My debtor claims that he wants to pay his debt to me and he asks me to go to a notary public and paralegal office he has found (which is 23 miles way from me) and he is asking me to sign some papers there and give his checks back to him. I already offered him to meet at a public cafe and told him to bring a witness and I will sign and give him a paper telling him that I received my money in full amount and give him his checks but he did not accept. He and his paralegal person insist that I should go to them. I also told them "let's do this in the lawyer's Office I will find," they said "no", "not necessary, why do I need a lawyer because he wants to pay in good faith."

Please advise, what I should do and what steps I should take. Should I go there in trust (he is a very untrustworthy person) or should I invite him to the office of a lawyer I will find and who will represent me? Your help and advice about this matter will be deeply appreciated. Thank you.

It may be a good idea to have an attorney help you with this negotiation. A debtor who is acting in good faith should not have a problem with you having representation in this matter if you feel you need it. The fact that they are trying to make you jump through hoops to get your money is unacceptable. An attorney can help you decide if legal action may be warranted against this debtor to possibly provide more leverage.

Unfortunately, unless your mother is legally incompetent due to dementia or like conditions (or otherwise lacks what is known as "testamentary capacity"), there may not be much that you can do about what gifts she makes in her will. Obviously, you should talk to her about this to see if there may be alternatives, but short of convincing her, she has the same freedom to do whatever she wishes with her private property. If a will is filed in probate court and your lawyer files a timely objection to it, there can be a trial on issues such as testamentary capacity and undue influence, either of which can set aside a will if the jury finds them to be present. I do not know when you last paid, but if it was more than 4 years ago, any possible statute of limitations has expired if you took this out in PA.

Even if it has not, they cannot sue. Their threats of "taking you to court" are a joke. If they want to sue you civilly, they will need a PA attorney. However, this is like a gambling casino trying to sue where a gambler does not pay his debts. Sure, they could sue in theory, but gambling is illegal so they don't. Kind of the same thing with payday lenders. Only lenders who are registered with the state are permitted and I am sure this place is not registered.

I don't see any criminality here, so I would not be afraid of any threats about alleged fraudulent checks. .

Many people are confused about the kind of SS benefit they receive. SSDI & SSI are different.

If your brother is getting SSDI (Social Security Disability Insurance), he can have other assets and money. So he can take his share of the estate.

If, however, he gets SSI (Supplemental Security Income), he is NOT allowed to have other 'resources' (cash and assets, with a few exceptions) So whether he gets 'his share' from the estate or from you, it is still counted as a resource. And his SSI will be diminished or stopped.

If you give him money and he does not tell the SSA and SSA finds out, it will declare an overpayment and demand a refund of the SSI money. It may investigate him for fraud because he has a legal obligation to tell the SSA about any and all resources. If you pay his bills instead of giving him money directly - it is still a countable resource.

You need to talk to an estate planning attorney ASAP to learn how his 'share' of the estate can be protected and to what extent.

1. What will happen to my COS application when I go outside of USA to India?

2. Can I appear for a H-4 interview in India and get H-4 visa stamped there, while the COS application is still pending? (My husband is not traveling with me to India, but he has I-797A till 2017, so I will carry a copy of his I797)

3. In case I get a RFE on my COS application while I am in USA, but I still go to India, what will happen to my COS application and in this case can I apply for a H-4 Visa and stamping in India ?

It would even be easier to just obtain your H-4 at the U.S. Consulate in India than wait for your I-539 adjudication (which does not give you a visa anyway).

You can withdraw the I-539 when you return to the U.S.

Make sure you bring your spouse's original H-1B approval notice & your marriage certificate with you!

Every landlord should really have an attorney to assist him or her when issues arise. If you are looking to get your tenants out, you will need to evict them. The process can be complicated, but will need to start with a notice to quit terminating the tenancy followed by an eviction complaint. I don't recommend doing this without a lawyer because it is so easy to make a mistake.

There are two routes to take. My first question regards your father. Your sister's father will have to be provided notice of either proceeding, even though your mother is in agreement. You can go through probate court to obtain a guardianship of her person and property. Or you can become a conservator of your sister, through family court. Which is the easier, less expensive option is affected by what prior proceedings have taken place. It is possible that it can be streamlined, but without more information, it is hard to say. Take whatever court orders currently exist, and sit down with an attorney in your county to discuss the best option. Good luck.

Maybe none, but maybe some. Grandparents rights are complicated, and ordinarily governed, in a general sense under chapter 153 of the Texas Family Code. Standing is determined by the child's current circumstances and each parent's conservatorship rights at the time. It is also limit whether you can file an original petition, or only intervene in an existing lawsuit. As you can see, it is a complicated case, and requires an experienced attorney to examine your situation as well as all off the orders and pleadings already on file. Consult with an attorney in your area.

Since she is your ex wife, that means you have divorce order or agreement of some kind that most likely dictates who has possession of the property, who is to be on the title to the property, and who is responsible for things like the mortgages, taxes, etc.

You will first need to see if you have the right pursuant to your divorce order or agreement to remove your ex wife without any money changing hands or, even better, if she is required to transfer title to you. Assuming you are acting in compliance with any existing order or agreement, the mechanics are rather simple, and require only that she and you execute a quitclaim deed in your favor and record it properly.

Although it is not entirely your problem, you also want to make sure that she is no longer liable on the loan to the property.

Depending on the length of marriage, your need, and your husband's ability to pay, you would be awarded spousal support/alimony to pay for your living expenses. If you are going to have physical custody of the children, your husband would be ordered to pay Child Support pursuant to Massachusetts Child Support Guidelines.

As for the two cars, the Court may order him to give up one of the cars for you if you need the car. Your husband may also be ordered to keep up the insurance on the car.

You said that he owns the house. So, I am going to assume that he purchased this property before the marriage. However, if he purchased the property during the marriage with his income from work and because he is the only one working the loan and title were put in his name, you would still have ownership in the property because the property would be considered marital property.

Based upon the facts you described, there seems to be no basis for tracfer to a non heir, without a sale. If the matter is not addressed through the probate Court, at least a quiet title action may be needed, for such a person to have any claim of ownership. If such a person had not been living in the property, or was paying separate rent to the homeowner, they may have a claim for reimbursement from the estate. Possibly the easiest non-probate procedure would be to guy the property from the presumed heirs at law, wait a year, and bring a quiet title action in the Circuit Court of the county where the home sits. Of course, if there are any recorded leins, those would have to be resolved.

My questions are how do we go about petitioning the courts from out of state, and any idea how long of a process, and how costly that could be? Would we have to actually travel to Illinois to appear in court at any point? And also, the length of time it took for a decision to be reached initially was close to 9+ months, and during that time I have covered all expenses on my mothers behalf (she is disabled and have very little income)... Would it be reasonable to ask for some reimbursement for these costs, and if not how would I go about doing so?

Even if you did succeed in getting an injunction, you would have to post a bond for the damages the lender would suffer from being prevented from foreclosing until the case was over. If you paid your attorney to do that, and you deposited with him the premium for the bond, then you have a legitimate grip. However, it is not too late to seek the injunction as long as the foreclosure sale has not occurred. It sounds to me like he has not been charged with anything, and even if he were charged, you do not have the ability (nor the duty) to prove him "innocent." I do not make light of the difference between your duty (or ability) to prove innocence compared to the State's burden of proving guilty beyond a reasonable doubt. There is a huge difference.

In terms of what rights he has... He has the right to be presumed innocent until he has been proven guilty by a jury of his peers. This is a true standard, and more important to our American way of life than most people realize.

Unfortunately, he does not have the right to force others to believe he is innocent. You cannot stop others from thinking he may be the one who took the phone. His foolish comments gave rise to that. The best thing to do now is to wait until there is a formal allegation, then get a good attorney.

While I know that, as a parent, you wish to make the situation go away, and prove the truth... it is just not possible to put the genie back in the bottle. Allow this to be a learning experience for your son, but do not allow it to get either of you down.

It is not that simple to answer-it is a fact-specific inquiry. No matter what, call an attorney and find out what your rights are. You MUST call immediately (I am working from home today & available, BTW*) because you MUST do certain things to preserve your rights, starting right from the ambulance and ER, if applicable, then the doctors' offices. You also want to watch what you say to the employer and everyone else, including any union representative, if applicable, I am not exaggerating about this, and certainly, do not sign anything. You won't know how you can, speaking colloquially, cutting your own throat. I've seen this over and over in my fields. And the only way you will know what you can say-after all, you still may need medical care and some sort of income-until you get an attorney.

You can tape calls as well-NY is a one-party taping state, as approximately half of all states are. So, you can tape record phone calls and even exams your employer and/or its insurance company and other parties, such as your own insurance company, if applicable send you to. Remember, an IME, Independent Medical Exam, is anything but independent-I could tell you things you just would not believe, and but for the tape, more so than notes taken by a relative who is an attorney and thus is an Officer of the Court, this victim would have lost all his rights. Charging your electric car is much cheaper than buying gasoline, for the same amount of miles driven. With an electric car you remove yourself from the gouging price swings of gasoline markets.

They are more energy efficient. They are the first but necessary step in the reduction of overall carbon emissions. In the US, most electricity is produced from fossil fuels so all electric cars do is shift the emissions from the exhaust pipe to the power plant. However, with an electric car, you would then be able to put solar panels on your roof and charge it that way, which is not possible with a gasoline powered car. Furthermore, with future developments in solar panel technology and manufacturing, electric cars will have solar panels embedded in their paneling which will make it possible to drive up to 50 km or more on a sunny day for free.

Limited range is not an issue with series hybrids, which have a small gas generator in the corner which kicks in when the batteries are low and charges the batteries for the few times you want to go more than the battery range (typically 150 km or so). In this respect, they have similar range as a conventional gasoline powered car.

Electric cars also have better performance since you can still get maximum torque at zero RPM. They produce no smog chemicals and are quieter (this may be a safety issue though).

When mass produced, they will end up being cheaper when you factor in all the gas you'd save over 10 years.

With NiMH batteries, they last well over 10 years. The NiMH and lithium batteries they use are non toxic, and due to their value, would inevitably end up being recycled anyways (why would you throw money away into the ditch?)

Unfortunately, their introduction is being hindered by a patent on the NiMH battery obtained by ECD, which was then bought up by Chevron. It doesn't expire until 2014. Instead, manufacturers have had to use lithium batteries, which currently aren't as good and are more expensive.

I would like to know if I have a case here to go to court over. We bought a truck on Memorial Day 2014. The truck was advertised by a big dealership but when we went to look at it, at first the sales man couldn't find it. It turned up still in the back lot as if it wasn't ready for sale yet (my assumption). We test drove it, liked it and bought it. Within the first week, it didn't shift right and we took it back to be fixed, which the dealer did. Living in Southern California, it didn't get cold enough for the heater until January of this year. The heater didn't work at all. We took it to our mechanic and were told that the heating coil had been cut and bypassed. The dealership of course refuses to fix it as so much time has passed and they claim this would have been found during their inspection of the truck. In my opinion they advertised the truck prematurely and didn't do a thorough inspection. It was also not detailed yet, which that part we didn't care about. Both our mechanic and the dealership gave us estimates and this is a costly repair at over $800. We contacted the Baureau of Motor Vehicles but other than trying to be a middleman, we had no success. The answer can be complex. In some cases, the car dealer might be required to provide a minimum 30-day and/or 1000 mile warranty. In some case, there may be no warranty at all. Itsi difficult to common without seeing the sales contract.

Honestly, your best bet is to file a small claims action if you want to recover the cost of the repairs.

Generally speaking,

First the partners should determine what would be the best state to form the company in. It could be one of the six states or could be a seventh state. There are various factors that should be considered such as the law of the state, its location in relations to the partners, tax issues etc.

Second, it is possible that the company would then need to register as a "foreign company" in each of the states where the partners live if they will be conducting business of the company from that state.

It's easy to make the wrong decisions and ending it costing a lot. Since you are six, consider for all six to chip in and retain an attorney who would act as the company's attorney and could advise on the best interests of the company in such a scenario.

Strictly speaking, you don't need a trust if your estate is worth more than $150,000, but a trust would allow your estate to avoid the hassle, most of the expense, and most of the time involved in a probate.

Yes, you must file Form I-539, Application to Change/Extend Nonimmigrant Status. You can find the form and instructions on the USCIS website: http://www.uscis.gov/i-539.

USCIS is currently taking about 6 months to process an application for change of nonimmigrant visa status. While the application remains pending, you can remain lawfully in the U.S. Keep in mind that, in order to obtain B-2 status, you must demonstrate that your intention is to remain in the U.S. temporarily and that you intend to depart the U.S. at the expiration of your temporary stay. You should probably limit your request to 6 months or less. If your application is denied, you will immediately begin to accrue unlawful process as of the date of the denial notice and must make immediate plans to depart the U.S. In no event should you remain in the U.S. more than 180 days from the date of the denial. Also, you should not depart the U.S. while the change of status application is pending since this would abandon your request.

My concern here is an old friend with knowledge said I should not sign that quit-claim deed giving her authority to sell home as the Bank might not like that with my name on loan. Yes and no. A person making a power of attorney does not have to record it immediately if it will take effect at some future date (called a springing power). When the power of attorney is going to be used, it must then be recorded at the register of deeds. They will charge extra unless it is in the proper format.

If the power of attorney is properly drafted, it may provide that it does not have to be filed with the clerk of court. If it does not have this language in it, then you also have to file it with the clerk of court within 30 days after it is recorded at the register of deeds and you may have to file accountings with the court.

All of this applies to a financial power of attorney only. A health care power of attorney does not need to be recorded. It can be filed with the Secretary of State's office at www.nclifelinks.org, but this is not necessary.
