims court (justice of the peace court or city court, depending on what parish you are in) without a lawyer for up to $5,000. Still, my best advice, unless this has seriously affected your reputation and your life, drop it and move on. Good luck.

My cousin put the title in my mother's name and told her that she didn't want any money for it. My mom insisted on paying anyhow. She paid 6 payments for a total of $750. My sister went through the proper channels to have the car put into her name and now my cousin is saying she is coming to get the car, that it belongs to her. The car was in my mother's name when she died, it is now in my sisters name. There is no loan documentation and my mom had the title free and clear. We offered to pay the difference of what they "sold" it to her for which was $250 as a good faith gesture. She refused and said that she wants the car back. We have all of the checks that she wrote to my cousin and my cousin cashed them. Does she have any right to this car? She is threatening to take us to court, or come and tow the car. She even told my sister just to sign my mom's name to the title, after she died. Obviously my sister refused as that is illegal. We are not sure what to do. The harassment is out of control!

The answers you have received are basically correct, but somewhat technical. So I write to give you the overview. The courts cannot order someone to work unless it is a consent order. The 13th amendment prevents work orders without consent. The courts CAN, however, decide whether it is equitable (fair) to calculate support based on actual income, or what the person COULD earn if they found work or worked up to their earnings potential. In exercising that discretion, the court looks at many factors and balance the fairness as well as the needs and best interests of the children. A parent who has an MBA but is working part time at Starbucks while pursuing a degree in Holistic Zen Basket Weaving, is very likely to find himself having support calculated on a lot more than his actual income. On the other hand, a parent who is working part-time as a pharmacy clerk at CVS while pursuing a full time nursing program, is pretty likely to have only his actual income considered, because the court knows that once he gets out he will earn a lot more and be able to contribute more to the kids than if he just stays a full time pharmacy clerk indefinitely. Figuring out where your situation lies and how to advocate for an appropriate order under your particular circumstances and details of your case is where consultation with a good Family Law attorney would be money well invested.

A widow, with 2 sons, has cancer and will pass away within 3 months. The eldest son is named executor of her estate. The 2 sons want to sell her car and cash in her only asset (an IRA worth $90K) now and split the cash. The widow's house is under water and she owes $60 in credit car debt. The 2 sons plan on telling the credit card compannies there are no other assets (they have already stripped the house of everything). Question: Can the eldest son be held liable by the credit card companies/mortgage company for improper handling of the estate?

After an estate is opened, the personal representative (sometimes called "executor") can certainly be liable if he improperly uses estate funds for his own benefit rather than paying valid claims. If assets are sold to avoid known creditors BEFORE death that may amount to a fraudulent transfer and be set aside.
No matter what the expected life span, decisions during one's lifetime should be made in the best interests of the principal (i.e., the widow with cancer) which may or may not be the same as the wishes of the children/heirs. It is not clear whether the dying individual designated an attorney-in-fact or whether a guardian has been appointed. If not done to avoid creditors, lifetime gifts may be a prudent part of an estate plan. However, depleting assets in the manner described can create problems and specific legal guidance may be necessary.
After someone passes, the personal representative has a legal obligation to disburse funds in accordance with the law. Certain obligations, like probate taxes, personal representative commissions, etc. The law specifies how funds get doled out if the estate is insolvent (that is, has greater debt than assets.
