I rented a beach house for a week in ca and had to back out, I gave an 88 day notice and lost my deposit, which was 50% of the rent and the owner is now demanding payment in full, I did sign a contract and I did not notice that it required a 90 day notice, can he legally sue me for the full weeks payment (4,017.00)

He must make reasonable efforts to find someone else to take the week, but if he cannot, then yes he can require you to pay it.

I agree wit. the counsel's response. There is a duty to mitigate which includes advertising the rental and taking other steps in trying to rent it. Also if you can find someone who wants to rent it that may minimize your exposure.
