Question

I have a lawsuit against an elderly person. It's going to trial soon. The defendant has a living trust. If the defendant dies before trial is over and I win, how will I get the money due me?

Answer

The attorney representing you in the lawsuit should address this issue with you. It would be unethical for an attorney here to interfere with that representation. If you are Pro Sent in the litigation, you'll have to Petition for the defendant's estate to pay the debt.

Good luck
