The primary physical custodian has the right to claim the child unless it is otherwise agreed to in a settlement agreement. I assume your daughter attends school in his school district which will support his argument. You can always attempt to challenge it with the IRS, but it may be difficult to prove to the IRS she was with you more of the time. You may want to meet with an attorney to discuss your future options.

After a four year process, multiple procedures, and being told I will need to give up my career, and get a new job, we're finally settling. However, the number they're offering me seems insanely low. I've spoken to my current lawyer, but he seems to be too eager to get me to accept the settlement and just close the case, which is odd to me. He also informed me that if I pushed for too much more for my CNR, the defense would completely pull out the settlement, and I would be forced to take the Stipulated Award, which basically leaves me with nothing but medical coverage. I don't expect some massive chunk of money to be dropped in my lap, but after 10 years of education and working, I'd like to be at least collect enough to cover my return to school, considering the sub displacement benefit wont even make the tiniest of dents against future student loans. I've never been through anything like this, but I have spoken to several people that have, and when they came to settlement, they were able to request the numbers they found fair. In my case, my lawyers are urging me to tip toe around the offer already made, and not to ask for much more. I don't understand this. Especially when everything I google, shows people who have had the same exact injury, same exact surgery, and settled in less time, end up with triple the amount asked. Is this normal? Should I approach this differently? I'm not sure what to do.

See the Treating Physician on the MPN every 30 days instead of every 42 days, insist. Have the MPN Treating physician issue at least two Request for Authorization Forms every 30 days (acupuncture, meds, braces, a new mattress, a new cane, work hardening, strength training). BE A BIG EXPENSE for the insurer to keep paying companies to review the requests and paying the doctor for the report each month...and appeal every denial. The offers are lower today because your Assemblywoman and State Senator and Governor Moonbeam put into play a new system where nearly all treatment is denied, so because they have to pay for so little now (Maximus doctors -- nameless, faceless -- deny 80% of all requests so far on the Indpendent Medical Review IMR process), so the adjuster has no reason to boost up the 'buy out' of future medical until the law changes. That said, you can get a new lawyer, you are not married to this one who is clearly weary with you. I show people what they can expect at trial, in a stipulations with request for award and a compromise & release agreement ... if the Permanent Disability is not high enough, you get this attorney to return to the treating physician or the AME and confront them at a deposition with the Whole Person Impairment factors they overlooked. In addition, give the attorney a number that you expect, and just take the Stipulations With Request For Award when that attorney fails to get that figure for you, and attempt the Compromise & Release agreement if and when the Governor and State Legislature change the law and make treatment accessible again for injured workers.

Presumably the trust paying your father the inheritance is making checks out in his name. A POA is only valid until your father terminates it. While in effect, you owe your father a very high fiduciary duty in handling his money. Co-mingling his funds in an account in your name is a very bad idea.

Use the DPOA, create an account in your father's name to receive the funds - the trustee may be willing to set up a monthly electronics funds transfer so you won't have to deposit checks.

Be sure to consult with your father over what to do with this money. If he wants to sign checks over to you each month (say, for example, he doesn't want an account out there subject to seizure for court ordered restitution), that's legal, but get it in writing. I climbed a ladder & tried to show how the cyclone fence on my neighbor's side is parallel to the wood fence on my side. I cannot afford a surveyor either, but that is likely the best eventual course, to ensure the correct property line & whether the wood fence is a "boundary" fence. I tried to discuss it with the neighbor Monday evening, however, she is still having the "fence co." out to give an estimate. I intend to repair the center section of the fence and replace the post. When I went to check it Monday & take the photos, it appears someone from the neighbor's side has intentionally tried to push the fence down. A section in the center, where I will repair it, has been pushed over somewhat. It was never like that until now. Short of a survey, if we both have existing fences, does that mean we each maintain our own, or am I responsible to pay for 1/2 of a new fence? I didn't think the law could force me to replace it all if I can repair the bad section. Not paying child support is not the same as not visiting the children.

Only after consultation with a family law attorney, can your question be answered.

If he is active in their lives and objects to the move, most Texas judges won't let you move.

But, if you can show that he is not "in their lives" and it is in the children's best interests to move, then you have a chance to get a modification.

My landlord within 10 days of this happening had a random person enter the properity and remove my stuff (selling and giving the stuff away). I returned ( under 90 days) and found out he did this. Is this legal? I was told he has to store my stuff for 90 days. I was never served an eviction notice and when I sent friends and family over the random person told them they weren't allowed to take the things I wanted then to get.

Even where a tenant abandons the property he is renting, the landlord must notify the tenant in writing that he will only hold onto his tenant's property for 30 days, after which he will sell them or dispose of them, if the tenant does not come to claim his personal property within that time period.

In texas, i decided to take my state jail time and did 17 months,released free and clear. Colorado did not want to pay to extradite me back to face their charge, so i went at my own expense. I am waiting now to be sentenced. Can the judge run the charge in colorado concurrent with the prison time I just served in texas? The guilty plea that I entered in Co, said that their charge can have aggrevating circumstances, which can double my sentence time.

If there was a detainer placed against you while you were in custody in Texas, then at least under Texas law you would be entitled to credit for that time on both sentences. (Colorado law may be different so you might want to try using Colorado as your address so the question goes out to lawyers in that state.)

My guess is that since they did not want to extradict you, then they probably did not have a detainer against you.

Contact the jail in the Texas County in which you were prosecuted as well as the state jail in which you served the time to see if there was a detainer.

Also, your Colorado lawyer will know the answer to this question.

However, you should not travel without an approved I-131. No, the Labor Code offers no payments for a defendant failing to attach everything the judge wants to see.

However, you refer to the contract as Stipulations, then later you refer to it as Compromise & Release.

These are entirely different. IF YOU DID NOT sign a Compromise & Release agreement and the employer forged your signatures and initials and attempted to get it approved, then you may request a financial fine called SANCTIONS for somebody forging your signature.

If you signed both Stipulations With Request For Award ("Stips") PLUS the C&R, then no Sanctions are due against the employer.

She could even ask for the whole amount as the penalty for you failing to claim it.

It is a community asset on which you would have a certain right of reimbursement. You have made the payments but you have also had the benefit of being the insurance beneficiary, so there is some offset. Need look at cash value as of date of separation, your payments and current cash value. If you wanted to calculate the current community interest you could take the cash value as of the date of separation and add a reasonable return on that sum for the community. I am sorry that your sister is faced with raising the two children without any help from their biological father. However, Pennsylvania recognizes the rights of a biological father, even if he has not provided any support for the children and even if he has a criminal record. If the father has not shown any violent tendencies in front of the children and has never been violent with the children, the law will not discount his rights as the biological father.

If your sister chooses to disregard the legal rights of the father and travels cross country to relocate in California, the father can Petition the Pennsylvania Family Court in his County and obtain an Order which commands your sister to return the children to Pennsylvania. The father can take the Order entered by a Pennsylvania Family Court to California and the California Family Court would have to enforce the Pennsylvania Order under the "Full Faith and Credit" Clause of the US Constitution.

If she chooses to disregard the biological father's rights and travels to California with the children, she will find herself in many situations in which she will be required to show a Custody Order, awarding her full legal and physical custody of the children, entered by a Pennsylvania Court, awarding her full custody of the children, including enrolling the children in school, and when she is unable to produce such an Order, she will find herself in difficult situations which will have a negative impact on the children.

Once you have the expert opinion taking the position that there was a failure on the part of your doctor to follow the proper standard, then we have to see what are the damages you are claiming.

Yes. Withholding rent has to do with non compliance of adequate living conditions - ie plumbling, water, electricity. If you signed a lease allowing for tenant rental without your permission, then you would be in violation if you refused the tenant occupancy. AS to HOA regulations - would depend on what the arrangements are with the owner and the HOA Board. I know of a of townhomes that are rented in the HOA communities and if they have the permission of the Board, I don't believe they would be in violation.

I would want to know more information about what you have termed "a classic hostile work environment". Under Texas law, there is a hostile work environment -- in its legal meaning -- when the environment is hostile to a protected status or exercise of certain employment-related legal rights. If your boss is just a jerk then there's not a lot the law protects. If you are suffering under a hostile work environment in its legal definition then there may be some options available to take action against the company for prior and future acts.

There's nothing in Texas that prohibits a former employer or manager from giving a current or future employer information about your employment, even if that information is negative. However, most employers do not do that for fear of the legal repercussions of giving a falsely negative review. It's even more rare that a former employer or manager would go out of their way to volunteer negative information--true or not--to a future employer for the same reason.

I'm not sure how your supervisor would find who you are going to work for but I guess with all the social media and contact you may have with your current co-workers after you leave it is not impossible for her to find out at some point. Whether a future employer would take it seriously is questionable, too.

Have you spoken with HR about that? They may be willing to take action to stop your boss. If not, you could always have a lawyer send a threatening letter to HR informing them of your manager's threat and the legal repercussions should she do that and something happen to your future job. If that's something you're interested in pursuing I could certainly do that for you at a reasonable rate.

This is such a difficult question to answer. Cash is a weird thing. Due to inflation, cash buys less each year. For that reason, wealthy people very rarely have money kept as cash in a normal bank account.
Let's look at his company instead to understand.
When a customer pays Microsoft the money goes into the bank account. This is the same account that money is being taken out of to pay bills like rent, wages, materials, etc.
