a realtor was found in violation of article 1 of code of ethics (deals with honesty). I listed with her and she change real estate firms without telling me. she forged dates on contract. the broker made my life hell but was not found in violation of articles. they put misinformation re my listing that made it hard to find for homebuyers to find the property. Any advice out there for us?



Answer

It sound like you would have a good cause of action and should be able to establish liability. Your problem will be proving damages. if the realtor made representations regarding the likely sale price, you may be able to use that in the calculations. Likely, you will want to wait until you actually have a contract with a buyer and possibly until after the sale to add everything up. Be sure to include your cost of ownership during any delay. After that, you can talk to a lawyer to see if the case can be pursued economically.
