Ex husband and I separated march 2014, and had court and reached custody, child support, and visitation agreement for our 3 children. Hr has been paying his child support and getting all the kids on his visitation days. He is not the biological father of our oldest daughter who is now 7 years old. She does not know that he is not her biological father. He signed the birth certificate and we married 3 months after her birth. I have now decided that I don't want him to have any legal rights to her or visitations because he is not her biological father. What am I looking at?
Answer
You are looking at something that I suspect a court will refuse to okay (except possible if you and your ex and the bio-father all cooperate in court). By letting him sign the borth certificate and then saying it's his child in the divorce it IS his child legally, and it is highly unlikely a court will let you "basterdize the child" and also cancel his support. This is a case where "you made your bed and get to lie in it to use a proverb. Your odds are very slim, and you might even lose custody by trying something like this.

I agree with Mr. Ashman, and my other question is, why in the world would you do this to your daughter? I find this somewhat despicable.
