Question

What rights does a single mother have regarding physical/legal custody? Paternity has been established privately (name not on birth certificate) and the father has an appointment with child support to set up payment. Also, He would like to relinquish his rights and I am willing to let the support go if he does...but is this possible under MS law? Thank you!

Answer

No it is not possible. Chancellors will not terminate rights except in extreme situations unless there is an adoption pending. Not wanting to pay support is not an option.
