The attorney that did my initial chapter 13 forms a couple years ago did not include the specific name of tenant whom I held security deposits in escrow as their landlord. Subsequently, my chapter 13 plan includes the escrow account as "property to be surrendered", listing just the bank its held as creditor. Now a tenant is requesting their deposit back. The bank now owns the house as it was foreclosed. Did my attorney make a mistake with chapter 13 filing?
