Question

My girlfriend of 7 year's and i have two kids and she moved out i have the kids but wants them who has right s to them right now.

Answer

Both parents will be given the right to raise the children. The court will determine which parent retains primary custody by evaluating the best interests of the children. You should consider meeting with an attorney for assistance.

Answer

Under Florida law, if you were not married to the mother, until a court addresses parental responsibility, you basically have no rights to the children. However, you still have the legal obligation to support them. You need to promptly pursue your paternal rights. Once the court case is filed, there is not supposed to be any preference of the mother over the father. Contact my office to schedule a no obligation office consultation. Answer

If you were not married when the children were born, she technically is considered to have superior rights to the children right now. You will need to establish your paternity of the children through the courts.

You should speak with a family law attorney in your area to discuss your options as soon as possible.
