What are the landlord/tenant laws for deceased tenants? My parents recently passed away and didn't pay November rent. We are trying to remove their things in a timely manner but are unable to quickly.



Answer

Landlords have to give a notice to heirs allowing a short window of time to pick up items. If items aren't picked up timely as required by the notice, then the landlord may be able to sell and account for the sale of items, or dispose of items if they reasonably don't appear to be worth anything. The contents of the notice are technical, and the landlord might have made mistakes. If you're not able to work it out between you and the landlord, you should consult with your own attorney.
