Question

i have a very sick 4 year old and have a court date today at 8 am. She has flu symptoms and is not getting any better. I intend to take her to her doctor/ER first thing in the norning. can i call the judges secretary from the hospital or doctors office to advise of this situation and get a date set...this is not a trial date but just an early resolution date and at this time i do not want to deal. the pd represents and their office does not open until after the start of the court call.

Answer

This answer may be too late. It depends on the type of hearing. If it was a hearing set by the court or the clerk, then you must be there or you risk arrest. If it was a hearing set by your attorney, you may not need to be present.
