Question

Last Feb. My brother took my mother out of her home and put her into a facility. He won't tell family or friends where she is or talk her. She had a reversed mortgage on her home but my brother's "real estate" girlfriend pulled some strings, got the home in there names and erased my name from the trust. Do i have a leg to stand on? Thank you, Steven Barnett

Answer

It sounds like your brother has committed or is committing "financial elder abuse". You need to consult with an elder law attorney to reverse the actions your brother has committed.

Answer

I suggest that you contact Adult Protective Services, and you should consult with an attorney as soon as possible. If they transferred your mother's home out of her name, you should file a lawsuit against them as soon as you can, allowing you to record a "lis pendans" (a lien) on the property preventing them from selling it or borrowing against it.
