During that month and the jail tried contacting P & P to find out what they were going to do. They never got back with them. The warrant expired. He was released on his 12/12 date a month later. Approximately 10 days later they reissued a another warrant for the same thing. They sent him back to prison for 87 days. Was that legal? If so, why? If not, why?

If your husband fully complied with the terms of his parole agreement during those ten days he was out (including meeting with his PO) then the new warrant was probably bad. If he didn't fully comply, then the warrant was probably okay. Noncompliance during those ten days is a new issue, and the ramifications aren't limited by the previous activity.

Being watched by her parents and a babysitter while working is not grounds for a change, assuming they are competent people. Being left alone in the car, under a certain age is cause for concern, and therefore a valid reason to seek modification. I just received court documentation naming me as a defendant ( along with the county social worker and the foster family) in a child abuse case against a foster parent while I was the director of the foster care program 4 or 5 years ago. The foster child allegedly claims she was raped against her will by the foster parent's adult son. She became pregnant as a result. When it was brought to my attention, I immediately removed the child from the home and decertified the foster parent. I have no representation and don't know what to do. And, the hearing is next week according to the court documentation.

How do you know you were not served? I have had lots of clients with judgments who tell me they were not served when they were. Service just has to be made on any person. It can be at an old address or even a wrong address. If a person accepts the papers and does not tell you, you have been served. A creditor can also get service by publication.
I agree with Attorney Riddle but you first need to go to the courthouse in the county where the lawsuit was filed and make a copy of the complete summons and complaint, including any return of service by the process server or sheriff or a court order. You have to follow the current court order until the court date. You have to remember you put a motion in to modify or establish custody. This is not an order, but in its most simplistic form, a request/demand. The court then determines whether your request/demand is reasonable based upon the family code (after going through meaningful mediation). Thus prior to a hearing the current order will remain in full force and effect and you should follow it.

How is the property titled? The property may pass outside of probate if the title allows for the right of survivorship and there is a surviving party on the title to take ownership.

BOne day I came home from work, my ex picked up the phone, dialed 911, claimed I had assaulted her, and life as I knew it was over I was arrested and had a restraining order against me, I didn't even know why, and that same night her new boyfriend moved in. I want to set the record straight......she filed false charges, blackmailed me, and lied to the police and the courts. I kept handwritten journals of all her threats, and she got caught SEVERAL times lying to the police and in court. My only concern is to do what's best for my child. My question: should I bring these issues up in criminal court, or should these issues be brought up in family court?

Not sure you can "set the record straight" unless you're in court for a larger purpose. Trying to readdress your criminal cases is probably a waste of time. However, if there's been a "material change in circumstance" since the last time you were in court on custody or visitation, you can file asking for a change in that area and use this information to your benefit - but be careful because these are generally difficult allegations to disprove. You should definitely do a consultation before you proceed.

You definitely do not want to just pay the tickets off. It may cost you more money but you need a lawyer to go get the warrant set aside and get your case put back on the court's docket. If you simply pay the tickets, they will result in final convictions. An MIP conviction would result in a license suspension of at least 30 days and if you were to receive another one, it could be enhanced to a class B misdemeanor. At the bottom of the letter that was submitted to the court it states "We recommend that criminal charges be dismissed." If these charges are dismissed, why are they still showing up when an employer does a background check?

It sounds like you need to follow up with the court. It sounds as though you completed diversion, and the program gave a recommendation for dismissal. You need to see the court file at the courthouse and make sure the court actually dismissed the charges. The record of the charges will not get erased, but it should not count as a conviction. Private employers are not supposed to be digging around into arrests.

Are you in Trinity County, or Humboldt? I used to be a large landowner in both counties (Eureka Southern Railroad). You seem to be stuck in a huge and messy conflict with a neighbor that has decided for some reason to go to war with you. My first reaction was that you should look at your possibilities for moving, rather than litigating with this aggressive jerk.
If necessary, there may be ways to litigate, or even to negotiate, and come out ahead. It doesn't look as though you can afford the battle, which could be more expensive than these opening estimates or my guesstimate of cost to challenge the neighbor in court.

Absolutely not. However, you also have to think in practical terms, not only what is legally the correct answer. Meaning: if you mom is living with your brother or sister, as a practical matter, if they're not going to let you in the house to see your mother, what are you going to do? Unfortunately to solve this problem you may need to go to court and begin a guardianship proceeding. Because this may be very, very expensive, what you may want to do first is hire an attorney to write your sibling a letter telling them if they do not give you reasonable access to your mother, you'll be forced to ask that a guardian be appointed. It's going to be a real mess. What we don't know of course is why your sibling would seek to prevent you from seeing mom. What's that about? Very odd.

I have recently fired my lawyer due to lack of support regarding a couple of cases of mine. Both cases are still pending. I feel he is possibly bribeing me by going against his word on a case that is not mine. Seems as if he is working with the prosecuting attorney by trying to convince or bribe me to change my opinion on weather to testify against someone whom I am a "victim" to. It says that the receiving party has to issue up to 3 notices to cure. My lawyer claims that his paralegal called us and left a voicemail, but there's no voicemail and no record of her ever calling. He's maintaining that she must have called while "the phone was off" and thus, no record was made.
Is that plausible? My wife (who had no idea I hadn't paid) is now part of the automatic judgment. I can't allow that, she's 7 months pregnant and we need our income (we're not rich, hence the hiring of a terrible lawyer who should have won our case.)

If the creditor did not comply with the stipulation then you can move to vacate it. It may be that the lawyer or a member of the firm--not the paralegal--should have given the notice. It may be that he should have sent a notice by US mail. Etc. In the end, however you're likely going to need to pay him. How much we can get it down depends on some imponderables. You did not make this easier by signing a confession of judgment but you know that already.
Unless your wife gave you a power of attorney or she signed the settlement, his entry of judgment against her is very bad cookies. I will not say anything more on the subject without the attorney client and work product privileges being in place. But it looks like your lawyer may be five pounds of nightsoil in a one pound sack.

The State's Attorney has now enhanced my criminal mischief charge to (2) additional charges of Burglary and assault.

Paying the owner will only help in restitution, it doesn't matter if you can be criminally prosecuted. The other charges sound like it involved a third party as well. Since, this can get very bad for you, I suggest you hire an attorney and see them in person so that you can get a proper professional view of your case.

Please understand that your son appears to be guilty as charged. The beer seems to have been in his custody and/or control, which is what "possession" means in this context.
It doesn't matter that he and his friends hadn't been drinking, since he is only charged with possessing the alcohol and not with drinking it or driving under its influence. That the box of beer was in the back of the truck doesn't matter either, since "possession" does not mean "within easy reach". It also doesn't matter that the box had not been opened, since your son has not been charged with having an open container in the truck.
You should get your son a lawyer if at all possible. If you can't afford one, your son should rely on the public defender. Don't try to defend against the charges without counsel.

I slipped on snow that had been tracked in and fell in Foodtown. Paramedics were called as I badly injured my leg. Had to go to emergency room and it's determined I have a severe hamstring sprain. Foodtown's insurer is denying liability stating reasonable risk living in Northwest Ohio.
I slipped on their wet floor. The only sign posted was at the front door. I'm not trying to profit here but I'm injured and in physical therapy now.

Your question is a little unclear but I gather that your child's father was given custody of your daughter. He is complying with the visitation order, but you are concerned about the child's well-being. That the child becomes upset when she is to be returned to her father should be a matter of concern. I recommend that you have someone that you trust and who would be a good witness in court observe you and your daughter during weekend visitation and also during a transfer back to the father. You need to be careful with this, but given your history the court will want a credible witness other than yourself involved with the matter.
You have two choices: (a) you may file for a modification of the custody and visitation orders or (b) file a report with CPS and ask that the child be placed in your care.
Before you take any action however, you should consult with an experienced family law attorney.

If you don't live in the house, you could try to offer a deed-in-lieu of foreclosure, but frankly, I'm not sure how that would work with a second mortgage, since the first mortgage has priority, meaning that it controls the situation. You should consult a lawyer who represents owners in foreclosures to deal with both lenders.

Assuming he agrees to accept the house you will need a recordable quit claim deed. Simply transferring the house to him does not stop your obligations under the judgment unless he agrees to waive those rights. Simply giving him the house without his accepting the obligations of ownership does you little good..
