Question

My 20 yr. old daughters father is trying to terminate child support citing emancipation because she works and lives with someone. She dropped out of school to pick up more hours at a second job when her father filed to stop child support. He has never been in full compliance with the court order, never providing her with health insurance even though he is ordered to do so and has had health insurance for some time. I have the order through DOR until she is 21. What are my options on her behalf.

Answer

If your daughter does not live with you, she'll likely be considered emancipated. For father to terminate child support, he'll have to file a complaint for modifications. If you have issue with his lack of compliance on any issue, a complaint for contempt must be filed.
