Paying Child Support for an illegitimate Child

My husband is divorced with 2 children of which only 1 is his biological child. We have recently learned that the natural mother secretly had a paternity test done when the child was a baby and has been receiving support for the natural father until present (8 years). When this was confronted in court the judge terminated payments from natural father and appointed my husband full responsibilty of the child. How can this be possible? What can be done?

Your husband needs a sharp divorce attorney to assist him.

This kind of nonsense has always really gotten me angry, but your husband will have to live with the complex and contradictory New Jersey law in this area.

He needs a good divorce attorney, and he needs solid advice. Do not wait, that will only make it more likely that the Court will not change this.

I agree with Mr. Davies. Sounds like you either went without an attorney or went with one who was half asleep. Get in touch with an attorney ASAP as there isn't much we can do over the this site.

If you are saying that your husband is being compelled to pay child support for his biological child, that is the law. If you are saying that he paid support for another man's child for eight years after the mother knew it was not your husband's child the mother probably owes your husband a great deal of money.
