A judgment has been obtained for past due co-op maintenance fees and legal fees. I wish to stay in home and offered to pay entire amount. co-op management agrees but wishes to hold judgment in abatement' so that they may take the home without
filing another judgment if I am ever late in my payments in the future. How can I protect myself?
Answer
If you satisfy the judgment, the co-op cannot "hold the judgment in abatement."
Answer
They are required to satisfy the judgment if you pay 100% of it and the interest which is due since its entry. You need to hire an attorney to accomplish this for you. Future late payments will be dealt with as new occurrences after the judgment is resolved. if the judgment is for foreclosure on a lien, than you need to act to get that dismissed by paying the sums due. hire an attorney to help you.
