In the contract it states the city is required to put up a fence on the property line once the open space is considered to have active use. How can you define "active use" on open space? The mayor is refusing to put up a fence now and says he does not consider the cutting of hay on the property or gardening "active use."

Sounds like active use to me. The problem is you'd have to sue the town to force them to put up the fence. You'd probably win (I'd have to see the contract to be more certain), but unless the contract provides for attorney fees to the winning party, you'd have to pay your own lawyer (around $2500 sounds in the ball park). Also check to see if the contract calls for arbitration rather than court.

3. The above two examples can be enhanced by a government investingin all levels of education. This then provides educated workers andscientists for the overall benefit of the nation. Privateeducational facilities can do this of course,however, governmentfunding of public universities as an example is proven to createthe new technologies cited above. There is a wealth of evidence toprove this. A Georgia Tech in Atlanta Ga. for example is subsidizedand the result has been hundreds & hundreds of new patents toadvance the development of new products.

We never established any kind of legal child support or visitations due to the fact that we were both students and he did not want anything to do with this issue at the time and I was to scared and naive. If this were me, I would write a letter to each of the 3 major credit bureaus (Experian, Equifax and Trans Union - you can get their addresses at their web respective websites). I would tell the credit bureaus what you are disputing and why. If you have proof of payment, then include a copy if you have it. Ask them to investigate and note that the item is disputed if they verify if and to take it off if it is not verified.
Depending on if the information is verified or not, I would send a second letter to whoever put the information on your report. Indicate that you are disputing the information and ask them to investigate. Include proof of payment - get it from your insurer - could be an explanation of benefits (EOB) form or anything showing payment.
Include as much details as possible - date of treatment, where and mention that your husband is active duty military and that you are not liable for any co-pay and that this is a poor way for them to treat the families of active duty personnel. Ask them to remove the item. If they fail to remove the disputed ite, see an attorney specializing in violations of the Fair Credit Reporting Act. You can recover attorney's fees under the act and damages of up to $1000 for violations.
Send the letter to the debt collector and credit bureaus via certified mail return receipt requested and keep copies to help establish your case.

Why would you be locked up? It is not a crime to not pay a debt in most cases.
You cannot keep a lawyer from suing you on behalf of a creditor other than to enter into some kind of setlement agreement and start to repay the debt. And even in those cases, it is likely that the creditor would want you to sign what is called a confession of judgment.
If you don't have funds, the lawyer can sue you. If you have a lot of debts and, depending on your circumstances, you might want to file bankruptcy. If you don't want to file and, again, depending on your circumstances, it may make more sense to start saving your funds for resolution of the debt when you are able.
I give free email consults. If you want to provide more details as to who is suing and what for, and your circumstances, I will be able to give you better advice as to what you need to do. With proper planning, you may be able to stretch things out until you have accrued sufficient funds to resolve this debt.

A bill of particulars is essentially a document that gets filed with the court and served on the da where the defendant asks for a more detailed explanation of the information that the DA filed. This is not something that needs filed in every case, but only an attorney familiar with your case could say for sure whether this is something that is needed or not. I would highly suggest that you retain an attorney as you could be missing out on important defenses and could miss important deadlines. For example, pre-trial motions must be filed within 30 days of formal arraignment. If they aren't filed within that time frame, you will waive your right to ever raise those issues, which could be important issues such as suppression.

The new law will have no effect unless it's retroactive. Most are not. Otherwise what matters are the laws in effect at the time of the offense.

Under Probate Code section 6402, if there is no issue of the decedent, and no living parents, then everything goes to the issue of the dead parents. If all of the aunts and uncles have already died, then the six cousins take six equal shares because they are all of equal degree of kinship to your late cousin.
However, your post implies that your cousin's father has living children. So instead each living aunt or uncle (blood relation only) gets one full share, and the children of each dead aunt or uncle divides their parent's share equally among them. Cousins who are the children of a living aunt or uncle get noting.

You need to read RCW 59.18.260, ,270 and .280; those are the statutes that control damage deposit issues.
You CANNOT be charged for normal wear and tear. If the walls are filthy you might want to scrub them - or possibly paint them. If the carpet is matted and stained you will want to have it cleaned professionally.
What matters is the contract that you signed with your landlord, and the walk through agreement (that you must have a copy of) and whether the apartment is in reasonable condition given the length of time you have been there.
You are not responsible for "turning" the apartment for your landlord (getting it ready for new tenants). The light bulbs are the landlords, not yours, for example. If they burn out, the landlord should replace them.
Best practice is to pay a service to come in and do a professional cleaning and give you an invoice.
It'll cost you about 150-200 and it is well worth it. Get an invoice from the service.

Call previous owner and verify it had 17,000. If so, write dealer and tell him you want to rescind the contract because he had it altered. Send copy of letter to Attorney General Ken Paxton filing complaint for fraud and under the DTPA- Deceptive Trade Practice Act, complaining that the dealer sold you a MC that was represented to have qualities that it did not have.

Its not illegal to charge fees.
Many physicians' have this policy. There does not have to be any paperwork. Usually this policy is stated on a notice in the office or on the doctor's website.
Healthcare providers have this policy because too many people are cancelling without notice and this causes problems with scheduling.
Why did you miss the appointment and fell to the doctor? If it was an emergency, then I would try contacting the doctor, explain what happened and ask if he will waive the fee.
If you were just discourteous then that is another matter. If you knew you could not make the appointment and had time to cancel then you should have let them know as it would have been the proper thing to do.

Move on and apply elsewhere. With modern technology, expungements are becoming far less useful than before. Broad database searches mean employers will sometimes match your name to old news accounts, arrest and jail record sites from outside the state and federal system, etc. Additoionally, expungements do not erase a record - it remains, but is accessible for certain categories of searches (for example the police and courts can see the expunged case, and certain background checks will pull it) You cannot unring a bell. (One detail: do check and make sure that your expungent order was properly carried out in official records.)

Impossible to answer this question without seeing the Order. File it early and avoid the problem. If it needs to be amended than seek Court approval to amend it later. Don't play around with the deadline. The court likely will allow the pleading anyway even if filed on 12/29 and that is late, but why wait? Get it done.

I have been separated and divorced from my former spouse for over two years. In MD, you have to be separated for a year before a final no contest divorce is granted. In our signed, notarized Separation Agreement, she was to file a Quit Claim Deed for our home. She didn't follow thru. During our final divorce hearing, in April 2014, the Magistrate instructed her to adhere to the terms of the Separation Agreement and file the Quit Claim Deed, which as of today, she still has not done. I guess my question is two parts, what legal recourse do I have to force her to file, and since she is still on the title and deed of the home, can I sue her for half of the real estate taxes and home owners association fees for the time she has failed to follow the agreements? Obviously I could just fill out the paperwork and have her sign it in front of a notary and file it myself, but its the principle, she did not follow thru with her agreement. Any advice would be greatly appreciated, thank you.

First of all, compliance with these kinds of separation agreement provisions typically requires the spouse who agrees to transfer their interest in marital realty to sign a deed and give it to the transferee spouse. You would then record it at the Recorder of Deeds office. If you had counsel at your divorce, he/she should have undertaken the responsibility of preparing an appropriate deed and arranging for your ex to sign it. What you should do now is file a show cause order asking the court to hold her in contempt of court for violating the court order to convey her interest in the property to you. In your petition you would ask the court to order her to sign the deed by a date certain subject to incarceration for failing to comply, and to require her to pay your legal fees and any other expenses related to her violation of the court order. However, if she had contemporaneously deeded the property over to you, you would have then been solely responsible for ongoing expenses (taxes, hoa fees, etc), so this wouldn't be an element of your relief now. Perhaps if you show her you intend to take her back to court, she'll agree to sign the deed and you will be where you should have been 2 years ago.

Two 1/2 weeks ago, I made an early payment for more than the months due amount and right after when I went to go sign in all my links/website address everything was not working. So I e-mailed Hostverse for the entire 2 1/2 weeks to not one response. I was losing money at this point. So a CPA marketing colleague of mine also had hostverse--so he signed into his account and opened a support ticket on my behalf so I could hopefully get an answer as to what was going on. Yes, they responded to him right away only they told him that because he opened the ticket on my accounts behalf they shut his business down and deleted his entire account. Then following this event when I sent them an e-mail once again asking for an explanation they finally sent an email accusing me of being fraudulent in my dealings with them and to communicate with Tina Williams for an answer as to what was going on. At this point I was shocked. Never have I been fraudulent nor ever would be. Turns out that about 3 months ago when my bank account debit card was stolen so I froze my account while they investigated. So, to pay for my hostverse account I gave my friend Tina Williams the cash as she paid with her debit card for me. What happened after that I don't know. In another e-mail shortly after the first, Hostverse said that this would be the last contact to me of any sort and proceed to state that following a couple charge backs they determined all on their own that I was involved with something fraudulent with them and they wiped out my entire website and everything else I had on my server. They did so without even sending me 1 e-mail even letting me know the situation. I feel that Hostverse not only assumed but acted as judge and jury accusing me of fraud when never in my life have I nor want to be a part of any fraud. My friend Tina and I after piecing things together since Hostverse won't help, I gave Tina Williams the cash to put my Hostverse payments on her debit card while my bank figured out who stole my debit card for my account-freezing my money temporarily. So I gave TIna the cash to pay with her debit card and 3 months later she forgot I gave her the cash and she forgot what Hostverse even was for. So she had her assisstant deal with the situation and her assisstant handled it improperly by going to the bank first rather than the vendor Hostverse to get charge backs. None of this I ever knew happened until after they shut me down. Tina forgot it was for me and therefore, never mentioned it to me. Because the bank was contacted first Hostverse blackballed me and my business. And also, one of my marketing colleagues attempted to help my and opened a support ticket on my behalf to help me figure out what happened and Hostverse deleted his entire online business as well no questions asked. This is not right in my opinion. Had Hostverse sent me an email about the charge backs that I was not aware of I would have happily paid them what is rightly owed them. Not one email. I feel Hostverse is taking the law into their own hands and assuming and accusing people of doing illegal things. They can't do that. Do I have any recourse here. They are way out of line. I am a law abiding citizen being treated like a malicious criminal based on assumpions. Thank-you,

Not affording is not a basis for cancellation. You need to look at your contract. If you were sick, did you obtain a certification from a doctor that you are unable to attend class, or is it that oyu no longer wanted to attend. There is nothing in the law that says medical bills take precedence over martial arts bills. Look at http://ilga.gov/legislation/ilcs/ilcs3.asp?ActID=2376&ChapterID=67 and see if their contract complies with that act. If it does not it may be unenforceable.

Your brother's estate / heirs do indeed have legal recourse. You may not know it, but every piece of creative work is automatically copyrighted upon its creation. A copyright holder may also choose to register the work and that would give them additional rights. One can register the work at any time though it's better to register it immediately upon creation.

Perhaps. As noted, copyright protection affixes automatically upon creation. But in order to receive the full bundle of rights this work must be registered with the copyright office. This registration can occur at anytime, but it must be done prior to bringing any action to federal court. If however the registration occurs after the infringement you will lose your right to ask the court to award statutory damages and attorney fees. This means that it is possible there will be no benefit to filing an action unless there are real damages to be had and the use of this material made the infringer a lot of money.

Its not ethical for an attorney to discuss your fiance's legal issues with you. Your fiance, if he is concerned, will get a probate lawyer.
You indicate that the fiance's mother died 15 months ago, but this does not tell anyone anything relevant. Did the mother have a will? If so, who is the personal representative? Was an estate probated? What other assets are in the estate? What debts are there? Why has the personal representative not taken adequate steps to distribute the home or sell it to the fiance? Or put the electric bill in the name of the estate if distribution will be delayed? Why is the estate still open after 15 months? When is the estate administration expected to end? Has the property been appraised? Do the other heirs/beneficiaries consent to the fiance buying the home?
These are all questions that need to be addressed. Your fiance needs to take a copy of the estate file to a probate lawyer to review. If there are insufficient assets in the estate I don't know why the executor cannot sell the property to your fiance for fair market value now as it would have the benefit of getting the property and its expense out of the estate. If there are no debts outstanding, then why can't the executor make distribution now? Then your fiance could buy out the shares of the other heirs.

Not only would I file a custody petition in New York, I would also file a Writ of Habeas Corpus to have the children produced in New York. A valid writ will be enforceable in New Mexico.
