Question

I have split with my boyfriend whom I have 2 children with. He has not tried to financially supoort the children since we have split. He has moved in with another woman and is unemployed but Is now drug trafficking. What are my rights as a parent as far as visitation goes. I do not want to allow my children to his new place because I dont want them around those kinds of activities. But I am not opposed to working out a plan to where he can meet me at a neutral location and spend some time with the children. What can I do? I dont want to keep them from their father but I dont want to put them in a situation where they could be in danger.

Answer

Talk to a local Family Law Attorney. There is very little you an do to block visitation. If he is arrested you may be able to prevent visitation but some Judges will allow visitation to continue.

Answer

If you weren't married when the children were born, then you are considered to have sole custody of the children. If he wants to assert his rights to the children, he will need to establish his paternity of the children through the courts.
