I have an order that had been modified for joint custody and there is a geographic restriction on the order that my son stays at the school in houston texas.. His father is moving to florida for two years cause his wife joined the military and he wants to take him.. Will the court side with him on this?
Answer
If there is a residency restriction to Houston and you visit the child frequently and am active in the child's life then modify immediately to gain primary custody.
Dad can live wherever he wants but the child is restricted to this area.
If you don't act quickly you lose it!
Look on this website and on www.avvo.com for an attorney to help you with this modification.
Do it today!

Good luck!
Answer
So long as the residency restriction is in a court order then he cannot move the child out of the geographic restricted area. Do not acquiesce to his desire to move your child out of the state if you oppose losing your connection to your child. You need to hire an attorney to modify the order to seek primary custody and keep your child.
Whether he will prevail in a modification could depend upon a number of factors. The best protection for your relationship with your child will be to start working now with a family law attorney who can guide you through the process and advocate for your rights.
