My husband and I currently own rental property in Kansas City. We live in TN so we use a Property Mgmt Company. In May 2014, we signed a contract with a Property Mgmt company and paid the $5,000 to repair and get the property tenant ready. Supposedly there are renters in the property, but we have not received any funds in regards to rent. Each time that we ask about the money, they always have some excuse. For the last 3 weeks we have called them on numerous occasions and left voicemails but no one is returning our calls. What are our legal rights? Can we sue? How should we handle this situation?

Obviously, if your not being paid rent, you can sue your agent, and probably cancel the mgmt contract. Without specific facts, it is impossible to guess what the mgmt company is or is not doing. Have you asked for a formal accounting of all activity? It's your property, they work for you. Accept no more excuses.
