We are currently trying to buy a property in Florida. The property has an easement to the driveway for the property behind ours with rights to use it to the main road. The current owners to the back property have put up a fence across the driveway (easement) and constructed a new driveway fully on their property. With these two facts, does this constitute the easement forfeited?
