Question

My wife is a special education teacher. She has a student who keep injuring her physically to the point where she has already had a concussion and is now going to the hospital yet again for another hit to the face. The school refuses to remove the child which is well documented needs to be in a different program or environment. Yet nothing is being done. What can we do as her quality of life is diminishing and at this point feels like her job is just as risky as a police officer. I don't feel she should have to quit her job just because no one wants to do theirs and place the child in the proper program.

Answer

Your wife is not alone. I have heard this story before. Unfortunately, the administration of many school districts do not believe that dangerous children are a factor in the safe working environment that the district must provide. I don't handle the type of case that your wife presents but there are lawyers who can help. I suggest that your lawyer will tell you that you should use your wife's union's grievance process first. However, I think that you should establish a relationship with a lawyer very soon. Look for an employment lawyer who handles cases for employees. Some personal injury background would be helpful.
