I know your ex spouse has to b behind 30 days on child support before any action can take place. I could go thru the Texas state attorney General but I do not want to go that route. I could go thru my attorney, but again I do not have the money for lawyer fees. What are the steps to put him in jail? Would he have to pay full amount of back pay of what is owed before he can get out of jail? What is the procedure?
Answer
The risk of pursuing a child support arrearage without thoroughly understanding the process and how to properly pursue your remedies is that you could pursue enforcement and end up losing your chances to pursue the unpaid child support forever. If you prevail on a child support enforcement then you have a very good chance to recover your attorney's fees in addition to the child support so you should give your attorney a call and see what he or she can do to work with you.
