A dective says he has evidence of theft on an accused individual. Over the phone, he tells the accused to come in for an interview before he (detective) finishes the paperwork to send to the D.A.
If the detective had evidence wouldn't he just arrest the accused without question?
Answer
He doesn't have to and can wait for a warrant or summons. Most importantly, don't talk to the police on the phone or in person without an attorney, even if you are innocent.
