Question

My mom entered a nursing home in November. We have been self paying till now. She had given me 100,000 dallor cd 5 years ago this april. will she qualify for medicaid.

Answer

There is no easy answer to your question, but a transfer of $100,000.00 could very easily have disqualified your mother from medicaid. You really need to speak with a medicaid planning attorney. If you would like, call our office and press extension 1 to speak with Carol Barton.

Answer

Any transfer made more than five years prior to the requested starting date for benefits does not need to be disclosed on the MassHealth application. If your mother's countable assets are below $2,000 as of the requested start date and it's been more than five years since the gift, then she would qualify.

I strongly suggest that you speak with an experienced elder law attorney to review the financial data prior to filing any application.
