A girlfriend of mine wore a wire, and did a controlled buy on me. She is a ci. If she doesnt show up to my trial, is it grounds for dismissal.if not, what is? I discredit her completely



Answer

The cops set up these controlled buys so that they have direct evidence of a person either buying or selling. They try to make it so they don't need the CI in order to prove the case. The credibility of the CI is less of an issue when the prosecution has other evidence to use. With that said, you may have some very good defenses and arguments to make. I agree with Mr. Edmunds. There may be ways to suppress the recording as evidence. If the CI is needed to testify by either party there may be chance that the CI would be required to testify or be held in contempt of court (i.e. put in jail until she decides to testify.)
