I am a high school varsity assistant coach. I have situation where I took a job more than 2/3 of the way through the season. After signing a contract that states, " This supplemental contract is for the 2011-2012 school year, and is for this specified period only. Any other appointment shall be only at the discretion of the Board of Education. All terms and conditions of this appointment shall be in accordance with the 2011-2012 Collective Bargaining Agreement between the Board of Education and the Sterling Education Associatiom." (teachers/counselors) The High School Activities Director and Head coach did not contact me to tell me that they were discussing my paycheck and they made a decision to cut my pay without me present for "missing days". The coach says since I am missing days he is deducting my paycheck into thirds and spliting it between the freshman and sophomore coach to be fair. The Head coach does not deduct any other coaches pay for missings days. How is this legal/ fair? This is unfair to me because I am the only Coach being deducted pay for missing days. Shouldn't the coach have to deduct every coach for missed days?



Answer

Whether it is fair is not really the appropriate question. The question should be, is it allowed under the terms of the contract or the collective bargaining agreement. And without reviewing those two documents, there is no way to answer that question.
