When I was 7 months pregnant the father of my child left, he wasn't there for the birth but has been child support for the last 4.5 years (on and off) by depositing money to a card. His never been a part of my daughter's life, they have never met. His not on the birth certificate either. Does he have any legal rights on her? Should I just go ahead and file for sole custody? I live in California.

Should he obtain a judgment that he is the father he will have the same rights as any other father. Obtaining a judgment that he is the father should not be difficult, assuming he is the biological father.
