However, if your father is alive, it's best that he amend his will or trust to leave more of the property to your sister, as that way there's no sibling to sibling transfer after your father's death that would subject this 1/5 portion of the property to a reassessment under Prop 13. If that's not possible, it may be possible for you to disclaim your interest in the home, but you would have to review the matter with a trusts and estates attorney first, and you cannot disclaim an asset more than 9 months after the date of death.

As you probably already know, the court makes custody and visitation orders based on the best interests of the child. Normally the court finds that it is in the child's best interests to split the holidays between the parents. Either by alternating the years or by splitting holiday in half between the parents. Occasionally the court will vary from this for good reason - for example when holiday is in middle of the week and parents live a long way from each other.

Pick ups and drop offs vary a lot. Where there is a lot of friction between the parents, a parenting plan that allows drop off and pick up at school or day care often works. Exchanges at McDonalds, a police station or curb side where the parents are ordered to remain in their vehicle or house while the child goes from one to the other often works. You need to state to the court why exchanges between parents dont work at each other's house and come up with viable alternatives that the court can order.

WoW! Sounds like you have a fairly angry ex on your hands. I suggest an approach that focuses on your child and the harm she may be causing to your son when she sends out such a message. If she refuses to speak with you or negotiate with you on the point either see a lawyer for an emergency motion (depending on how much time you have) or a regular motion if you have a few weeks.

What you want from the judge is an order modifying custody where you have 1st right of refusal (her too) when she is going to leave the child with a care taker. That means if she is going to leave your child with another person and you are available to babysit - she has to call you first to see if you can do it. On your side, and tell her this in your negotiations, if she leaves your son with you while she is out of town you are NOT going to try and file a motion to tell the judge you have all this extra time. This is called "co-operative parenting." You both help each other out and your son learns that his parents are mature and loving and they can work out issues on their own without getting the judge involved.

If that does not work . . . . . file a motion and go to court.

Chances are the best advice I can give you is to get a lawyer.

Just as you would not do your own surgery, you are risking a lot by representing yourself in court.

Courts are loathe to keep children away from their parents, and deeply suspicious of parents who want the court to do that.

Be prepared to show more than a crimial record. There are plenty of people who are criminals but their crimes have nothing to do with their parenting skills.

If his crimes involved the children, e.g. he assaulted them, that's different. If there are drugs involved, you may well have a point that the Court will use as a basis for restrictions.

I was injured at work in November 2013 with a progressive trauma of a acetabular labral tear in my left hip as well as osteoarthritis . The company I worked for saw me in pain for 5 months,(from November 2013 to March 5th 2014) limping around and did nothing but fight me when I filed for workman's comp after going to the ER and not being able to return to work. On top of that I was terminated 4 weeks later even though I have been disabled. I was working as a bartender in the San Francisco bay area and have been told I will never be able to work in my career as a bartender ever again due to my injury, a career I have been investing in for 10 years.

I am in need of a hip replacement and I am 32 years old. I have the help of a workmans comp lawyer but the attorney is telling me that I cannot sue for loss of wages or even obtain the full amount of the surgery unless I want try to battle this out for 2 years (its been 1 year so far) . The defendants IC denied the case after I asked for another her QME panel.

I cannot walk due to my condition getting worse since I have gone without treatment since September 2014 and I am in a sever amount of pain. I am being forced to settle for $99,000 which is not nearly enough to even pay for the surgery I need and live during recovery . He has to take commercially reasonable steps to attempt to relet the unit. In the event he relet the property for less, you are liable for the difference.

As to liability for the landlord's attorneys fees, if that's what the lease provides, you may be liable. If you entered the lease after December 2013, and it contains that clause, the landlord also may be liable to you should you prevail on your claims. It is my suggestion that you retain counsel to negotiate with the landlord.

There is no legal excuse, and many potential problems, with withholding the will. In fact it is a crime for someone in possession of a will not to tuen the will in for probate. When you probate the will, you have a fiduciary responsibility to the heirs to follow the will, which likely will include collecting 7 years of back fair market rental from your sister. Had you done the right thing 7 years ago and seen a lawyer, she could likely have gotten the house as years support bypassing the will; that right expired 5 years ago.

This is all too confusing for me. Regardless of whose name is on the deed, if the husband died, title vested in the beneficiaries, which are the grandchildren. They could come back after you for causing loss to the estate (and them) because you failed to act properly here.

I would not probate this will now because its too late. The home can be deeded to the grandchildren. A lease needs drawn up then if the mother is to rent the home. The grandchildren should see a real estate attorney about this if that is what they choose to do.

Estates do not have trustees so I do not see how this can be. Trusts have trustees and estates have executors. And you are the "trustee" of nothing until you have been officially appointed as such by the probate court unless the will would say otherwise and authorize you to act.

I agree with Attorney Ashman in that there was no excuse for your actions. If you did not know what to do then you should have consulted a probate lawyer 7 years ago at the time of the husband's death.

While I do not see a need for probate at this late date, I have not seen the will or any other documents and I don't know what the sister's bankruptcy has to do with this or why she had to file a chapter 13 as opposed to a chapter 7. I suggest that you take everything to a probate attorney who practices in the county/state where the sister's husband lived prior to his death and see if anything can or should be done as far as probate. If not, then the grandchildren need to take the deed and will to a real estate attorney, have the property deeded into their names if they are over 18 and have the attorney draw up a lease between them and your sister for the home.

You should consult an attorney in person about this. There are more facts that would need to be known before a positive answer can be given for your problem, but I will give you what information I can.

If a road is a private road owned by you, you can legally block it off. In fact, there are many instances where you SHOULD do that, as allowing the public to use it without objection over the years could cause the road to become public, or give private users a right to use it over your objections.

There may be more going on. When a developer or person who sudivides a parcel of land subdivides a lot, he cannot landlock any of the subdivided lots. In other words, each lot MUST have access to a public road. If these other landlowners have no other access to any public roads, you MAY have to grant them the right to use the road as well.

Even in that instance, you may still be able to gate the road over the other users' objections and/or gate it and not allow anyone to use it but you. The issue will be very fact intensive and you really should consult a local attorney about it ASAP.

I took it back since it was still making the noise. Dropped my car off the next day around 8am. Around 2:45 one of the mechanics came by my house to say the car had been hit in their parking lot. This was the case and the insurance company sent a check for the damage to the body to be repaired.

The PROBLEM is that the next day, the shop called to tell me that when the man hit my car, it must have knocked a pin lose in the motor. When they tried to start the car the motor blew up.

The shop says it is the man's insurance company that needs to pay. I don't think it is possible for the hit to have knocked something lose in the motor to cause it to blow up. There would be cars all over that have blown motors.

I can only make an educated guess from the context of your posting, but it appears that for whatever reason the will did not have to be admitted to probate in the courts, usually when the estate is under $150,000 in value. If this is the case, then there's no executor or administrator regardless of what the will says (as the executor or administrator is appointed by the court) and there's no duty of accounting.

On the other hand, if the accounts were in the trust and you were successor trustee, then you do owe a duty of accounting to the trust beneficiaries and if the daughter goes so far as to take you to court to compel an accounting you'll likely be ordered to do so.

You are correct that when you meet the eligibility requirements for a divorce, that you are entitled to it and there is nothing anyone can legally do to prevent it. However, you getting custody, child support and alimony is not going to be easy or cheap. As to suing an convicted felon for alienation of affection - why bother? Even if you win, you will likely end up with a judgment that has about the same worth as toilet paper.
