Exactly 6 days before our move date he told us that he had to sale the home because of a financial bind. He tried to find us another home and in turn we had to go with another property management company, pay 1,000 more for a deposit and purchase a refrigerator and washer/dryer (the other house had those appliances already in the home). Do we have a case to take him to court atleast for the extra money we had to pay out?

To start, the sale of the home doesn't terminate the landlord's obligation (nor the tenant's) under a lease. A foreclosure could, but not a sale. What your landlord would be selling would be a tenant-occupied income property, not a vacant house, but you'd have had a right to remain as the tenant (unless the lease contained a specific termination-upon-sale clause, which is rather unusual in residential leases). Consider, for example, the situation where a large office building such as the Sears Tower or the Empire State Building gets a new owner. Do you imagine the chaos if all the hundreds of tenants got evicted as a result of the sale? It's the same with single-tenant residences, apartment buildings, stores, and everything.

You probably have a case for return of your deposit and some amount of money damages for breach of the lease. I'm somewhat doubtful about whether you would be awarded the outlays for additional deposit and/or the appliances as specific losses you have incurred, because the deposit is refundable and the appliances expenditures aren't so much a loss to you as a transfer of one kind of asset into another, but it's worth a try. Small claims may be a good venue.

A possible drawback is that if the (former) landlord is or was in a financial bind, he may not be able to pay any judgment you get against him.

Hello I am recently divorced and am trying to change back to my maiden name. Unfortunately, I was not in the country when the divorce went through and so wasn't able to stipulate a name change. I am living/working out of the country right now and the county clerk (where I got my divorce decree) says I can't get it done there because I don't live there any more. But another person says I can, so I'm getting conflicting information. It would be easier if I could get it done where I'm currently living (South Korea), but is it possible? The question really pertains to residency. If you are in the military, that's no problem because your legal residence is the county you are from. If you are temporarily in Korea but have no intention of staying there and you still intend that your home is in whatever county it is in Iowa, I think it could be done remotely if you have not given up your residency. Evidence of that would be filing an Iowa income tax return or owning property.

You would however have to sign the petition in front of a notary public before it is filed. Iowa Code chapter 674 gives you all the needed information.

Myers was born into a large West Virginia family in 1937, in the midst of the Great Depression. Two years after his birth, his mother died, leaving his father with eight children to care for and no job. In 1939, his father's previous wife, a mixed-race (white/Native American) woman from whom he had been divorced due to family pressures, came to take her two daughters with her to New York, where she now lived with her second husband, Herbert Dean. The Deans decided to adopt Walter along with his half-sisters, and so he came to grow up in Harlem.
Though poorly educated themselves, the Deans taught Walter to read by the time he was four. His mother had Walter read to her every day from True Romance magazine and eventually from other sources, and his father and grandfather told him stories. Despite his obvious ability, though, young Walter had trouble on the playground because of a speech impediment; he was frequently involved in fights when the other children teased him, so much so that by the time he was in fourth grade, he was threatened with suspension. Fortunately, his fifth grade teacher recognized his writing ability and channeled his energy into creative writing.
Walter's childhood life revolved around the church, which was not just a place of worship but an activity center where he learned basketball and dance. He says, "I am a product of Harlem and of the values, color, toughness, and caring that I found there as a child."
His talents brought Walter a place in an accelerated junior high program and ultimately at Stuyvesant High School, a strong academic environment (the same school that Steve Harmon attends in Monster). Again, one of his teachers encouraged his writing, and he received some writing awards; but his school attendance became spotty as he would spend days reading and writing in the park rather than attending class.
Myers began hanging with the "wrong crowd," and, knowing his family couldn't afford college, dropped out of high school at 15. He soon returned but then left again, and at the age of 17 joined the army to escape. After three years, he returned to civilian life, taking a factory job in New Jersey and then a position with the Post Office. He married a woman he met in the Post Office job and began once again to write - publishing stories and poetry in (mostly) black-oriented magazines.
Myers took college classes but did not finish school; meanwhile, his first marriage was falling apart under the strain. In 1970, he was hired as an acquisitions editor for Bobbs Merrill, a publisher interested in developing more black writers for young people. Already, he had published his first children's book, a picture book published by Parents Magazine Press. Myers had written it for a contest, "more because I wanted to write anything than because I wanted to write a picture book." In 1975, he wrote his first young adult novel, Fast Sam, Cool Clyde, and Stuff. Two years later, he left Bobbs Merrill and undertook to write full time.
Supporting oneself by writing alone requires discipline. Myers' daily routine begins with early rising, usually before 5 a.m., for a daily 5-mile walk. He returns home and showers, then starts into work by about 7: "I try to get ten pages done. Once I do my ten pages, that's it."
The idea for Monster goes back to a series of interviews with prisoners Myers did during one of his attempts at college, in the late '70s:I did 600 pages of interviews with prisoners in New York and New Jersey. And patterns began to emerge. They all knew why they were in jail; they knew what crimes they had committed or had been accused of committing, but they never seemed to be really sure of the path that had got thm there. . . . All these people felt that they were good people. They were always talking about whether they were guilty or innocent, and the discussion were legal arguments. (Rochman)
Later, he witnessed the trial of a 17-year-old charged with armed robbery and attempted murder, right across the street from a high school, and was struck by the short distance between those ordinary students and this young man's situation.
Walter Dean Myers twice received Newbery Honor recognition (for Scorpions, 1989, and Somewhere in the Darkness, 1993) and is a three-time recipient of the Coretta Scott King Award. In 2000, Monster (a Coretta Scott King Honor book) was named the first winner of the Michael L. Printz Award for "literary excellence in young adult literature."

The question of guilt or innocence: Do we think Steve is guilty or innocent? We have been given pretty much all of the evidence that the jury is considering (plus a little more conveyed by his journal writing) - so if we were on the jury, how would we judge?
Myers avoids a simplistic view of his character's role. We know that Steve was in the store the day of the killing, and that he had discussed his role with James King. Steve says he did not signal the others; they say he did. We are never shown directly what happened when Steve emerged from the store. Steve's own father and his defense attorney both seem to have doubts about his innocence. Under the law, if he conspired with others to commit a felony (the robbery), and someone dies in the course of that felony (no matter how the death occurs), all of the conspirators may be guilty of felony murder. So there are hints that he may be guilty.
On the other hand, we have ample testimony that he is basically a good kid - his teacher, his mother, his relationship with his little brother. We don't see him actually agree to take part, just that he was present when the job was planned. If we believe that his job was to signal the others that the coast was clear, we have to accept a relatively far-fetched argument that "no signal" was the signal. And he never received his "taste" of the proceeds. Is this enough doubt to find him not guilty? If he is "not guilty," is he also necessarily "innocent"?
Additionally, there is the question of proportionate punishment. Even though some may conclude that he is guilty under the law, life in prison seems a pretty stiff penalty for a first offense, when he himself wasn't even present at the time the killing occurred.
Myers says that when he talks to young people about Monster, their responses are interesting: "When I ask them, 'So what's the story with Steve?' they come up with various answers about his legal guilt, but eventually some kid does say that whether Steve's legally guilty or innocent doesn't make any difference; he is guilty. And to me, that's the essence of the book. Apart from legal machinations, is he accepting his moral responsibility for what he's done or is he just trying to avoid it?" (Rochman)
The issue of the novel's form: Myers uses the two types of narration - Steve's journals and his film script - as a means of showing how people create distance between their sense of themselves and their actions. When Steve writes in the journal, we get an insight into how he feels; when he writes about his crime, he uses the film script to distance himself from this act
That, at any rate, is what the author tries to do. Does it work? We are accustomed to watching movies, and a film script - which provides cues as to closeup, long shot, and other details of scene that a play script cannot - is a bit closer to traditional narration as well in its ability to set the scene and mood. But it is still often more difficult to read a dramatic text, which is normally intended to be performed, than a typical narration. Here, Myers is writing what looks like a dramatic text, but what is intended to be read, not actually filmed. Does this create a degree of difficulty in our understanding the book?
Between journal entries and the film script, we get a number of shifts back and forth across time. This is not a simple narrative in chronological sequence. What effect does that have on our reading experience?
The matter of Steve Harmon's identity: We get various testimonials as to who other people see Steve as being - the prosecutor describes him as a monster, his teacher sees him as a gifted student and a gentle soul, etc. But, as always with the adolescent novel, the great task of this character is to determine for himself who he is. What kind of evidence is there?
He seems to accept the prosecutor's characterization when he names his film, "Monster," and again when he writes the word over and over on his scratch pad, until his lawyer makes him stop and tells him, "You have to believe in yourself if we're going to convince a jury that you're innocent" (24). Interestingly, she doesn't seem to believe him, either, since she never states that he is innocent during her summation, only that he should be found "not guilty," and she shrinks back from his attempt to hug her after his acquittal.
His brother Jerry admires him, and to Jerry, Steve says he would like to be Superman - but his motive is that as Superman, "I'd kick butt" (58). This scene comes not long after one in which he throws a rock and hits a tough guy, then runs away (42-43). Which is Steve's true "secret identity" - the guy who runs away, or the butt-kicking Superman?
In his journal, Steve writes: "I want to look like a good person. I want to feel like I'm a good person because I believe I am. But being in here with these guys makes it hard to think about yourself as being different. We look about the same, and even though I'm younger than they are, it's hard not to notice that we are all pretty young." (62) Steve has to deal with some strong prejudicial stereotypes that may affect jurors (and readers) - the fact that so many young black men are or have been in prison, for instance, may predispose some observers to conclude that they are all "monsters"; as Ms. O'Brien says, "You're young, you're black, and you're on trial. What else do they need to know?" (79) Steve is in danger, here and elsewhere, of accepting the negative stereotype as his actual identity. At one point, he says that he feels like the word "Monster" has been stamped on his forehead.
Steve's sense of his self-identity is further strained when he realizes that his father is no longer sure of who he is. When Steve asks his father if he believes that Steve did nothing wrong, the father is unable to give him the reassurance he asks for, and instead tells him about his own aspirations for Steve, along with his failure ever to imagine visiting his son in prison (111-12).

The particular citation to the law for which you are being cited is A.R.S. 28-662

It is a class 2 misdemeanor if you were "involved" in the accident and did not remain at the scene.

Your defenses are did not know or have reason to know that damage was done, was not involved or duress.

Since the purpose of the law is to prevent hit and run accidents, and no one was hurt I recommend pleading not guilty and ask to waive counsel to speak to the prosecutor. If you weren't even involved, and just witnessed the accident, you have no obligation to stop and fill out a report.

If found guilty, I doubt you would get probation time let alone jail. A steep fine would be more like it and you face the possibility of the judge ordering your driver license to be suspended or restricted.

Went to Municipal court in 2007, was sent to Super court with added charge of Presenting a false document to a police officer.

Was offered and accepted into Pre Trial Intervention. At that time I was told if i accepted PTI and successfully completed it ALL charges would be dismissed.

Did community service, paid fines, got insurance, had car inspected - met all requirements of probation.

Now 8 years later I received a summons to appear in court because the 4 citations are still open.

Went to court, told Judge about Superior court, completed PTI, all charges dismissed... he did not care, said those remain open... suggested I get a lawyer and persue a dismissal based on lack of speedy trial.

I only learned about it when the judge made it aware to me. I received no defense for this charge at the preliminary hearing. I took a plea to a recovery court program to avoid state sentencing. I have fulfilled all my requirements with the court. Can I request the court reduce my felony charge to a misdemeanor, citing it may be a "wobbler" offense?

We submitted an invoice for the same amount which she is refusing to pay. She wanted great detail - which we provided in the form of hours and store receipts. After non-payment (and repeated emails - she refused phone calls), I filed a small claims case. A day after filing, she mailed a check for 16% less than full payment (before she was served) because this is what she deems fair. I cannot stop the small claims process at this point. Can I cash the check without it being considered payment in full? Can I notate the check as "accepted as partial payment" or something similar?

You can stop the small claims proceeding--just tell the judge that you want to. You cannot accept the check or cash it without risk of it being deemed full satisfaction. If you're getting almost 85% of your bill, you have to ask yourself whether it's really worthwhile pursing this any further.

Choosing to sentence someone as a Youthful Offender is discretionary if they meet the requirements for Y.O. sentencing. The key word in the Statute is "may" though. The court can chose to do this on a case by case basis so even if the judge has done this in very similar cases they do not have to.

The other party and I have the same insurance and in Feb. 2015 I sought legal advice and decided to sue the other party personally. The other party was granted an attorney from the insurance then, however I won the case. Now that the other party is looking to appeal (again is provided legal services through the insurance company) however I am not getting the same treatment. The insurance company declared the auto accident as a "no-fault" but when i took the party to court they were found at fault and ordered to pay. So now that the case is being appealed and I have to defend what I already proved in court shouldn't I be able to have an attorney appointed through my insurance?

Insurance companies provide attorneys for their insureds who are defendants. You are the plaintiff so you have to pay for your own. The situation does not change despite the fact that that defendant appealed the result.

Your former girlfriend is still part owner of the property and you will need her signature if and when you decide to sell the property. She will not be entitled to any increase in value of the property, but if and when you sell, the check will be issued in both your name and hers and if she demands one half of the check, you will have to take her to Court to determine your rights, so it would be a good idea to keep good records of all the costs and expenses you paid for since she left.

In the alternative, you could file an action in Partition and ask the Court to remove her name from the deed, however, you would have to be prepared to buy her out at the value the property had at the time she left and you started paying all the expenses yourself. Then, when you sold the property, any appreciation in the property would be yours and she would have no claim to it.

If a handicap room was available and offered at the same price as for comparable non-handicapped rooms, the hotel has complied with the law. You are not entitled to get preferential or discount rates because of handicap. If you took a cheaper non comparable room, that was your choice.

However, if you were actually charged 'extra' for a handicap room, that is a violation.

Your facts are not clear, since you say bottom floor rooms are higher regardless of disability, versus alleging the clerk was fired for trying 'to charge extra'.

I would look at your agreement. if you negotiated two weeks immediately then to avoid any confusion the agreement should have indicated something to the effect that the two weeks given to Employee are in addition to any schedule of vacation offered in the employee manual. It is almost impossible to get one's name off a mortgage. Could it be that he was ordered to refinance the home? The wording of the judgment governs when you are supposed to give him the quit claim deed. It may be at the time of the refinance or at the time of entry of the judgment. The terms of the judgment are not modifiable except by agreement of the parties. They are part of a property settlement. the court can enforce the agreement but it does not have the power to modify it.

You will have to go back into court and ask the court to enforce the terms of your settlement. Its called a rule to show cause. In the meantime, do not give your ex a quitclaim deed. If you do, you will still be liable on the mortgage but have no claim or right to the property. You should always wait until your name is removed from the mortgage before giving up your rights to a property.

Did the father demand money? I've heard several stories like that, and they sound like scams to me. After all, a father who was genuinely upset about something like this likely would not let it go in exchange for a quick payment.

The "son" may really be over 18. The photo might not really be him. The person in the photo might be over 18, whether it's the "son" or not. And the "father" may not be who he says he is.

I'm not saying this really is a scam. It might be exactly what it looks like. And I suppose there is some risk you could be prosecuted, though that depends on additional facts. (Did you ask for the photo? Had you already heard that the "son" was underage? Did you delete the photo? If so, when? What sort of things did you say after he told you he was 17?) Whatever you do, proceed with caution.

Since the custody order in 2010, my ex has denied me nine ordered visits, is 30 minutes or more late for exchanges about 95% of the time, failed to answer at least 40% of my phone calls to my daughter, refused to cooperate for getting my daughter decent insurance, taken my daughter to no dental visits, taken my daughter to no regular health checkups, discontinued ordered mental health care about one week after the order, failed to respond to repeated requests for documents for me to cover any medical or school-related costs, and made four moves without any (required 30 day) notice. She also has facilitated no contact with my daughter's Godmother or Aunt, and very limited with my parents. She's given harassed me by text and email over child support twice a month, despite support being paid ahead since support order took effect in December, 2011, too.

Our judge was her foster parent in her teens. The custody order in December, 2010, actually contains fabricated information to support the order. Her failed court-ordered drug tests somehow never made it into record, and have disappeared. I've gone through every cent of family and friends' money trying to work this out.

First, whatever your father "plans on" doing must obviously be appropriately planned while he still alive, by either executing a will or establishing a trust. If his will were to say that you and your sister would be the devisees of the house, presumably as a tenancy in common, then her rights would not trump your rights. Each of you would have equal rights. Which is a problem, because the relationship between you and your sister is clearly not good. There will need to be cooperation between the two of you. You don't say what other assets, if any, you expect to be part of your father's estate, but if it were possible for you and your sister to divide up the assets in a manner that would obviate the two of you sharing a single asset, that would obviously avoid a good deal of feuding.

Yes, but what are they going to do if you tell them? Fire you. What are they going to do if you don't tell them and they find out? Fire you. You do the math. Unless it is part of a negotiated personal employment contract like many high level executives get, with appropriate protections for employer and employee if the employee is considering leaving, I'm not sure how realistic such a requirement is.

Legal to ask? Of course. Legal to refuse them? Of course. Legal for them to fire you if you say you are looking? Of course. Give them notice only after you have a new job, unless you are sure they won't immediately walk you off premise when you tell them.

Whenever anyone asks whether something is "legal" in a contract, my response tends to be "What do you mean by legal?" Lawyers tend to think of legal and illegal as terms defining what is permissible and what is punished, particularly in a criminal law context.

Here, the better question might be whether such a contract provision is enforcible, and what would enforcement amount to.

Suppose you signed the agreement, then went and applied for a position at another company without telling the employer, thus violating the term of the agreement. If they find out, what can they do? Fire you? Sure, but they can do that anyway; they don't need a contract provision. Sue you? I think the judge would die laughing. The company could win, but its damages would be nominal ($1). Or, it could lose on the ground that such a contract provision is void under Business and Professions Code 16600, which declares any employment contract term that limits anyone from engaging in any lawful business, trade or profession to be void; such ruling resting upon the obvious purpose of the clause to restrict employment mobility, contrary to B&P 16600.

I would not encourage you to engage in a heated negotiation over this term in your employment contract. Go ahead and sign it. Then, when you get itchy feet, either report the facts of your other job interviews to this employer or not. What's the worst thing that can happen?

Look at this way, if you owed your ex-husband $40,000.00 and the house had gone up in value, your ex-husband would not be entitled to the increase in value. He would only be entitled to the amount he was entitled to when the divorce became final ten years ago. So, the bottom line is, he would not be penalized for the decrease in value or reap the benefits of the increase in value since divorce.

To be successful with a malpractice suit, you would have to prove 1. that he had some sort of duty to provide care for your pet and 2. that his actions or inaction fell outside of the normal standard of care. A bad result does not always equal malpractice. Their general defense is that they acted within the normal standard of care for that specific situation.

To be able to even file a malpractice action against the vet, you would first be required to find another vet and have that vet review the records and have that vet issue an opinion that the original vet did in fact commit malpractice. This can be an expensive and very complicated process. I certainly would not suggest doing this without an attorney.

We were both highly intoxicated and for some reason or another were not wanted back inside. How do we stop the HOA from doing this again since the bank refuses to finish the foreclosure and remove his name from the property because his lender is in bankruptcy themselves.

You generally will owe the fees as long as the property is in his name. You should have tried to negotiated a settlement providing that it was a full and final settlement of all claims related to the condo. Otherwise, if they have valid claims there is nothing stopping them from pursuing their claims. Even Bankruptcy does not discharge future HOA dues.

You do not fill out the exemptions if your husband has a judgment against him. Your husband has to fill out the exemptions.

Your husband cannot convey away assets now that he has a judgment against him; it would be a fraudulent conveyance if he signed his share of the car to you. You should have thought about this before the judgment was entered. Going forward, he cannot have his name on any assets as this poses a problem if you go to sell it.

Your car is not at risk for right now. Your husband is allowed to exempt up to $3500 equity in any one motor vehicle. That means that your half of the equity can be $3500 too. Right now, you only have $2000 equity total. The car is safe.

I suppose you could refinance and keep the car in both of your names. That would not be a problem as far as fraudulent conveyance law goes. If your husband gets served with exemptions, I would strongly encourage him to contact me or another attorney like me who assists clients in fillinmg out the exemptions properly for a reasonable fee. Long term, your husband needs to think about how he is going to resolve the judgment debt - by either paying or filing bankruptcy.

I would take immediate steps to try to have your record sealed. The rules and procedures depend on how old the cases are, whether they were felonies or misdemeanor . If they were misdemeanors and any probation ended more than five years ago, you can file a simple for, the the Board of Probation. I'd they are more recent, you'll need to ask a judge for this. If the record is sealed it comes back as "no record" on a CORI.

The BBC doesn't spend the money to get the rights to the music everywhere. BBC openly dislikes America, because we don't HAVE to pay the BBC, whereas in England if you want TV at all you have to pay the BBC. Because they have less of a market, because they would have to work harder for the same pay, and because rights for music are bloody expensive, they'll pay for the rights to music only in region-locked DVDs and on british television. BBC America usually has one or two kids on staff who can slap together music for them, mixed with music the BBC and BBC America have purchased unlimited rights to use and royalty free music.
Obviously I would never do this because that would be wrong, but apparently if you google top gear, and put in the season and episode, and look for the episodes that have been uploaded to streetfire.net, you can watch the episodes with the original british music.

My "Original" decree has a raised seal and says it is a true and correct copy certified from the records of......county, penna. The only signature is that of the Deputy Prothonotary. A contractor has to be licensed in New York to perform work. Did you check your contractor's credentials, his insurance binder and experience? Chances are, no matter where you sue him, you are going to hold the bag. I doubt he will answer your formal complaint. You can sue in New York Supreme Court, for Civil Court and small claims court have no jurisdiction and you are in for a pretty hefty bill in legal costs and bills. After not being able to get into my fathers house to go through/split belongings as what was in the will I called the lawyer and he was of no help and would not respond to me. I have a commercial building I'm leasing. my lease was over in Feb. The landlord sent me a letter in the mail on March 3rd stating he wants to increase the rent as well as have me responsible for utilities if the bigger unit next to me becomes vacant. The problem with this is that unit and mine share a meter. If I don't agree to this new provision by April 1st he has given me less than 30 days to find a new location. We have also been to court last year where I filed suit and won for a breach of contract and I know this is his way of retaliation by his comment "you had to have known this was coming." What can I do? Please help!

You would really need an attorney to review the lease and then advise you as the answer is going to be in the terms of the agreement. Generally, with proper notice, a landlord has the right to change terms (i.e. increase rent) after an agreement expires or is terminated.

The transaction is not complicated it would ivolve drafting a new deed and recording it. You would have to get a payoff figure from the mortgage company. They should then complete and file a mortgage satisfaction so that it shows on the record that the mortgage was paid . this would avoid problems in the future if it still showed up on credit reports. There would not be a transfer tax as it is a tax free transfer from parent to child unless it was being transferred to another unrelated party.
