My brother is facing life in prison for a Capitol sex offense with a child under 12 (his son) in 1997. During his trial last week, which he is appealing, two witnesses lied on the stand. His son and the grandmother who raised him. Also, the recorded video tape from the Sheriff's questioning has been edited, especially the part which he claims would help his case.
Can he go after the witness who lied? The Sheriff's dept for tampering with the video? If he could prove this, would it be declared a mistrial, even though he confessed?
Answer
You need to talk an attorney that is either handling the appeal, or get yourself an appellate attorney ASAP. Lots of things could happen, but an experienced appellate attorney would be able to tell you the likelihood of any of those happening.
