can i personally obtain video survelliance tapes from a shell gas station for defense in a criminal case and may i get these for review before the courts do?
Answer
The usual way to obtain them is to subpoena the tapes. This goes through the courts. If the district attorney or the police have the tape you will get it through the discovery process. If you have an attorney and an investigator the investigator may be able to get it from the station.
