Niece recently had baby. Father is a married man whose wife cannot have children and now the father is making threats to take the baby from my niece because he wants visitation and shared custody. Father is not listed on birth certificate and no paternity tests have been given. Niece wants nothing from him including any support etc. She has told him this numerous times and hasn't been in the picture until he found out the baby was born and his wife fell in love with the baby. Niece works two jobs and family watches the baby. She cannot afford to hire an attorney and monetary support from family isn't an option. What should be her next step to stop the harassment etc?

What "harrassment"? If he is the father, it is best for the baby to have the involvement of both parents in the baby's life. Plain and simple, it does not MATTER if your niece wants something else; being a good mother requires this approach and attitude.

In order to sort out support responsibilities, she should contact the local prosecutor's office and have paternity established. To discuss parenting time arrangements, she should read the Indiana Parenting Time Guidelines first and then consult a private attorney.
