Who has legal rights over a child with parents who are not married?



Answer

If there is a paternity order then that controls. If there is no order and the father is recognized by paternity by the court, or assumed, as in on the birth certificate both have equal rights, though to be sure a father needs to file an action to establish paternity.

It is important to have a custody order in place,
