i am an ex-wife with a claim, by divorce decree, against my deceased exhusband's estate. however, my ex-husband's mother, who is the executor/administrator of my ex's estate, knows about the debt owed to me by his estate but refuses to pay it. any advice is greatly appreciated.



Answer

Get an attorney who practices probate law in the county where your ex resided when he died. This is where the estate should be administered. You also need to find out if an estate has been opened for him.. If so you need to file a claim with the estate before you can be paid. If you don't file a claim, your claim can't be paid.

You need to understand that there is a priority in which claims are paid.

For example creditors are paid before beneficiaries. However some creditors are paid before others.
