I have 2 children from the same mother and for the past 4years she has decided to claim both on her income tax. She had not worked in over 6years, do I have any right to claim them? I pay child support and have 40% joint custody of them... All her income and means to live have only come from the Welfare...



Answer

IRS rules clearly state that the parent having 51% or more time with the minor children have a right to the dependency exemption.
