The question is a bit confusing. Under California Community Property anything acquired during the marriage, prior to the date of separation is presumably 50/50. That being said in your case it seems that legal separation has occurred. Anything purchased after this date is separate property; however you still could have monies owed to you if it was purchased with community property.
