I will like to know if I can sue Aeropostale for emotional damages and distress. I made two orders, and one was cancelled and when I called to ask why I was told that my billing address was wrong, funny thing is that the same address was used for the first order, and that was confirmed. I disputed this and I was told to re-order. the thing is if I re-order, I do not get the $25 off since the sale is over, I refused this and was given a case number and told to call back while they investigate, I call back and I'm told the order was cancelled because my bank did not allow the transaction, I call my bank and they say this is not possible as the transaction is still pending and can only be cancelled if the merchant does not come will necessary paperwork. I call Aeropostale and they say maybe my card was not recognized because its foreign, this is a lie cos I bank with BofA. So I was told to wait while the case was reviewed and then I get an email containing a different order number and stating why that order was cancelled, I call to tell them that is not my order number and gave them the real one. Funny thing is the order number in the email is invalid and does not exist. does aeropostale take me for a fool? I have had migraines cos of this and I am ready to sue.I have used my card and same billing address for a year, so there is nothing wrong with it.



Answer

No. In Illinois you get just economic damages. This does not appear worth a lawsuit.
