husband passed away but owes over 10,000 in back child support i currently have a medical malpractice case against the hospital the treated him will that come out of his settlement cuz im not to sure that the kids are his we also have 1 child together

Huh? You need to seek some legal advice. You say have you have malpractice case already? You have an attorney pursuing one? Speak to that attorney. If paternity and entitlement to child support is an issue, that needs to be litigated in a separate case. You need an attorney to help sort our the claims.
