Question

After have a settlement against me, I called to set up payment arrangments. They will not accept the arrangment, but I can not afford to pay more than origanlly discussed. They will accept my payments, but still want to garnish my wages. Can they do that?

Answer

The creditor cannot garnish your wages, until they have a judgment against you. If you have a payment agreement (and you're current on your payments) they probably can't get a judgment. If they have a judgment, and insist on doing the garnishment, you're not required to make any extra payment.

Good luck
