I recently was employed by a commercial custom cabinet manufacture and install company. They made me sign a no compete contract when I was hired. I have recently started my own residential cabinet install only company. I have not and will not ever try to compete with them for their customers. Am I in violation of their non compete? In Florida by the way..



Answer

The non-compete agreement is limited by law to a reasonable geographic area and a reasonable length of time. If your agreement states that you cannot engage in a business that does the same type of work as your former employee, and it is appropriately limited in time and scope, then the non-compete clause is probably enforceable.
