Hello,

I live in Maddachusetts and I am considering a divorce to my husband. We have 3 children. My husband own's the home and the 2-cars are under his name. I depend on him financially because I am a homemaker, but I cannot be in this relationship anymore. I am not concerned if he or I gets 5 days with the children and the other two days go to he it. Can you please explain how I could afford an apartment and expenses since I am not working?

Answer

Depending on the length of marriage, your need, and your husband's ability to pay, you would be awarded spousal support/alimony to pay for your living expenses. If you are going to have physical custody of the children, your husband would be ordered to pay Child Support pursuant to Massachusetts Child Support Guidelines.

As for the two cars, the Court may order him to give up one of the cars for you if you need the car. Your husband may also be ordered to keep up the insurance on the car.

You said that he owns the house. So, I am going to assume that he purchased this property before the marriage. However, if he purchased the property during the marriage with his income from work and because he is the only one working the loan and title were put in his name, you would still have ownership in the property because the property would be considered marital property.



Answer

Depending on the custody arrangement and his finances, you may be entitled to alimony or child support. However, as a practical matter, you may also want to consider planning for your own employment as it will be very difficult to live comfortably relying on only his income.
