How do I know if I need a will?

Question

How do I know if I need a will?

Answer

If you do not want your estate to pass to your intestate heirs, you need a will.

If your estate is worth more than $150,000, you need a living trust.

Answer

If you are married, and you have any separate property at all, then you need a will, because your separate property (such as an inheritance) would go only 1/3 or 1/2 to your spouse on your death, and most married people want to leave everything to their spouses.

Also, if you want to leave your assets to persons other than those provided for by California's intestate succession laws (google it for details), then you need a will.

Strictly speaking, you don't need a trust if your estate is worth more than $150,000, but a trust would allow your estate to avoid the hassle, most of the expense, and most of the time involved in a probate.

Question

Hi, I'm working in U.S. with L1 visa. I want to stay in US after I finish working - i.e switch to b2.

I have a valid b2 visa for couple of years. How do I change my status?

Do I need to need to fill in I-539 and pay a fee of 165$ and wait 2 months? I don't have so much time.

Answer

Yes, you must file Form I-539, Application to Change/Extend Nonimmigrant Status. You can find the form and instructions on the USCIS website: http://www.uscis.gov/i-539.

USCIS is currently taking about 6 months to process an application for change of nonimmigrant visa status. While the application remains pending, you can remain lawfully in the U.S. Keep in mind that, in order to obtain B-2 status, you must demonstrate that your intention is to remain in the U.S. temporarily and that you intend to depart the U.S. at the expiration of your temporary stay. You should probably limit your request to 6 months or less. If your application is denied, you will immediately begin to accrue unlawful process as of the date of the denial notice and must make immediate plans to depart the U.S. In no event should you remain in the U.S. more than 180 days from the date of the denial. Also, you should not depart the U.S. while the change of status application is pending since this would abandon your request.

Question

Getting a divorce. She in N.Y. at house in question, me in Missouri. She wants me to sign quit-claim deed so she can sell house and pay back Bank of America on mortgage. I want NOTHING, just the divorce. My concern here is an old friend with knowledge said I should not sign that quit-claim deed giving her authority to sell home as the Bank might not like that with my name on loan. I am 100% disabled Vietnam Veteran, do not have money to hire lawyer, currently paying off all credit cards SHE ran me up on in 5 yrs. of marriage. I would appreciate your help in what I should do, as I do not want to get into trouble with the N.Y. Sup. Ct. Judge dealing with the divorce. Would it be OK for me to sign and notarize the quit-claim deed ???

Answer

Really, you should get an attorney. Notwithstanding, the bank does not care if you sign a deed so long as you make full payment on the loan.

Mike.

do you have to have a power of attorney recorded to be legal?

Question

do you have to have a power of attorney recorded to be legal?

Answer

Yes and no. A person making a power of attorney does not have to record it immediately if it will take effect at some future date (called a springing power). When the power of attorney is going to be used, it must then be recorded at the register of deeds. They will charge extra unless it is in the proper format.

If the power of attorney is properly drafted, it may provide that it does not have to be filed with the clerk of court. If it does not have this language in it, then you also have to file it with the clerk of court within 30 days after it is recorded at the register of deeds and you may have to file accountings with the court.

All of this applies to a financial power of attorney only. A health care power of attorney does not need to be recorded. It can be filed with the Secretary of State's office at www.nclifelinks.org, but this is not necessary.

If your power of attorney was just the simple statutory one or was not properly drafted, I can do one for a reasonable fee provided that you or the person making the power of attorney is mentally competent. Please contact me at [email protected]/* */ if interested.
