A farmer leases a land. He plants orange trees. His lease expires. Is entitles to a) uprooting the trees and taking them with him, or b) harvest the oranges of those trees in perpetuity?
Answer
Neither. Anything that is affixed to the land becomes the property of the landlord upon expiration of the lease unless the lease or a side agreement provides otherwise. This most commonly happens when, for example, a commercial tenant leases raw land and builds a commercial building on it. The building reverts to the landlord upon expiration of the lease. The same goes, however, for plants.
