We had a builder do some poor work on our roof. We paid them $300, they say we still owe them $900, and we have another estimate to fix it for $1,800. So we are suing for $3,000. Two questions: 1) Is it worth it to have legal representation for $3,000? 2) I read the losing side must pay the winning side's costs, does that include attorney fees?
Answer
Not sure why you are suing for $3,000 when you say you have an estimate to fix it for $1,800. It would seem your damages would be $2,100. Whether it would be worthwhile to hire an attorney depends on how able you are to present your case. For one losing party to be responsible for attorneys fees, there would need to be an agreement to that effect.
